A spouse’s refusal does not prevent a divorce if marital breakdown is proved. ARG helps distinguish the dissolution claim from disputed fault, parenting, maintenance and use of the family home.

Clients often ask ARG whether their spouse can stop a Bulgarian divorce by refusing to sign. The more difficult question is often what happens next when both want the child to live with them, one needs to remain in the home, or the claim contains disputed allegations of fault. Accepting that the marriage has ended does not mean accepting every demand made in the court papers.
ARG can arrange assessment and representation by appropriately authorised Bulgarian attorneys in situations such as these.
Either spouse may seek divorce, but the statutory breakdown must be established through the court.
A fault determination requires a request and does not automatically decide parenting or property rights.
Care, support and housing may need a provisional arrangement while the divorce remains pending.
Jurisdiction, service and the later use of the judgment depend on the family’s actual connections.
The Family Code (Семеен кодекс, СК) permits either spouse to seek divorce for deep and irreparable breakdown under Article 49(1). A limited comparison for England and Wales is the Matrimonial Causes Act 1973, although its present statement-based divorce process differs from the Bulgarian assessment of breakdown and any requested fault finding. In Bulgaria, agreement that a marriage should end does not by itself settle parenting, housing or maintenance.
The right to seek divorce does not depend on persuading the other spouse to sign a settlement. A claimant relying on Article 49(1) of СК must establish deep and irreparable breakdown. The legal issue concerns the actual state of the marital relationship and whether ordinary marital life can realistically be restored. A temporary argument, a period of employment abroad and a settled separation may have very different significance. The claim should explain the events and their consequences, rather than present the statutory expression as a fact that needs no support. The respondent can challenge that account, but a refusal to consent is not an independent veto over a properly proved claim.
Breakdown is assessed through the relationship as a whole. The history may involve prolonged loss of communication, separate households, abandonment of shared responsibilities, violence or another serious deterioration. None should be reduced to a slogan. Dates, duration, context and the connection between events help explain whether the marriage has become only a formal bond. A family can share an address for financial reasons while no longer maintaining marital life. Conversely, temporary physical separation may coexist with continuing mutual support and an intention to remain together. The lawyer should therefore identify what the evidence shows about this marriage, without treating one visible circumstance as an automatic legal answer.
Fault is a separate question from whether the marriage has broken down. A decision on fault is made under Article 49(3) of СК when either spouse requests it. The absence of such a request does not remove the need to establish the statutory ground for contested divorce. Equally, a party can accept that the relationship is beyond repair while disputing responsibility for that outcome. The choice to request fault should be made deliberately, after considering the facts, possible consequences and evidential burden. It should not be inserted automatically because the client understandably feels hurt, or omitted merely because the other spouse would prefer that the court avoid examining both parties' conduct.
The scope of a fault dispute was clarified in Decision No. 160 of 14 May 2014, civil case No. 5764/2013, Supreme Court of Cassation, Fourth Civil Division. When one spouse requests a fault determination, the court is not confined to assessing the other spouse's conduct. It must consider both and may find both responsible, or even the requesting spouse alone. That principle makes a balanced chronology particularly important. A selective account that leaves out a client's own conduct can create an avoidable weakness. The lawyer needs the difficult facts early so that the position can be evaluated honestly and the relevant evidence presented in its proper context.
A contested divorce requires proof of the statutory breakdown. Mutual-consent divorce instead rests on serious and unwavering agreement and the required settlement under Articles 50 and 51 of СК. The judge does not investigate the spouses’ reasons in that route. Thus a respondent who says “I also want a divorce” has not necessarily agreed to mutual consent if parenting, housing or maintenance remain unresolved.
The distinction affects what must be proved and what becomes final. In a contested case the court can decide unresolved consequences after hearing evidence. In mutual consent the spouses must present an acceptable agreement, and the decision granting the divorce is not subject to ordinary appeal. A partial agreement can still be valuable in contested proceedings under Article 49(4) of СК, without pretending that all remaining disputes have disappeared.
Children's arrangements require their own assessment rather than a reward for success in the adult dispute. The framework in Article 59 of СК addresses residence, exercise of parental rights and duties, contact, maintenance, travel and documents. Its current paragraph 6 identifies factors including parental capacity, care already provided, attachment, age, available family support, social environment and material circumstances. The evidence should explain the child's ordinary day and future needs. A parent should show who can provide care, how schooling and treatment will continue and how appropriate relationships will be maintained. General claims of being the better parent rarely answer those practical questions sufficiently.
The process is governed by the Civil Procedure Code (Граждански процесуален кодекс, ГПК). The closest procedural comparison for England and Wales is the Family Procedure Rules 2010, but Bulgarian pleading, proof and appeal rules remain distinct. Relevant disputed facts and the parties' responsibility to establish their assertions are addressed in Articles 153 and 154(1) of ГПК. A claimant should connect each important allegation with available evidence. A respondent should distinguish a denial from an alternative account supported by records or witnesses. This helps avoid a case consisting of competing emotional narratives with no reliable explanation of the events that the court must determine.
Immediate uncertainty can be addressed through provisional measures under Article 323 of ГПК, covering maintenance, housing, use of marital property and care and maintenance of children within the statutory scope. The request should identify the present problem and a workable temporary solution. The current provision permits action on request or of the court's own motion. If further evidence is required, a new hearing is scheduled within two weeks under paragraph 2. The order is not appealable but can be varied by the court before which the case is pending under paragraph 3. These measures support life during the proceedings and should not be mistaken for a final property division or complete determination of every future issue.
Witnesses are useful when they can describe events they actually observed. A relative may know the family's routine or have witnessed a particular incident, but may know other matters only through one spouse. The assessment of potentially interested witnesses under Article 172 of ГПК requires consideration of the other evidence and their possible interest. A witness should not be coached to deliver a legal conclusion or repeat a prepared description of the marriage. Contemporary communications, residence records and other relevant documents may support or qualify an account. The objective is a credible factual picture, not the largest possible collection of people willing to express sympathy for one party.
Proof should establish the change in the marital relationship, rather than expose private material merely because it is embarrassing. A complete exchange about separation may explain when shared life ended. Intimate photographs unrelated to a pleaded fact may add distress without proving that fact. Access to another person’s account should not be assumed lawful simply because the parties are married. The proposed evidence must be relevant and lawfully obtained, and its authenticity must remain open to challenge.
Protection from violence has its own legal route and should not wait for the divorce judgment. The Protection Against Domestic Violence Act (Закон за защита от домашното насилие, ЗЗДН) provides protective measures under Article 5, including removal from the shared home and restrictions on approaching or contacting the victim. Non-molestation orders in England and Wales provide a limited functional comparison, but Bulgarian eligibility and procedure are separate. A protection application does not depend on first obtaining a criminal conviction.
Where the application contains information indicating direct, immediate or subsequent danger to the victim’s life or health under Article 18(1) of ЗЗДН, the district court issues an immediate protection order within twenty-four hours of receiving it, without first summoning the parties. A dated medical record, threatening messages or a police intervention may substantiate that need. The ordinary application period is three months from the act under Article 10(1), with the statutory exception for objective impossibility and an outer six-month limit. Describing violence only in the divorce pleading does not itself request this separate protection.

The child’s arrangements follow the Family Code (Семеен кодекс, СК). A limited comparison for England and Wales is a child arrangements order under the Children Act 1989, rather than a reward for success in the divorce dispute. Each proposal must explain where the child will live and how care, decisions and appropriate contact will actually work.
The parenting proposal needs its own evidence. The factors in Article 59(6) of СК require attention to the child's attachments, previous care, parental capacity, family help and living environment. A care calendar, school information, treatment records and realistic working arrangements may be more informative than broad claims that a parent is devoted. Joint exercise is also possible under the conditions in current Article 59(3), with the child's best interests central to the assessment. The proposal should explain residence, decisions, transitions and communication. Neither a fault allegation nor a demand for equal time replaces the need to show how the arrangement will work for the particular child.
The child's participation must remain protected from adult pressure. The procedure in Article 59(8) of СК includes appropriate hearing and social assessment, with psychological expertise where the statutory circumstances concerning alienating behaviour arise. A child should not be asked to prepare a statement endorsing one parent's litigation position. Parents can provide information about routines, concerns and observed reactions without claiming to know every thought the child has. Allegations of harm should identify concrete events and available support. The resulting assessment should distinguish actual risk from assumptions and preserve the child's ability to maintain suitable relationships without becoming the messenger or decision-maker in the adult conflict.
The Civil Procedure Code (Граждански процесуален кодекс, ГПК) governs that preparation, including the written response under Article 131 and the special matrimonial provisions. The Family Procedure Rules 2010 provide a limited procedural comparison for England and Wales, but Bulgarian deadlines and remedies must be checked independently. A discussion between spouses is not a court filing and does not automatically suspend the case.
Witnesses should be selected for knowledge, not loyalty. The assessment of relatives and other interested persons under Article 172 of ГПК requires the court to consider possible interest together with the remaining evidence. A witness who observed daily care may be useful on that issue even if they cannot explain the cause of the marital breakdown. Another may know a particular incident but not the wider history. Preparing a witness means identifying the relevant events and practical arrangements for attendance, not rehearsing a preferred answer. The court needs an account based on memory and observation, with uncertainty acknowledged where the person does not know the answer.
Fault should be assessed on the basis of both spouses' behaviour. The rule explained in Decision No. 160 of 14 May 2014, civil case No. 5764/2013, Supreme Court of Cassation, Fourth Civil Division, allows the court to find both spouses responsible or the requesting spouse alone once fault has been put in issue. The lawyer should therefore review the complete communications and the client's own actions, not only material selected against the other party. The practical decision is whether a fault request is supported and useful in the circumstances. It should reflect the potential legal consequences and evidence, rather than an expectation that the court will simply endorse one person's account of the relationship.
Living abroad neither defeats the divorce claim nor excuses proper service. The court needs the respondent’s actual known address and the applicable international method of transmitting documents. A spouse should not give a knowingly obsolete Bulgarian address in the hope of obtaining an uncontested result. An absence does not authorise a matrimonial default judgment or a judgment simply accepting the claim under Article 324 of ГПК.
Representation can cover filings, objections and evidence applications, but personal explanations may still be ordered under Article 176 of ГПК. The old general requirement of personal attendance at the first contested-divorce hearing in Article 321(2) was repealed from 1 July 2024. That repeal does not remove a specific direction to attend or the separate hearing requirements concerning children. The practical approach is to provide travel or medical obstacles promptly and seek a lawful procedural arrangement, rather than assume either that every hearing requires an overseas journey or that counsel can replace every personal act.
The first review should preserve the complete served packet and evidence of the service date. The general written-response period under Article 131(1) of ГПК is one month, and the court's directions must be examined carefully. The client should provide all attachments, not only the page describing the allegations. Missing a requested parenting or financial measure can distort the advice as much as misunderstanding the dissolution claim itself. Counsel should identify any procedural objection, admission, denial or counterclaim that needs attention. Ongoing conversations may support settlement, but they should not be treated as permission to let a procedural deadline pass without a considered response.
A temporary housing request belongs in the pending case under Article 323 of ГПК. It should identify the rooms or premises sought, who currently occupies them, the children’s daily needs and why the proposed use is workable. Ownership records matter, but temporary occupation does not decide title or divide the property. A precise request is more useful than asking generally for “protection of the home”.
Settlement should be evaluated by its actual legal content. The power to agree all or some divorce consequences under Article 49(4) of СК can reduce the dispute, subject to the protective review in paragraph 5. The document should identify resolved issues, outstanding claims and any necessary relationship with existing orders. Payment amounts, dates, contact periods and use of the home should be clear enough to operate. A general statement that the parties have settled everything may be inappropriate where a property issue has not been investigated. The client needs to understand the scope of each commitment before accepting wording that could exceed the practical compromise they intended.
A switch to mutual consent requires more than acceptance that the marriage has failed. Serious and unwavering agreement under Article 50 of СК must be accompanied by the required settlement under Article 51. The transition in Article 321(5) of ГПК leads to the distinct procedure in Article 330, including personal attendance and the court's assessment of the agreement. A decision granting that divorce is not appealable. The client should check every operative term before confirming the outcome. If agreement covers only selected consequences, the legal team should explain how the remaining issues will be determined rather than label the whole case resolved prematurely.
The judgment must be reviewed promptly after service. The ordinary appeal period under Article 259(1) of ГПК is two weeks, with the appeal lodged through the court that issued the decision. The review should identify the particular part challenged, the legal or factual error and the requested correction. A broad statement of dissatisfaction is not an effective substitute. The document's service history should be preserved, and counsel should assess what evidence or arguments are procedurally available. The client also needs to know which obligations already require attention and whether any appropriate procedural step concerning their operation is available in the actual circumstances.
The exception to the cassation restriction in Article 280(3), item 2 of ГПК concerns the questions under Article 59(2) of СК where a child of the marriage is still under eighteen on the date the appellate judgment is announced. The age at filing is therefore not the decisive date. The exception does not make a third hearing automatic. Admission must still satisfy the applicable grounds in Article 280(1) or (2), and the cassation complaint is normally filed within one month of service under Article 283.
Finality may differ between parts of the decision. A divorce takes effect even if appealed only on fault under Article 325 of ГПК. The client should receive a clear explanation of marital status, outstanding issues and any documents needed to establish the result. Surname treatment requires attention to Article 53 of СК and Article 326 of ГПК. The end of the marriage also should not be confused with a complete distribution of every asset or discharge of every debt. Remaining property matters need their own analysis, and any intended foreign use requires the appropriate recognition and documentary route for the relevant country and type of decision.
A Bulgarian district court hears the divorce at first instance under Article 103 of ГПК, while territorial venue must also be established. The ordinary defendant-address rule in Article 105 and the special rules in Article 107 require particular care where the respondent resides abroad. These domestic rules select a court only after international jurisdiction has been established.
Where Regulation (EU) 2019/1111 applies, its Article 3 identifies alternative links for divorce, including the spouses’ habitual residence, the respondent’s habitual residence or their common nationality. An applicant relying on their own residence must satisfy the applicable duration and nationality conditions. Owning an apartment in Bulgaria is not itself one of these grounds. Parental responsibility normally follows the child’s habitual residence under Article 7, subject to the Regulation’s exceptions. Consequently, a Bulgarian court competent to dissolve the marriage does not automatically acquire every dispute about a child living in another state.
For a divorce within the applicable EU framework, recognition of marital status generally proceeds without a special procedure under Article 30 of Regulation (EU) 2019/1111. The useful documents are an authentic copy of the judgment and the appropriate certificate under Articles 31 and 36. The matrimonial certificate uses Annex II. Translation may be required in the circumstances specified by Article 31, so a short informal translation of the operative part is not always sufficient.
The divorce certificate does not enforce every financial or parenting obligation in the same way. Parental responsibility uses its own certificate and enforcement provisions, while maintenance is excluded from this Regulation and follows the applicable maintenance framework. The Regulation applies to proceedings instituted on or after 1 August 2022 under Article 100(1). Earlier proceedings retain the previous Regulation where its transitional rules apply. Use of a Bulgarian judgment in a state outside this framework requires a separate recognition check. Identifying the destination country and the precise result sought before obtaining documents prevents paying for the wrong certificate or assuming that proof of divorce also collects unpaid maintenance.
