Clients often ask ARG whether they can explain their side at the first hearing after receiving a Bulgarian claim. Waiting can mean losing objections and evidence before that hearing begins. The immediate task is to understand the precise demand, the service date and the facts that could defeat or support it.

ARG can arrange advice and representation by authorised Bulgarian attorneys where these situations arise.

  • Court papers arrive while the defendant is abroad.
  • A claimant seeks payment from the wrong person or company.
  • A technical dispute needs expert evidence before repairs alter the property.
  • A judgment appears to ignore a decisive objection or evidence request.
  • Settlement, an appeal or enforcement must be compared against likely costs.

At a glance

(001)
Procedure protects the substantive position

A sound argument must be raised and supported at the stage when the court can consider it.

(002)
Admissibility and merits are separate

A jurisdictional or procedural objection does not necessarily replace preparation of the substantive defence.

(003)
Evidence must answer the legal question

Documents, witnesses and experts serve different functions and should support identified disputed facts.

(004)
Appeal is a defined remedy

Review has procedural limits, and cassation is subject to separate conditions rather than an automatic third hearing.

What is the difference between a civil claim and the procedural defence to it?

A claim asks the court to grant a defined remedy. A defence seeks to prevent that remedy through disputed facts, an independent defence or a procedural objection. The framework is the Bulgarian Civil Procedure Code (Граждански процесуален кодекс, ГПК), including Articles 124 and 131. The written defence under Part 15 of the Civil Procedure Rules in England and Wales is a limited structural comparison, but Bulgarian response periods and preclusion rules apply independently.

How do jurisdiction, admissibility and legal interest affect whether a case may proceed?

Jurisdiction concerns the competent court; admissibility concerns whether the requested judicial protection can be examined at all. The level of court follows Articles 103 and 104 of ГПК and the nature and value of the claim. Losing on the facts is different from having an inadmissible claim. A declaration also requires a present legal interest, not simply curiosity about how a hypothetical dispute might be resolved.

For domestic territorial competence, different claims have different connections. Claims against a legal person ordinarily relate to its seat under Article 108(1) of the ГПК, with the stated option for disputes directly connected to a branch. Specified claims concerning rights in immovable property and certain contracts affecting those rights belong at the property's location under Article 109. Consumer proceedings have their own rule under Article 113. A claim for a contractual payment should not automatically be treated as a property rights claim simply because the underlying work occurred in an apartment. The requested protection and legal relationship remain decisive.

A civil claim begins with the right asserted and the interference requiring judicial protection. The general basis in Article 124(1) of the ГПК permits proceedings to restore an infringed right or establish the existence or absence of a right or legal relationship where there is an interest in doing so. The requirement of interest is particularly important for a declaratory claim. Courts do not provide abstract advisory opinions about hypothetical disagreements. A claimant should explain the concrete uncertainty or interference and how the requested declaration would remove it, rather than merely seek judicial approval of a preferred interpretation.

Why does the court decide claims on pleaded facts rather than general unfairness?

The first task is to identify the claim that has actually been brought. A demand for compensation, a demand for payment under a contract and a request to establish a disputed right do not have identical legal elements. The defendant should distinguish the claimant's factual account from its legal description and requested outcome. A mistaken statutory label does not necessarily defeat an otherwise properly pleaded claim, because the court determines the legal classification. By contrast, an unclear allegation about who acted, what happened or what relief is sought may prevent a meaningful defence until the pleading is clarified.

The claim must present its factual foundation and the requested judicial response with sufficient clarity under Article 127. The factual account should identify relevant events, not reproduce every exchange in chronological order without explaining their legal significance. For example, an advance payment, a promised completion date, an alleged defect and a later agreement may each perform a different function in establishing the right asserted. If the pleading is irregular, Article 129 provides a correction procedure and consequences for noncompliance. Correcting a missing formal element is different from proving a disputed fact, and a regular claim can still fail on its merits.

What must a defendant do immediately after receiving a statement of claim?

A response in ordinary claim proceedings is generally due within one month after service under Article 131(1) of the ГПК. That period should not be applied indiscriminately to every civil or commercial document. A commercial dispute proceeding under the special rules can carry the two week response period in Article 367(1). The relevant starting point is legally effective service, not necessarily the day the defendant personally opened an envelope. For a company, receipt at its office and the consequences of leaving its registered address require particular attention under Article 50. An employee's acceptance can matter even when management is travelling.

Defences should be pleaded with their factual basis and available supporting documents. A statement that all allegations are denied may leave the court without a clear account of which events are disputed and why. A payment defence should identify the transfer, recipient and obligation discharged. A limitation defence needs the relevant dates and any alleged interruption addressed. The response should also identify evidence that cannot presently be produced and the fact it would establish. The requirement in Article 131(3) is not satisfied by a general promise to bring documents later when the case becomes more serious.

Delay can close procedural opportunities even where the underlying argument might have been strong. Failure to respond or raise specified objections and requests in time can lead to preclusion, subject to the statutory exception for particular unforeseen circumstances under Article 133 of the ГПК. The Supreme Court of Cassation confirmed the importance of timely objections in Interpretative Decision No. 1 of 9 December 2013, interpretative case No. 1/2013, General Assembly of the Civil and Commercial Colleges. Its discussion of appellate proceedings rejects the assumption that a defendant can ordinarily save limitation and similar objections for appeal after having had a proper earlier opportunity.

A missed response does not by itself mean that the claimant automatically wins. A default judgment requires the additional conditions in Articles 238 and 239 of the ГПК, including the relevant failure to attend the first hearing, absence of a request for the case to proceed in the party's absence, the opposing party's request, prescribed warnings and the statutory assessment of probable merit. Nevertheless, attending the hearing after silence may not restore objections already lost. Representation therefore addresses both the immediate default risk and the less visible loss of individual procedural rights, which are separate consequences of inactivity.

Which objections can be lost if not raised at the appropriate stage?

How are counterclaims, set-off and jurisdiction objections distinguished?

A counterclaim requests an independent award against the claimant. It must be filed within the response period, fall within the same court’s subject-matter competence and be connected with the original claim or capable of set-off under Article 211 of ГПК. It follows the requirements for a claim. A set-off objection instead uses a reciprocal claim defensively against the amount demanded. If a defendant wants payment of an excess, merely asking that the original claim be dismissed does not request that affirmative award. A jurisdiction objection concerns the forum, not whether either party owes money.

An objection to the wrong court also has its own timetable. Subject matter competence, property location competence and other forms of territorial competence are not subject to identical rules under Article 119. Many ordinary territorial objections must be raised by the defendant within the response period, whereas other categories permit official examination within specified procedural limits. Evidence supporting the objection must accompany it under paragraph 5. Consequently, a defendant who participates without addressing an available territorial objection may lose the opportunity to rely on it later, even though the address facts themselves have never changed.

Who must prove each material fact and when may expert evidence be decisive?

The allocation of proof follows the facts relied on by each party. A claimant ordinarily proves the facts creating the asserted right, while a defendant proves independent facts supporting a defence, such as performance under Article 154(1) of the ГПК. Denying that a payment ever became due differs from alleging that an admittedly due payment was made. The first position contests an element of the claim; the second introduces an extinguishing fact. Both may require evidence, but the risk of an unresolved factual issue falls differently. Statutory presumptions can alter that allocation and must be identified rather than assumed.

An expert becomes necessary when the court requires specialised knowledge under Article 195. The questions should address the actual disputed elements, such as whether a repair method corresponds to the observed damage or whether another source could explain it. Experts do not decide who legally owes compensation. Their conclusions remain evidence that the court evaluates alongside the rest of the case under Article 202. An incomplete or unclear report may require supplementation, while an unfounded conclusion or doubt about its correctness can justify a further expert examination under Article 201. Mere disagreement with an unfavourable figure is not a developed technical challenge.

What is the difference between interim measures and the final judgment?

An interim attachment protects the practical possibility of later recovery; it does not establish that the debt exists or pay it to the claimant. Security for a pending claim is available under Article 389 of ГПК. The ordinary conditions in Article 391 require a risk that realisation of the judgment would otherwise be impossible or difficult and convincing written evidence or security, with the court able to require security even where documents exist. Special statutory restrictions remain relevant. A threatened disposal of the only identifiable asset may explain the risk more clearly than an unsupported accusation that the defendant is dishonest.

Security before a future claim follows Article 390 and the court’s deadline for filing the claim, no longer than one month. Failure to prove timely filing leads to cancellation. The measure must match the relief and property concerned. A frozen bank account and a preserved technical inspection perform different functions. The eventual judgment decides the pleaded right on the evidence, whereas the provisional order addresses a temporary risk. A defendant may contest the measure through Article 396 without treating that challenge as a substitute for the defence on the merits.

Where an evidential condition may disappear, Article 207 permits advance collection when evidence risks being lost or becoming difficult to obtain. The application should identify the evidence, the relevant fact and the concrete danger. Dismantling a machine, repairing a damaged room or a witness's impending inability to testify may require different procedural measures. The application does not itself decide liability or guarantee that the later claim will succeed. It preserves a source of proof so that the eventual court can evaluate the merits on a more reliable factual basis instead of speculation about a condition that no longer exists.

When is an appeal available and what does it permit the court to reconsider?

An ordinary appeal generally must be filed within two weeks after service of the judgment under Article 259(1) of the Bulgarian Civil Procedure Code (Граждански процесуален кодекс, ГПК). A restrained comparison is the formal written defence framework in Part 15 of the Civil Procedure Rules in England and Wales; neither that procedure nor its periods can be imported into Bulgarian litigation. The Bulgarian appeal identifies the challenged part, the error and the requested result. New evidence is restricted by Article 266, so appeal is not a fresh opportunity to submit everything omitted at first instance.

The scope of review is structured rather than unlimited. The appellate court examines validity of its own motion and admissibility within the appealed part, while ordinary review of correctness is generally bounded by the complaints raised under Article 269 of the ГПК. Important qualifications include application of mandatory substantive rules and protection of interests for which the law imposes an official duty, as confirmed in Interpretative Decision No. 1 of 9 December 2013, interpretative case No. 1/2013. It would therefore be inaccurate either to promise a complete rehearing of every issue or to say that the court can never examine an unmentioned legal question.

A judicial error in directing the evidence can have a different consequence from a party's omission. In Interpretative Decision No. 1 of 9 December 2013, interpretative case No. 1/2013, General Assembly of the Civil and Commercial Colleges, the Supreme Court of Cassation addressed evidential opportunities on appeal following a reasoned complaint about a deficient first instance report. The practical lesson is to record the precise issue when it arises. If the report allocated proof incorrectly, the party should identify the affected fact and proposed evidence. That creates a coherent basis for correction instead of a later claim that the proceeding was generally unfair.

How should foreign-language documents and witness evidence be prepared?

Material in another language requires a Bulgarian translation under Article 185. The provision calls for an accurate translation certified by the party and allows expert verification where its accuracy cannot otherwise be checked or is challenged. The practical issue is not only translating ordinary words. A term describing acceptance, cancellation or reservation may carry a meaning central to the pleaded facts. The original and translated text should remain connected so that a contested expression can be examined. A fluent informal summary sent to the lawyer is useful preparation but is not a substitute for the document required in the proceeding.

Witness examination should focus on what the witness personally perceived and how that perception relates to the contested event. A person present at delivery may identify the equipment and visible condition but may not know the contractual specifications. A colleague repeating a later explanation may have little direct knowledge of the underlying cause. Questions should separate observation from inference and identify uncertainties about time, location and participants. The evidential request must describe the facts the witness will establish under Article 156. Bringing several people to repeat the same peripheral point does not compensate for having nobody who observed the decisive event.

What happens if papers were served at an outdated address?

Service at an old address is neither automatically valid nor automatically ineffective. The file must show which address was used, who received the papers, whether substitute service under Article 47 was justified and whether required checks occurred. A party absent for more than a month from an address given in the case or previously used for service must notify the court under Article 41 of ГПК. After the required warning, failure can result in papers being placed on the file and treated as served. A company leaving its registered address without recording a new one faces the separate consequences in Article 50.

The remedy depends on the stage and kind of decision. For a default judgment, Article 240(1) provides a special application to the appellate court within one month of service where the statutory deprivation-of-participation grounds exist. That is different from an ordinary merits appeal. The envelope, process server’s record, address history and proof of when the obstacle arose can therefore decide the available remedy. Simply stating that the client never personally saw the claim does not establish defective service on an authorised recipient.

Deadlines require a distinction between extension and restoration. A request under Article 63 must be made before the period expires and supported by good reason, and appeal periods are excluded from that extension mechanism. A request to restore a missed period under Articles 64 and 65 needs the special unforeseen circumstances specified by law, timely filing and the omitted act together with the application. Ordinary travel or a delayed internal exchange should not be assumed sufficient. Evidence should show how the obstacle actually prevented the procedural act and why it could not reasonably have been overcome through the available representation arrangements.

Can an unsuccessful party face litigation expenses even if the claim appeared weak?

Yes. Costs follow the actual procedural outcome and the statutory exceptions, not a party’s early impression that the opponent’s claim looked weak. The successful claimant can recover qualifying costs proportionally under Article 78(1) of ГПК, while the defendant’s entitlement tracks the dismissed part under paragraph 3. A claimant who proves only a small portion of an inflated demand may face the opponent’s costs for the rejected portion. Receipts, the legal services agreement and evidence of relevant expenditure matter. The costs list under Article 80 must be submitted by the end of the last hearing in the instance to preserve the specified opportunity to seek amendment of the costs ruling.

What can settlement achieve before or during proceedings?

A judicial settlement has a defined procedural status. The court approves and records an agreement that does not conflict with law or good morals under Article 234(1) of the ГПК. It has the significance of a final judgment and is not appealable before a higher court under paragraph 3. This makes accuracy particularly important before approval. A client should not assume that an ambiguous payment clause can later be corrected through an ordinary appeal simply because the practical consequences were misunderstood. The court's approval does not replace the need for clear terms addressing the real dispute.

Withdrawing proceedings and waiving the disputed right are materially different. Withdrawal without the defendant's consent is available until the end of the first hearing, subject to the provision's rules under Article 232. A waiver under Article 233 prevents the same claim from being brought again. A client who intends only to pause litigation while receiving instalments should not accidentally authorise a permanent abandonment of the right before payment is secure. The correct mechanism depends on the agreement and procedural stage. Its wording should reflect whether the dispute is being finally resolved or merely removed from the present proceeding.

The parties can settle only part of the case. Proceedings continue for the unresolved part under Article 234(4). This can be helpful where an undisputed amount can be paid immediately while a technically complex defect remains contested. The boundaries should be explicit so that an agreement about one invoice does not unintentionally release claims concerning another project or period. A partial settlement should also explain how the remaining claim is calculated after performance. Otherwise the parties may agree on a headline figure while leaving uncertainty about credits, interest or the scope of the continuing litigation.

Which decisions can later be enforced against assets in Bulgaria?

Enforcement needs an enforceable obligation, not merely favourable reasoning. The categories in Article 404, item 1 of ГПК include final court decisions, appellate judgments ordering performance, judicial settlements and acts subject to preliminary or immediate enforcement. The creditor normally requests a writ under Article 405 and then applies to an enforcement officer under Article 426. A declaration about ownership cannot simply be treated as an order to pay compensation that was never awarded. The operative ruling identifies the debtor, the required performance and the limit of compulsory recovery.

Finally, the effect of the judgment depends on its scope and finality. A finally resolved dispute cannot simply be restarted between the same parties for the same request and basis because a better document has later been found under Articles 298 and 299. The client should identify whether the result requires payment, establishes a right or rejects the claim, and what voluntary performance would satisfy it. The practical response may involve compliance, an available appeal or implementation of the awarded relief. Each step follows from the actual judicial outcome and current procedural position, rather than from the expectation that litigation remains indefinitely open to revision.

How can a client abroad conduct a Bulgarian civil case effectively?

Which court and representative can obtain the particular result required?

The competent first-instance court follows the nature and value of the claim under Articles 103 and 104 of ГПК, alongside the applicable territorial rule. An appeal is lodged through the court that made the decision under Article 259 and goes to the competent higher court; a cassation complaint follows the separate admission requirements in Article 280. Hiring a lawyer based in Sofia does not move a property case from the court at the property’s location. International jurisdiction must be established separately where the parties or relevant events are abroad.

The required authority should be tailored to the acts contemplated. A signed power of attorney establishes the representative's procedural authority under Article 33, while Article 34 distinguishes general conduct of the case from acts requiring express authority. Settlement, waiver, admission and receipt of money are particularly consequential. A client should understand those powers before execution and should not rely on an informal message to replace a required formal authorisation. Equally, an authority limited too narrowly may prevent a beneficial act when a deadline is close. The document should reflect the intended scope of representation and the client's actual decisions.

Which foreign judgments and documents can actually be used in Bulgaria?

A judgment from another country is not treated as a Bulgarian enforcement instrument merely because it has been translated. Where Regulation (EU) No 1215/2012 applies, a judgment enforceable in its Member State of origin can be enforced in another participating Member State without a declaration of enforceability under Article 39. The applicant provides an authentic copy and the Article 53 certificate under Article 42, with translation where required. The Regulation’s subject matter and temporal scope must be checked. Family status, succession and insolvency are not ordinary civil and commercial judgment matters within its scope.

Outside that framework, the applicable treaty and Bulgarian recognition procedure must be identified before promising recovery. Within the Regulation, the receiving court cannot retry the merits under Article 52, although the specified refusal grounds remain relevant. The creditor should identify assets in Bulgaria and the exact person liable under the foreign ruling. A judgment against a company does not authorise attachment of its director’s personal bank account merely because the director controlled the business. Separate obligations, ownership and the terms of the enforceable instrument remain decisive.

Questions and answers

01 / 06

Can I wait for a translation before considering the response deadline?

The deadline must be assessed from the applicable service rules and actual procedural documents. The date a translation reaches your adviser does not necessarily determine its start.

Does challenging jurisdiction make a substantive response unnecessary?

Not necessarily. The available objection and the obligation to present facts, defences and evidence must be assessed together to avoid losing procedural rights.

Can an expert decide who should win the case?

An expert addresses specialised factual questions. The court determines legal responsibility and evaluates the report with the other evidence.

Does every unfavourable judgment receive Supreme Court review?

No. Cassation requires the applicable admission conditions and is subject to statutory exclusions. The particular decision and proposed legal grounds must be examined.
