Before agreeing a buyout, establish which shares actually belong to each spouse or heir. ARG assists with ownership disputes, compensation arrangements and voluntary or judicial partition.

Clients often ask ARG whether a home must be divided equally when only one former spouse is named in the deed, or whether a surviving spouse owns half before the children inherit. Those questions cannot be answered from the deed or property valuation alone. The acquisition history determines whose share is available for division.
Our Bulgarian attorneys can assist in situations including the following.
The origin of each share must be established before value and distribution can be agreed.
The surviving spouse’s existing property must be separated from the estate before inheritance shares are calculated.
Mortgage repayments, repairs and use of the home can support separate claims without transferring another owner’s share.
Compensation, possession, registration and lender obligations should be coordinated with the legal division.
The name in the deed is not decisive where the statutory community regime applies. A purchase during marriage may belong to both spouses, even though only one signed, while inherited property can remain personal despite years of family occupation.
The first distinction concerns the source of ownership. Rights in property acquired during marriage through joint contribution fall within the statutory community regime regardless of the name in the acquisition document under Article 21, paragraphs 1 to 3, of the Bulgarian Family Code (Семеен кодекс, СК). Contribution includes more than direct payment. Personal work, childcare and work in the household can matter, and joint contribution is presumed. For readers familiar with England and Wales, the closest broad comparison is matrimonial property adjustment under section 24 of the Matrimonial Causes Act 1973, although Bulgaria's statutory community and tracing rules are a different legal structure and must be applied on their own terms.
The acquisition date and the applicable matrimonial regime must therefore be checked before drawing conclusions from the deed. A marriage agreement or a chosen regime of separation may change the analysis. A property bought before the marriage, inherited by one spouse or received by that spouse as a gift may be personal under Article 22, paragraph 1, СК. None of those descriptions should simply be assumed from family recollections. The underlying transaction, the intended recipient and the documents connecting it to the asset need to be established. A parental contribution may have been a gift to one spouse, a gift to both or a loan requiring repayment.
A gift or inheritance used for the purchase can support personal ownership of all or part of the new asset. A loan from a parent is different because repayment is owed. Calling borrowed money a family contribution does not establish a gift to one spouse.
Personal-property transformation under Article 23 СК works differently. It concerns the use of personal assets in the acquisition itself. Suppose a person sells a property inherited from a parent and applies its proceeds to part of the price of a home bought during marriage. The analysis should identify the inherited property, establish the sale proceeds and trace the amount actually applied. The proportion cannot safely be calculated from the sale price of the former property alone if some of that money was spent elsewhere or if the new acquisition was financed at several stages. Purchase costs, loan financing and later improvements also need to be kept conceptually distinct.
The Supreme Court of Cassation made the distinction especially clear in Interpretative Decision No. 2 of 20 January 2025 in interpretative case No. 2/2022, adopted by the General Assembly of the Civil Chamber. Personal transformation and rebuttal of joint contribution are different grounds, even though both may exclude community ownership. The practical lesson is to plead the facts that support the actual ground relied on. Saying that the other spouse did not transfer money into the account does not establish the personal origin of its balance. Saying that money came from an inheritance does not require accusing the other spouse of making no contribution to family life.
If an apartment was entirely matrimonial community and the deceased leaves a spouse and two children, the surviving spouse ordinarily retains their own half. The deceased’s half is then divided equally between the three heirs, giving the spouse two thirds of the whole and each child one sixth, assuming intestacy and no other material circumstance.
An estate contains the deceased's rights, not everything that the family associated with that person. The Bulgarian Inheritance Act (Закон за наследството, ЗН), read with the actual title documents, is therefore applied only after identifying what the deceased owned. The nearest general comparison in England and Wales is the administration and distribution of a deceased person's estate under the Administration of Estates Act 1925. The comparison is limited because the Bulgarian system of heirs, acceptance and reserved shares has its own structure. It is particularly important not to import assumptions about an executor's powers or a surviving spouse's entitlement from another legal system.
Where a dwelling belonged to matrimonial community, death first ends that community. The surviving spouse's own interest must be distinguished from the part that enters the estate. Succession is then calculated over the deceased's interest. If the deceased also owned a separate inherited plot or a personal interest acquired before marriage, that asset may enter the estate on a different basis. The fractions can consequently differ from asset to asset. A single statement that the spouse receives half and the children divide the rest may be wrong if it is applied indiscriminately to both common and personal property.
The rules for descendants and a surviving spouse in Articles 5 and 9 ЗН provide the starting point for intestate shares, but the family tree and relevant documents must be complete. A child from an earlier relationship does not lose their status because the later family was unaware of them. A deceased heir may have transmitted an acquired interest to their own successors. A will may alter the distribution, subject to the applicable protection of reserved shares. These possibilities should be investigated before a draft agreement describes two siblings as the only owners or calculates compensation solely from the certificate they happened to obtain first.
Yes. The owners may agree that one keeps the apartment and pays the others, divide several properties into separate allocations, or preserve co-ownership with agreed shares. The agreement must distinguish recognition of existing ownership from a new transfer of an interest.
An agreement is most useful when it resolves both the legal position and the practical arrangements that otherwise keep the dispute alive. The Bulgarian Ownership Act (Закон за собствеността, ЗС) recognises an owner's right to seek partition in Article 34 and sets the form for voluntary partition of immovable property in Article 35, paragraph 1. In England and Wales, disputes concerning interests in land may be addressed through the trust-of-land framework, including section 14 of the Trusts of Land and Appointment of Trustees Act 1996. That is only a functional comparison. A Bulgarian agreement must satisfy Bulgarian rules on ownership, participation and form.
For an apartment that cannot sensibly become separate legal units, the usual commercial discussion is whether one owner can acquire the others' interests or whether everyone should cooperate in a sale. An informal promise that one person will take the flat and pay later leaves too many unanswered questions. The agreement needs an identifiable asset, the interests being transferred, an intelligible calculation of compensation and a workable payment arrangement. The parties must also decide when possession changes, who bears agreed transaction expenses and what happens to utility accounts, keys, stored belongings and any existing tenant. These are substantive protections against a second dispute.
The court cannot divide an asset on assumed fractions and leave ownership for later. Its first-stage decision fixes the participants, property and shares. A dispute about personal purchase funds, an earlier gift or a will therefore belongs in that determination.
Judicial partition is organised around two different questions. The Bulgarian Code of Civil Procedure (Граждански процесуален кодекс, ГПК), Articles 341 to 355, first provides for determining the people, property and shares involved, and then for carrying out the division. Civil proceedings in England and Wales are similarly governed by procedural rules, but a trust-of-land application there is not a substitute for this Bulgarian two-stage process. Understanding the separation is important because the first decision does not necessarily give a participant a particular room, apartment or payment. It establishes the legal basis on which the second stage proceeds.
The initial claim must accurately identify the property and the other participants and be supported by the relevant documents. In an inherited estate, Article 341 ГПК expressly addresses evidence of the death, heirs and estate property. Problems in an old deed or differences between a historic description and the current cadastral information should be investigated early. They may require additional documents or technical evidence. A court cannot sensibly divide an asset described so imprecisely that the parties are disputing different objects. Nor should the claimant omit a known co-owner in the hope that service abroad will otherwise be avoided.
A larger payment does not automatically mean a larger ownership share. Personal transformation, absence of any joint contribution and a claim for a larger matrimonial share are different routes. Choosing the wrong route can leave an otherwise relevant payment history without the remedy the client expected.
The first hearing is a significant procedural point. Objections to another participant's entitlement, the size of their share and the inclusion of particular property fall within Article 342 ГПК. Related disputes, including specified inheritance issues, may be examined within the partition proceedings under Article 343 ГПК. These rules make it risky to present only a general account of family unfairness and postpone the actual legal objection. The lawyer must identify what is contested, the remedy required and the evidence supporting it. The precise procedural treatment of a particular claim depends on its nature, and some claims require a separate action rather than casual mention in the partition case.
Under the statutory community regime, the question whether property became common is different from the question whether the contributions were equal. Joint contribution includes financial input, labour, childcare and household work under Article 21, paragraph 2, СК. A spouse who earned less may still have made a legally relevant contribution, and a payment history cannot be read in isolation from the household arrangements. Once the community ends, Article 28 СК supplies the starting rule of equal shares. A demand for a greater share based on substantially greater contribution under Article 29, paragraph 3, СК is a separate legal proposition, with its own requirements and the time rule in Article 31 СК.

Necessary preservation costs and agreed improvements can be shared in proportion to ownership under Article 30, paragraph 3, of the Bulgarian Ownership Act (Закон за собствеността, ЗС). The closest subject-matter comparison in England and Wales is accounting between beneficial owners within the trust-of-land framework, although Bulgarian reimbursement rules remain distinct. Replacing a collapsing roof is different from fitting a more expensive kitchen because one occupant prefers it. The invoice proves expenditure, not automatically the amount another owner owes.
Where the work also serves the paying co-owner’s interest and was undertaken without the others’ consent, recovery may be limited to their enrichment under Article 61, paragraph 2, of the Bulgarian Obligations and Contracts Act (Закон за задълженията и договорите, ЗЗД). Express opposition engages the unjust-enrichment rules through paragraph 3 and Article 59. Unjust enrichment is also a recognised subject in England and Wales, but its tests should not be substituted for these provisions. A person genuinely possessing the whole property as their own may raise different rules under Articles 72 and 74 ЗС; merely occupying a shared home does not establish that status.
The Supreme Court of Cassation applied these distinctions in Decision No. 113 of 19 October 2023 in civil case No. 3575/2022, Second Civil Division. The court distinguished necessary expenditure, useful improvements and expenditure exceeding the compensable market benefit. It rejected the assumption that the cost of works must equal the increase in property value. For a client who spent more than the apartment gained in value, that distinction can substantially reduce the reimbursement claimed from another owner.
For former spouses, marriage and divorce documents should be accompanied by evidence of the applicable property regime and any agreement addressing the asset. The Bulgarian Family Code (Семеен кодекс, СК), Articles 18, 21, 22 and 23, supplies the distinctions between statutory community, personal property and transformation. In England and Wales, property adjustment on divorce under section 24 of the Matrimonial Causes Act 1973 concerns comparable family circumstances, but it does not replace the Bulgarian acquisition-based analysis. A translated divorce judgment should therefore be read for what it decides about ownership, not merely for the date on which the marriage ended.
Where personal purchase funding is alleged, the evidence should follow the money through identifiable events. A useful sequence might include the deed for an earlier personal asset, its sale contract, receipt of the proceeds, statements showing the relevant balance and the transfer used for the later purchase. The Supreme Court of Cassation's Interpretative Decision No. 2 of 20 January 2025 in interpretative case No. 2/2022 makes the origin of funds legally significant. It does not establish a rule that a particular bank format is always sufficient. The evidence must support the asserted connection despite transfers between accounts, mixed balances or gaps in the records.
An inherited estate requires careful personal records as well. The Bulgarian Inheritance Act (Закон за наследството, ЗН), Articles 48 and 49, links acquisition of an inheritance to acceptance, while Article 52 regulates renunciation. The closest broad comparison in England and Wales is the legal administration of an estate under the Administration of Estates Act 1925, though the Bulgarian mechanism should not be equated with obtaining a grant of representation. The lawyer should check relevant certificates, wills and formal declarations, together with conduct that may matter to acceptance. A family email stating that someone is not interested cannot safely stand in for the legal act required.
For renovation expenditure, preserve the condition before the work, the scope and date of each operation, who paid and whether the others agreed, knew without objecting or expressly opposed it. A valuation expert should distinguish preservation work from improvements and compare market value with and without the improvements. A family loan requires its own contract and repayment evidence. A promise that another owner will take over the mortgage does not release the existing borrower unless the lender’s required agreement is obtained.
Claims for accounts between participants must be raised at the first hearing after partition has been admitted, with their evidence, under Article 346 of the Bulgarian Code of Civil Procedure (Граждански процесуален кодекс, ГПК). The closest procedural comparison in England and Wales is the need to plead and prove financial claims within the applicable civil procedure. Bulgarian timing controls here. Preparing the expenditure schedule only after the valuation has been approved can therefore miss the relevant opportunity in the partition proceedings.
An heir does not lose the right to participate by living abroad. The issue is whether the chosen representative has authority for the actual agreement, including compensation, receipts and any conflict of interest. Signing a general management power can be insufficient for a final disposition.
A power of attorney deserves review against the final transaction, especially when the principal is abroad. Authority to manage an apartment may not authorise its partition, a transfer against deferred compensation or acceptance of a particular settlement. The required form and the treatment of the foreign document must be checked for the jurisdiction and method of execution involved. The principal should receive an explanation of the essential economic and legal terms in a language they understand. This is particularly important where a representative also acts for another participant or where payment is to be received through an intermediary account.
Authority must match the form required for the proposed contract under Article 37 ЗЗД. A voluntary partition requiring notarised signatures should not be confused with a different transaction requiring a notarial deed, for which the provision permits written authorisation with simultaneous notarisation of signature and content. The exact document should be settled before the principal attends a foreign notary. Representation of both sides or contracting with oneself also requires the principal’s consent under Article 38 ЗЗД. An apostille confirms authentication; it does not supply missing transactional authority.
Public sale is possible when an indivisible property cannot be placed in one share under Article 348 ГПК. Allocation under Article 349 is a conditional alternative. For former matrimonial community, paragraph 1 concerns the surviving or former spouse entrusted with parental responsibility for minor children of the marriage who has no dwelling of their own. For inherited housing, paragraph 2 requires residence there when the inheritance opened and absence of another dwelling. Neither a larger share nor willingness to pay alone satisfies those tests. The allocation request is due no later than the first hearing after the admission decision becomes final under paragraph 4. Monetary equalisation with statutory interest must be paid within six months after the allocation decision becomes final under paragraphs 5 and 6. Failure can undo the allocation and lead to sale, so financing must be realistic.
Prior gifts affect the title chain and may also raise a reserved-share claim. A matrimonial agreement can determine the property regime or allocate specific rights. Neither document should be treated as a mere family preference that a later partition may disregard.
Earlier agreements may already have resolved some of these questions. A marriage agreement, a court-approved divorce settlement and a later voluntary partition should each be read for the rights they actually regulate. A statement about who may occupy a home is not necessarily an ownership transfer. An express allocation of fractions cannot be treated as though the parties merely postponed their decision. Interpretative Decision No. 3 of 29 November 2018 in interpretative case No. 3/2015 distinguishes an agreement maintaining common ownership without specifying fractions from one that settles their proportions. The resulting advice must respect that distinction before any new ownership calculation is presented as legally available.
A challenge to a will or a claim to restore a reserved share can affect what is available for division. Reserved-share protection is governed by Articles 28 to 30 ЗН, while the detailed remedy depends on the disposition, the claimant and the estate composition. It would be unsafe to tell an heir that a gift is automatically void because it leaves them dissatisfied. The legal issue may be reduction to the necessary extent, subject to the applicable conditions. The value of the estate, relevant debts and earlier gifts may all be important to that calculation. A partition proposal should not silently assume the outcome of an unresolved reduction claim.
An omitted coheir is not equivalent to an omitted cupboard or parcel. The first defect can invalidate the entire division. The second may permit an additional division of the missing asset. Establishing all participants before negotiation avoids obtaining an apparently complete agreement that cannot settle ownership.
Partition itself must include the correct participants. The omission of a coheir has different consequences from the omission of an asset under Article 75, paragraph 2, ЗН. The former makes the partition entirely void, while paragraph 1 provides for an omitted asset to be divided additionally. This distinction matters in negotiations because a partial inventory can sometimes be completed later, but an agreement excluding a rightful heir cannot be justified merely by saying that the parties intended to deal with the missing interest on another occasion. The lawyer should establish whether the transaction is genuinely a partition and whether everyone whose participation is required is represented.
The Supreme Court of Cassation confirmed the procedural significance of an omitted owner in Interpretative Decision No. 4 of 16 June 2025 in interpretative case No. 4/2023, General Assembly of the Civil Chamber. An action under Article 75, paragraph 2, ЗН seeking nullity of judicial partition is admissible after the admission decision has become final even though the actual division has not yet been completed. The omitted owner need not simply wait for the property to be allocated before seeking the recognised remedy.
A dispute requiring a binding determination of ownership belongs before the competent court. A notary can authenticate a lawful agreed partition but cannot impose disputed shares on an unwilling owner. The territorial rules distinguish ordinary co-owned real estate under Article 109 ГПК from inheritance partition under Article 110 ГПК; an international succession may additionally require examination of the applicable European jurisdiction rules.
A voluntary partition of real property must be in writing with notarised signatures under Article 35, paragraph 1, ЗС. Participation by a person lacking full legal capacity requires the prior court permission specified in paragraph 2. The district court hears the partition claim under Article 341 ГПК. A private valuation or a relative’s assurance cannot replace either the required agreement or the judgment. Where compensation is deferred, its security should be agreed before the owner gives up the interest.
Birth, marriage and death records issued by one EU Member State for presentation in another may fall within Regulation (EU) 2016/1191. Its Articles 2 and 4 identify the covered status matters and remove legalisation and apostille requirements within that scope. A multilingual standard form may avoid a separate translation where the conditions of Article 6 are satisfied. This is not a rule recognising every foreign document or deciding the ownership effects of a marriage. A property-partition power of attorney is not covered merely because a notary signed it.
For a document outside that EU exemption, the issuing state and applicable treaty determine whether an apostille, another authentication route or an exemption applies. The 1961 Hague Convention abolishing legalisation for foreign public documents regulates the apostille in Articles 3 to 5; it authenticates the signature, capacity and seal, not the substantive truth of a claimed property share. Foreign-language evidence filed in Bulgarian proceedings requires an accurate Bulgarian translation certified by the party under Article 185 ГПК. If accuracy cannot be checked or is challenged, the court can appoint an expert to verify it. These are separate questions from whether a foreign judgment needs recognition.
