A client's tax question revealed connected issues involving residency, foreign income and company payments. ARG established the facts and separated immediate filing obligations from planning decisions. It documented the resulting position in a form the client could use with their accountant and bank, giving them a practical structure for addressing the issues together.
Tax advice should show which person or company has an obligation, which income or transaction creates it, what needs to be filed or paid, and which decisions can still be changed. For a cross-border matter, a residence card, foreign invoice or overseas bank account does not settle those questions. Immediate filing work and longer-term planning may need to run together, but their purposes should stay clear.
ARG can help you:
Start with who earns the income and which countries can tax it; citizenship, bank location and immigration status are separate facts.
Separate personal income, corporate profit, VAT and withholding so a payment is classified and reported by the right person.
Use contracts, residence certificates and tax-payment records to support exemptions, deductions and foreign-tax credit.
Track annual, quarterly and transaction-based duties; a first cross-border service or NRA notice can require action before year-end.
Start with the decision that affects you: moving to Bulgaria, receiving foreign income, paying a company owner, signing a cross-border contract or responding to the National Revenue Agency (NRA). Identify the taxpayer and tax year before comparing rates. Compliance means calculating, declaring and paying an existing obligation; planning means assessing a proposed step before it creates one; a dispute requires the procedure for an authority’s specific request or assessment. ARG connects those tasks with the contracts, accounting records and dates that determine the result.
For individuals, the Personal Income Tax Act, known in Bulgaria as ZDDFL, distinguishes residents generally taxable on worldwide income from nonresidents taxable on Bulgarian-source income. Article 4 uses alternative residence criteria, including permanent address subject to its centre-of-interests exception, presence exceeding 183 days in any 12-month period and the centre of vital interests. An immigration permit is not a tax conclusion. Establish homes, family, work and business connections, and use the relevant treaty if two states both claim residence. NRA residence criteria and certificate procedure
Bulgarian Tax Residency and Personal Income Tax Return are common starting points for expatriates and internationally mobile professionals. Establish residence before assessing the reporting treatment of salary, consultancy fees, remote work, rent, capital gains or mixed foreign income. A person carrying on their own activity may also need self-employment analysis and advance-tax calculations. NRA guidance addresses advance payments as well as annual filing, so the dates of receipts and payments belong in the initial review.
Corporate Tax Advisory addresses the company's taxable profit, losses and year-end obligations. The ordinary corporate income tax rate is 10 percent of tax profit, not 10 percent of bank receipts; the taxable figure is established under the tax rules from the accounting result. NRA corporate-tax guidance
A permanent establishment (PE) is a taxable business presence of a foreign enterprise. It is a tax concept, not simply another name for a registered subsidiary. Staff, premises or agents may require a review even where the foreign company has not formed a Bulgarian company. Permanent Establishment Risk and International Tax Planning examine the actual activity and any applicable treaty before reporting or restructuring decisions are made.
Select the service by the decision or obligation involved:
Withholding tax collects specified income tax through the payer, although some cases require the recipient to pay. For foreign corporate recipients, ZKPO Articles 194–200 provide 5% on covered dividends or liquidation shares and 10% on other covered income, subject to exemptions and treaties. Individual dividends belong to the Personal Income Tax Act instead. An EU/EEA corporate dividend exemption is not the same rule as the conditional interest-and-royalty exemption. Classify the recipient, source, income and tax base before applying a rate or arranging a net payment. ZKPO Articles 194–202 а
For an initial assessment, give ARG the taxpayer’s residence or incorporation details, the income or activity involved, the relevant dates and any outstanding NRA correspondence. These facts establish which reviews are needed and which obligations are urgent.
Client status determines whose income or activity is being assessed and which records support the analysis. An individual’s return, a Bulgarian company’s accounts and a foreign company’s local operations require different evidence, even where they form part of the same business arrangement.
An individual moving to Bulgaria, working remotely, receiving foreign salary, earning rent or selling assets needs residence and income-source analysis. That establishes what belongs in a Bulgarian return and whether treaty relief may be relevant. The review should also identify whether the instruction is limited to a completed tax year or includes planned changes to work, residence or investments.
A Bulgarian company may need corporate tax advice, VAT registration, transfer pricing documentation, withholding analysis or audit defence. The Tax and Social Insurance Procedure Code (ДОПК) governs filings, audits, objections, collection and refunds. Accounting data and corporate records must therefore support both the tax treatment and any later explanation to the NRA. Related-party transactions, foreign ownership and cross-border invoices often require coordinated records across several tax obligations.
A foreign company needs to assess the consequences of its Bulgarian income and operations even without a Bulgarian subsidiary. Staff, agents, a fixed place of business, recurring local services and payments from Bulgarian counterparties can warrant permanent establishment, treaty, withholding, VAT or transfer pricing analysis. Contracts must be read alongside the way the business actually operates.
The core evidence differs by client type:
Tax Consultation Bulgaria brings these facts together where the applicable obligations are unclear. If an NRA letter, inspection notice or refusal has already arrived, include it at the outset: NRA Tax Audit & Appeal Support may be needed immediately under the ДОПК procedural rules.
Record who earns the income, what creates it, when the relevant event occurs and where the underlying activity or asset is located. These facts often explain why two transfers of the same amount receive different treatment. A shareholder loan repayment is not a dividend; a salary for work performed in Bulgaria is not necessarily foreign-source because an overseas employer pays it; a company’s retained profit is not automatically its owner’s personal income. Include the legal basis and gross amount in the income schedule, with any tax withheld and supporting documents. The resulting classification tells you which specialist service, declaration or registration is needed and which facts still require confirmation.

Employment, self-employment, rent, dividends, services and a foreign company’s Bulgarian operations can engage different tax rules. For individuals, residence under the Income Taxes on Natural Persons Act (ЗДДФЛ) establishes the scope of taxation. The income’s character and the date it arose then determine the relevant treatment and payment timing.
For employment and self-employment, establish where the work is physically performed and how the income is earned. 'Advance tax' means tax assessed during the year before the final annual calculation; it is not an optional prepayment. NRA guidance describes a 10 percent rate on the relevant tax base for employment and specified other income, with deductions and rules that differ by category. Do not apply 10 percent to every gross receipt. Record tax already withheld, contributions, contracts, work locations and payment dates so the annual review can reconcile what remains due.
For rent, identify the owner’s residence, property location and the payer’s status. Ordinary resident-individual rent generally uses a 10% statutory expense deduction before 10% tax, while nonresident Bulgarian-source rent ordinarily follows a gross final-tax regime, subject to applicable relief. Short-term accommodation can instead be business or patent-tax activity and may raise tourism and VAT duties. Bring the lease or platform terms, occupancy pattern, gross receipts, commissions and withholding records; the word “rent” on a statement does not settle all those issues.
For dividends and service fees, establish why the payment is owed and when the relevant tax obligation arises. A dividend is a distribution to an owner; a director payment or consulting fee pays for a different legal relationship. They cannot be assigned the same treatment just because the same person ultimately benefits. Use the withholding categories and exemptions explained above, then test any treaty relief. For related-party payments, retain evidence of the work performed and the basis for the price as well as the invoice.
Recurring services, personnel, agents or a fixed place of business in Bulgaria may warrant Permanent Establishment Risk analysis. The question is whether the foreign business’s presence creates a Bulgarian taxing connection. A double tax treaty may affect Bulgaria’s taxing rights or support a reduced withholding position. Connected companies, intercompany invoices and shared management can also bring transfer pricing into the same review.
Hypothetical example: a foreign group company invoicing Bulgarian customers while using Bulgarian-based staff may need three linked checks: whether the activity creates a taxable presence, whether payments attract withholding or treaty relief, and whether intercompany pricing is defensible. That can require International Tax Planning, Permanent Establishment Risk, Withholding Tax Bulgaria and Transfer Pricing Bulgaria together.
Provide the following facts for each income stream or activity:
Support these facts with contracts, invoices and the payment trail. They allow ARG to identify the applicable rule, relevant tax period and evidence needed for the proposed treatment.
Identify the action needed and its deadline: a return, registration, relief claim, advisory assessment or response to an authority. The Tax and Social Insurance Procedure Code (ДОПК) provides the procedural framework for filings, audits, objections, collection and refunds; the evidence and route depend on the action involved.
For a filing, establish whether the return is personal, corporate or information based. Personal filings may depend on residence and income-source findings. Corporate filings may require accounting records, profit allocation and payment support. Resolve those classifications before submitting the declaration.
For VAT, place of supply means where the transaction is treated as occurring for that tax. It is determined by the type of supply, customer status, relevant establishment and any special rule, rather than the bank account receiving payment. Article 97a may require a Bulgarian business to register for specified incoming reverse-charge services or outgoing EU B2B services before its turnover reaches the general threshold. Identify the customer’s business status, contract, first tax event and any advance before issuing the first invoice. NRA VAT registration grounds
From 1 January 2026, NRA guidance sets the general registration trigger for persons established in Bulgaria at annual domestic turnover exceeding EUR 51,130, with an application within seven days of exceeding it. The turnover calculation follows the statutory rules, not simply all receipts in a bank account. Separate registration grounds and cross-border rules can apply below that threshold. Provide the current and prior year's transaction records so the relevant rule and period can be checked. NRA VAT registration guidance
A tax treaty is an agreement allocating taxing rights and providing relief between countries; it is not a blanket exemption for foreign income. For a treaty or withholding claim, prepare the recipient's residence evidence, the contract, payment description, ownership or counterparty chain and records of tax already paid. The adviser must match those facts to the applicable treaty article and claim procedure.
An advisory review establishes the reporting and registration obligations before action is taken. It may combine personal or corporate tax, VAT, transfer pricing and treaty analysis. The resulting advice should identify the required steps and their supporting evidence, including whether a proposed filing is needed.
If the NRA contacts you, keep the complete notice and record when it was served. A request for information, an audit report and a tax assessment are different procedural stages. The report can call for an objection and supporting evidence; an assessment may require an administrative appeal followed, where appropriate, by court review. A routine reply should not be mistaken for an appeal. Give the adviser the challenged period, filed returns, calculations and underlying documents so the response addresses each finding and the correct deadline. Tax and Social Insurance Procedure Code: control and appeal procedures
An NRA notice should be assessed for its deadline, the period it covers and the evidence it requests.
Before any deadline expires, give ARG the return or notice, contracts or invoices, payment evidence and prior NRA correspondence. These documents establish whether the immediate task is a filing, registration review, relief claim, advisory memorandum or response to the authority.
Bulgaria-only advice applies Bulgarian law, the relevant treaty and the NRA procedure to your facts. A comparison with England and Wales can explain differences in residence, source, entity classification and payment treatment where that helps a relocation or business decision. Any tax exposure in another country still needs assessment under that country’s law.
A comparison is most useful when relocating, choosing between a local company, a foreign company and an individual contracting arrangement, or considering salary, dividends and service fees. It should identify the rules and evidence relevant to each option. Bulgarian filing and relief requirements must then be addressed under the applicable Bulgarian and treaty provisions.
Tell ARG which countries and options you want assessed. Provide the dates, each payer’s and recipient’s country, the income or activity, company documents, contracts or invoices, and any NRA letters or advice already received abroad. That defines the scope of the Bulgarian review and any comparison needed for the decision.
The final action list should identify the taxpayer, procedure, responsible person, deadline and documents supporting the treatment. For a foreign-tax credit, retain evidence of the gross income and tax attributable to it; an excessive foreign withholding may require a refund in that country. For company payments to an owner, retain the decision or contract establishing the payment. For cryptoasset disposals, preserve acquisition costs and a transaction ledger, distinguish transfers between your own wallets and check whether activity amounts to a trade. These records serve different questions and should not be replaced by one unexplained bank statement.
Revisit the analysis when the facts change: an employee starts working in Bulgaria, an owner changes profit rights, a new service is purchased from abroad or a transaction crosses the relevant threshold. A residence certificate supports a stated period and purpose; it does not freeze future residence or establish a company’s treaty entitlement. A useful tax plan therefore includes the events that require a fresh check, alongside the immediate filing calendar.
