Paternity and Legal Parentage Disputes in Bulgaria

A DNA result does not automatically change a birth record. ARG helps distinguish acknowledgment, establishment and contestation of parentage, including the deadlines and consequences for the child.

Paternity & Parentage

Can a biological father be entered on a Bulgarian birth record when the mother’s former husband is already recorded? Clients ask ARG this question after separation, remarriage or an international move. The answer depends on how the existing parentage arose and who still has a legal route to challenge it.

Through appropriately authorised Bulgarian lawyers, ARG can assist when the following situations arise.

  • A marital presumption identifies someone other than the alleged biological father.
  • An acknowledgment has been notified and an objection period is running.
  • A child has no established father and maintenance needs to be addressed.
  • The parties disagree about testing or the identity of submitted samples.
  • A foreign judgment and Bulgarian civil records show different parentage.

At a glance

(001)
Status exceeds biological evidence

A genetic fact and legally established parentage are distinct. Existing status must be addressed through the available legal procedure.

(002)
Claims have individual conditions

Standing, time limits and required parties depend on the specific establishment or contestation route and the person seeking relief.

(003)
Acknowledgment has lasting effects

Formal acknowledgment cannot simply be withdrawn after a relationship ends. Objection and annulment involve different grounds and procedures.

(004)
Consequences require coordination

Civil records, names, maintenance, parental measures and succession may follow from status, but each practical consequence needs proper legal treatment.

What is legal parentage and how is paternity established in Bulgaria?

The correct starting point is the source of the child's present legal status. Maternity, the marital presumption of paternity, acknowledgment and judicial establishment operate through different rules of the Bulgarian Family Code (Семеен кодекс, СК). A restrained comparison is the declaration of parentage available in England and Wales under section 55A of the Family Law Act 1986, although the Bulgarian routes, standing and periods must be analysed independently. A document entitled birth certificate does not itself explain whether the father's details originated in a marital presumption, a declaration or an earlier judgment. The underlying record and relevant family events therefore need to be obtained before anyone selects a claim.

When does the marital presumption of paternity apply?

The presumption follows legal marriage dates, not the date a couple stopped living together. The husband is treated as father for birth during marriage or before three hundred days have elapsed after its termination under Article 61(1) of СК. If the mother remarries before a birth within that period, the new husband is presumed father under Article 61(2). A separation agreement, another partner’s attendance at the birth or everyone’s belief about biology does not substitute for these rules. The actual marriage and divorce records can therefore change which person must be a party to the claim.

Maternity has a different starting point. The mother is the woman who gave birth, including through assisted reproduction, under Article 60(1) and (2) of СК. Genetic contribution alone does not replace this definition. Where the second husband’s presumed paternity is successfully contested, Article 62(3) can bring the first husband’s presumption into consideration, with its own challenge period. The family must therefore disclose the complete sequence of marriages, rather than assume that removing the most recent entry necessarily leaves the record available for an immediate acknowledgment by a third person.

How does voluntary acknowledgment create legal parentage?

Acknowledgment is a personal legal act, not an informal family statement. A parent may acknowledge their child within the framework of Article 64 of СК, and the declaration must comply with Article 65(1). This means using the prescribed written declaration before the civil status official or a declaration with a notarised signature submitted to that official. A private message, a social media announcement or a promise made before witnesses does not perform the same function. The parent should also understand the notification and objection process before signing, because the act can create a lasting status and cannot later be withdrawn merely because the adult relationship has deteriorated.

An objection to acknowledgment does not itself determine biological parentage. After an objection under Article 66(1) of СК, the acknowledging person has three months from receiving notification to bring an establishment claim under Article 66(2). There is also a specific consequence where acknowledgment precedes the birth record and the other parent declares in the prescribed form that it will not be challenged. Immediate registration follows under Article 66(3), and that parent cannot challenge the acknowledgment after the record is drawn up. A family should therefore understand the significance of a declaration before signing it, rather than treat the document as an administrative courtesy.

How is acknowledgment different from a court claim to establish paternity?

A missing paternal status calls for a different route from an existing but disputed one. The initial establishment claim under Article 69 of СК may be brought by the mother within three years of birth or by the child until three years after reaching majority. When the child brings the claim, the mother is also summoned. For example, a child with no established father is not in the same position as a child already linked to the mother's husband. In the latter situation, the existing status must be addressed under Article 71 before, or through the permitted combination with, establishment of another relationship.

An existing legal parentage cannot be bypassed by presenting a competing declaration. The bar in Article 71 of СК applies while parentage established through the birth record, the marital presumption or acknowledgment remains in place without a successful challenge in the proper judicial way. A person claiming biological fatherhood may therefore need to combine the challenge with establishment of their own paternity where the law requires or permits that combination. This is different from asking an administrative official to replace one name with another. The practical distinction prevents families from spending months on a registration request that cannot resolve the underlying status conflict.

When can established parentage be contested and by whom?

A person asserting biological fatherhood faces the separate framework of Article 62(5) of СК. The law connects the one-year period to learning of the birth and requires the challenge to be joined with a claim to establish that person's paternity. It also expressly requires attention to the child's interests. These requirements make the case more than an attempt to disprove someone else's status. The claimant must be prepared to ask the court to recognise their own relationship with the child and address the consequences of that recognition. A filing that seeks only to remove the recorded father may therefore miss an essential part of the statutory route.

Why can procedural time limits decide a parentage dispute?

The husband ordinarily has one year from learning of the birth to contest paternity under Article 62(1) of СК. If he discovers circumstances disproving paternity later for reasons independent of him, he may bring the claim within one year of learning those circumstances, but no later than the child’s majority. A new test report may be important evidence, but its date does not automatically prove that the relevant circumstances first became known then. Earlier communications, medical information and admissions may establish a different date. The account should therefore explain both the later discovery and why the earlier lack of knowledge was independent of the husband, rather than select whichever event produces the most favourable calendar.

The mother’s challenge to marital paternity has a one-year period from birth under Article 62(2) of СК, while the child’s independent challenge runs from age fourteen until one year after majority under Article 62(4). These are different from initial establishment under Article 69 and from objections to acknowledgment. The periods in this chapter are applied by the court on its own initiative and are not suspended, interrupted or restored under Article 73. Negotiations, a private test or the other adult’s promise to cooperate should therefore never be treated as preserving an expiring right to sue.

Challenges to acknowledgment require their own calendar. The notified parent or a child aged fourteen or over has the statutory three-month period for a written objection under Article 66(1) of СК. A person claiming to be the child's parent has a separate judicial route under Article 66(5), with a one-year period from learning of the acknowledgment and mandatory joinder of an establishment claim. The triggering event is therefore not identical across the two provisions. Copies of the acknowledgment, notification, proof of receipt and subsequent communications can be crucial. An argument based only on the date of a recent family disagreement may leave the actual statutory trigger unexplained.

What does DNA evidence prove and what can it not resolve by itself?

Scientific evidence is often central to disputed paternity, but its legal value depends on how it is obtained and used. A reliable test can address biological relationship. It does not decide whether the claimant has standing, whether the action is timely, whether an existing acknowledgment must first be challenged or what arrangements will protect the child after establishment. The Bulgarian Civil Procedure Code (Граждански процесуален кодекс, ГПК) regulates expert cooperation in parentage proceedings in Article 333. England and Wales also provide for court-directed scientific testing under section 20 of the Family Law Reform Act 1969, but the Bulgarian court applies its own safeguards and procedural powers.

Scientific absence of a genetic link also requires attention to assisted reproduction. A challenge is barred under Article 62(6) of СК where the child was born through assisted reproduction and the mother's husband gave informed written consent to the procedure. In that situation the law gives legal significance to the consent, so a genetic report cannot simply be treated as if the case involved an ordinary disputed marital presumption. The consent document, its content and the actual circumstances of the procedure are therefore material to defining the claim before commissioning further tests.

How are the child’s interests and right to identity considered?

The law's concern with stability does not mean that biological truth is irrelevant. In Decision No. 11 of 28 July 2022 in constitutional case No. 3/2022, the Bulgarian Constitutional Court considered the 2020 reform of access to paternity challenges and the balance between biological truth, legal stability and the child's interests. The Court rejected the challenge to the particular transitional provision before it. Its reasoning should be used within that context, rather than as a statement that every adult has an unrestricted opportunity to reopen parentage. For a family facing a new dispute, the decision explains why the court considers both access to a meaningful remedy and the consequences of disturbing an established relationship.

The child is a person whose legal relationships are being determined, not merely the subject of an adult’s scientific question. In a claim by an alleged biological father under Article 62(5), the court must consider the child’s interests alongside the required challenge and establishment. Evidence about actual care, the child’s established relationships and the proposed change explains what recognition would mean in daily life. This assessment does not turn affection into a substitute for statutory parentage, but it prevents the case from being presented as though a genetic percentage alone settles every legal and personal consequence.

What are the effects on maintenance, surname and inheritance rights?

Establishing a parent establishes a legal family relationship, with consequences beyond the birth certificate. Where an establishment claim under Articles 68 or 69 succeeds, Article 70 of the Family Code (Семеен кодекс, СК) requires decisions on residence, parental responsibility, contact and maintenance. A limited comparison is the declaration of parentage under section 55A of the Family Law Act 1986 in England and Wales; the Bulgarian consequences follow Bulgarian law. The child’s recorded names and potential inheritance position also need review in light of the status actually established. A status judgment does not by itself distribute an estate, recover every past payment or give the adults unrestricted freedom to choose new names.

Names are a legal consequence requiring a specific ruling. The Civil Registration Act (Закон за гражданската регистрация, ЗГР) connects judicial establishment to the court’s determination of the child’s name in Article 16(2), read with Article 73. Birth-registration and re-registration procedures in England and Wales offer only a broad comparison, not identical naming rules. In Decision No.417 of 27June 2024, civil case No.2421/2023, Third Civil Division, the Supreme Court of Cassation required application of the statutory patronymic and surname rules after paternity was established. It distinguished a separate name-change application under Article 19(1) of ЗГР from the mandatory consequences in the parentage case. The practical point is to address the names in the requested outcome, rather than assume that preserving familiar names follows automatically from a general appeal to the child’s welfare.

Legal parentage can also determine whether the child participates in inheritance. Children inherit equally between themselves under Article 5(1) of the Inheritance Act (Закон за наследството, ЗН), within the applicable succession framework. A restrained comparison is recognition of descendants in intestacy under section 46 of the Administration of Estates Act 1925 in England and Wales; the shares and conditions differ. A private DNA result does not by itself establish the civil status required for this purpose. If the alleged parent has died, Article 72(2) of СК directs the parentage claim against the deceased person’s heirs. The relevant parentage claim and its time limit still need to exist. Establishing status does not itself resolve wills, competing heirs, estate assets or every succession issue.

Which birth certificates and civil-status records are needed?

Marriage and divorce documents can explain why a particular man appears as father even if he has never lived with the child. The presumption in Article 61(1) of СК concerns birth during marriage and the specified three-hundred-day period after termination, while subsequent marriage requires attention to the remaining statutory rules. A client should therefore supply the dates and documents for each relevant marriage, termination and remarriage. If a foreign divorce is involved, the way it takes effect in Bulgaria may also need examination. An inaccurate assumption about the date on which a marriage ended can distort the entire parentage analysis.

Where the record derives from acknowledgment, obtain the declaration and the notification material. The personal form required by Article 65(1) of СК is different from a private statement or an agreement between adults. The notification date may matter for the written objection available under Article 66(1), while another alleged parent's judicial route under Article 66(5) has a different trigger. The envelope, delivery confirmation or electronic record should therefore be retained along with the notice itself. If the client only learned of the acknowledgment through a later certificate, that fact should be documented honestly rather than converted into an assumed date of formal service.

How can a person request scientific expert evidence?

A request for scientific evidence should identify the biological relationship to be tested, the persons concerned and any existing reports with disputed sample identity. The Civil Procedure Code (Граждански процесуален кодекс, ГПК) supplies the parentage expertise framework in Article 333. Court-directed scientific testing under section 20 of the Family Law Reform Act 1969 in England and Wales provides a limited comparison, without importing that procedure into Bulgaria. A private result with unidentified samples may justify investigating a concern but cannot establish that the material came from the parties. The request should seek a reliable answer to the remaining factual question, rather than simply commission the same uncertain test again.

Cooperation with the expert process is required by Article 333(1) of ГПК, subject to the statutory exception concerning serious or prolonged danger to life or health. The court determines whether refusal is lawful under Article 333(2), and another method may need consideration. Appropriate measures relating to non-invasive sampling are addressed in Article 333(3). The possibility of obtaining samples from a deceased person is regulated by Article 333(4), subject to legal prohibitions. These powers belong within the judicial process. A party should raise an actual medical concern with supporting evidence instead of assuming that refusal is either an automatic defeat or an absolute veto.

When is correcting a civil record different from challenging parentage?

A misspelled name and a claim that the recorded father is not the legal father require different remedies. Correcting a transcription error preserves the established relationship and makes the record express it accurately. Replacing a father contests the relationship itself. The obstacle in Article 71 of СК cannot be avoided by calling the latter request a correction, even where the adults agree. Before applying to a civil-status official, identify the underlying acknowledgment, presumption or judgment. A registration application cannot resolve a disputed biological and legal status for which the law requires judicial determination.

Civil registration is another distinct task. The family should obtain the appropriate court documents and check how the relevant authority will reflect the result in the child's records. The spelling of names, dates and identifiers should be reviewed against the judgment and the source documents. Where a clerical discrepancy remains, it should be identified as such rather than used to reopen the merits of parentage informally. A reliable updated record matters for later dealings with schools, health institutions and other authorities. Keeping a clear set of the original and amended documents also helps explain the change when the child's history must be reviewed in another jurisdiction.

How do foreign parentage determinations interact with Bulgarian registration?

A foreign parentage decision requires its own recognition analysis before its effect on Bulgarian records is assumed. Regulation (EU) 2019/1111 expressly excludes establishment and contestation of a parent-child relationship in Article 1(4)(a), although it regulates other parental-responsibility matters. Its mechanisms cannot therefore be borrowed merely because the dispute concerns a child. The relevant state, the nature of the foreign act and any applicable convention or domestic recognition route matter. A foreign birth certificate may record a relationship without being the court determination that established it, so both the certificate and its legal basis should be obtained.

Earlier judgments, pending cases and foreign documents should be disclosed at the beginning. The bar on replacing existing parentage without a proper challenge under Article 71 of СК means that an earlier determination may be central to the next step. A foreign certificate can also raise issues of applicable law and recognition that are not resolved by translation alone. The client should supply the complete document, information about finality where relevant and any previous use of it before Bulgarian authorities. This allows the lawyer to identify whether the present problem concerns parentage itself, the effect of an existing decision or an administrative record that does not accurately reflect an established status.

Which Bulgarian court decides parentage and who must participate?

Parentage establishment and contestation claims fall within the regional court’s first-instance subject-matter competence under Article 104, item 1 of ГПК. That is distinct from the usual district-court route for many ordinary disputes over a child’s care. International jurisdiction must still be established before the domestic territorial venue is chosen. A parent’s residence abroad does not automatically defeat a Bulgarian claim, but neither Bulgarian language nor a lawyer’s office address creates jurisdiction. The pleaded result and the actual family connections determine which rules need to be applied, before expenditure on foreign service and testing.

The necessary participants must be checked before filing. The mother, child and husband have roles in paternity challenges under Article 63 of СК, with additional rules for the particular circumstances described there. The child's representation deserves separate attention where an adult's interest conflicts with the child's own position. A family may agree that one lawyer should organise the documents, but that convenience does not eliminate a legal conflict. Each participant needs an appropriate opportunity to understand the case and respond. Missing or incorrectly represented parties can undermine the proceedings even where the biological evidence appears straightforward.

Which foreign documents and enforcement issues need separate attention?

A foreign party must have a proper opportunity to receive the claim and participate. Silence does not secure a status judgment by default or admission, which Article 334 of ГПК excludes. The file should identify the current foreign address, previous service attempts and any document proving finality of an earlier decision. Express authority to bring civil-status claims through a representative is required by Article 34(2). Representation can organise the case from abroad, but it does not remove the need for participation in an ordered expert procedure or any other step the court lawfully requires.

Maintenance should be treated as a legal obligation requiring a clear decision and implementation. A scientific report alone is not a sound basis for unilaterally stopping payments made under an existing enforceable arrangement. Equally, the recognition of a new parent should not leave the child without practical support while the adults debate responsibility. The lawyer needs the current orders, payment history and information relevant to the arrangements sought in the parentage case. The appropriate request can then be assessed within the actual procedural position rather than through assumptions about what a biological finding must automatically change.

The child's understanding of the result deserves careful handling even when all formal steps are clear. A judgment changes legal relationships, but it does not dictate how quickly emotional relationships develop. Adults should avoid presenting the child as responsible for the dispute or using the outcome to denigrate a person who has provided care. The court's arrangements and any appropriate professional support should guide the transition. This practical approach is consistent with the attention to the child's interests and legal stability discussed in Constitutional Court Decision No. 11 of 28 July 2022 in constitutional case No. 3/2022, without treating that constitutional ruling as an individual welfare assessment.

Questions and answers

01 / 06

Does a private DNA result automatically change the birth record?

No. It may be relevant evidence, but a change of legally established parentage requires the appropriate procedure and satisfaction of its standing and timing conditions.

Can another father acknowledge a child who already has established paternity?

The existing status cannot simply be ignored. Its proper contestation and any permissible or required combined establishment claim must be assessed before another status can be established.

Is there one deadline for every parentage dispute?

No. The applicable period and starting event depend on the person, the type of claim and the statutory circumstances. Prompt individual assessment is essential.

Can an acknowledgment be withdrawn after separation?

It is not freely revocable. An available objection or claim based on a defect in consent has its own legal requirements and must be distinguished from a general change of mind.
