A Bulgarian marriage contract can organise ownership, expenses and financial consequences before or during marriage. ARG helps distinguish a valid property arrangement from promises that cannot bind children, creditors or foreign registries.

An entrepreneur planning marriage may want the business to remain separate while ensuring that a spouse who takes parental leave has dependable financial support. Clients ask ARG how to express both aims without leaving the next home purchase, loan or replacement asset unresolved. Through authorised Bulgarian attorneys, we assist in situations such as these.
Community, separation and contractual arrangements have different legal effects and continuing family obligations.
It cannot replace every personal family duty or dispose of a child’s interests through an adult bargain.
Personal notarial conclusion, regime registration and any property entries require separate attention.
A private agreement does not automatically release a guarantee, mortgage or previously acquired creditor right.
The initial legal question is what the couple already owns and what they want the agreement to change. The Bulgarian Family Code (Семеен кодекс, СК) permits provisions about both premarital assets and property acquired during marriage under Article 38, paragraph 1, items 1 and 2. In England and Wales, nuptial agreements receive weight within the court's financial jurisdiction, subject to informed consent and fairness as explained in Radmacher v Granatino [2010] UKSC 42, paragraph 75. Bulgaria's express contractual regime gives the parties a statutory framework for arranging property relations. Its use still requires lawful terms and accurate identification of the rights concerned.
An asset schedule should distinguish a description of the existing position from an operative disposition. Recording that one spouse bought a vehicle before marriage can help identify the starting assets. A clause transferring an identified share in another asset has a different function. The text should state which effect is intended and when it arises. A general phrase that property is shared may leave uncertain whether the parties intended ordinary coownership, a community rule for future acquisitions or an immediate transfer. The restriction on converting premarital property into marital community under Article 38, paragraph 2 of the СК makes that distinction particularly important. Different legal results cannot safely be treated as interchangeable expressions of fairness.
Financial independence concerns the allocation of rights and responsibilities, rather than the absence of obligations towards a spouse or child. The parties can regulate participation in expenses and debts under Article 38, paragraph 1, item 4 of the СК. A practical clause might identify recurring household costs, the method for calculating each contribution and the date for payment. It should also define what happens when a cost is exceptional or disputed. An instruction that each pays a fair share leaves the central question unanswered when incomes differ. A workable obligation must identify the performance expected from the person who undertakes it, so that compliance can be assessed without renegotiating the entire arrangement each month.
Spousal maintenance can also be addressed within Article 38, paragraph 1, item 6 of the СК. The obligation should state its trigger, duration, amount or calculation method and the circumstances in which it ends. A payment obligation expressed only as support when necessary may create disagreement about both entitlement and performance. The parties should consider whether a defined recurring payment, reimbursement of specified expenses or another lawful arrangement reflects their actual intention. The legal review must also examine whether the clause fits the Code's mandatory limits and the rest of the contract. Its presence does not justify importing conditions that regulate personal conduct outside the permitted property scope.
Personal execution is a substantive formal requirement. Both parties conclude the contract in writing with notarised content and signatures under Article 39, paragraph 1 of the СК. An ordinary signed draft, scanned signature page or authorisation allowing someone else to negotiate cannot simply be treated as the completed statutory instrument. The appointment should take place after the parties have settled the actual text and understood its effects. Where interpretation is needed, the arrangements must support comprehension and the lawful notarial process. The file should contain the version that will be executed, with consistent schedules and references, so that the authenticated document records the agreement actually reached.
The matrimonial property register serves a separate publicity function. Contracts and the statutory regime are entered in the central electronic register under Article 19 of the СК, following the municipal notification mechanism in paragraph 2. A contract concluded during marriage is noted in the marriage record under Article 39, paragraph 4. Where no regime is registered, community applies in transactions with third parties under Article 20. Verification should therefore distinguish the entry of the regime from the entry of a specific immovable property transfer. A receipt relating to one process is not proof that the other has been completed. The couple should retain the executed instrument and obtain evidence of the entries relevant to the effects they intend to rely on.
The available regimes are statutory community, statutory separation and the contractual regime under Article 18(1) of СК. Community applies where no different choice is made within the statutory conditions. Under separation, rights acquired by each spouse during marriage are personally held under Article 33(1); this is not a statement that every family obligation disappears. A contract offers a different degree of detail, allowing permitted rules for identified property, expenditure and financial consequences. Calling a document prenuptial describes when it was signed, whereas Article 37(3) also permits a marriage contract during an existing marriage.
Default community depends on joint contribution to property acquired during marriage, and the contribution is presumed under Article 21, paragraphs 1 to 3 of the СК. The spouse who earns the income may have made the visible payment while the other maintained the household or cared for children. Those forms of contribution are expressly recognised. A contract can arrange property relations differently within the statutory limits, but the negotiations should begin from an accurate explanation of what the default would do. Otherwise, a spouse may surrender a legally significant position while believing that their unpaid work has no relevance. Conversely, the agreement should not promise rights in an asset that neither party can lawfully dispose of.
Finally, the intended treatment of future acquisitions must be expressed in operative terms. The couple may refer to a statutory regime under Article 38, paragraph 2 of the СК, or make permitted provisions for identified categories. They should examine whether the rule covers replacements, purchases funded from several sources and assets acquired jointly. Matters left unregulated fall back to community under paragraph 4. A contract focused exclusively on business property may consequently leave the next family purchase subject to that default. Before signing, both spouses should be able to explain the result of an ordinary proposed purchase using the actual clauses. If their explanations differ, the language has not yet resolved the issue they brought to the lawyer.
The agreement should preserve a clear distinction between financial terms and decisions about a child's care. A promise to fund education is a property arrangement, while a purported final decision about the child's residence is not made valid by placing it beside that promise. The property limitation in Article 38, paragraph 1 of the СК requires the purposes to be separated. Financial performance should not be made an instrument for controlling access to the child or compelling unrelated personal behaviour. Where the couple needs a separate parenting arrangement, it must use the appropriate family law framework. This separation makes the financial contract more reliable because each obligation is assessed through the legal rules that actually govern it.
Child maintenance provisions require particular care. Although Article 38, paragraph 1, item 7 of the СК expressly permits arrangements concerning maintenance of children of the marriage, parents remain subject to the obligation to support minor children under Article 143, paragraph 2. The amount is assessed through needs and the liable person's means under Article 142, paragraph 1, with the statutory minimum addressed in paragraph 2. A provision for ordinary school costs may be useful, but it cannot be treated as a permanent ceiling that extinguishes the child's legal entitlement regardless of later needs. The drafting should distinguish the parents' agreed performance from rights the child holds under the law and from later changes requiring an appropriate legal response.
A proposed transfer of immovable property determines territorial notarial competence. Certification must be by a notary in the district where the property is located under Article 39, paragraph 2 of the СК. If several properties lie in different districts, a notary in one of those districts may be chosen. The parties should therefore identify every transfer before finalising execution arrangements. Adding another property at the last moment may change the documents or checks required even where the chosen district remains permissible. The relevant question is what the instrument legally does. Its description as a marriage agreement does not remove the requirements attached to the creation or transfer of the specified property right.
The timing of effect follows the parties' marital position. A contract made before marriage takes effect upon conclusion of the marriage under Article 40, paragraph 1 of the СК. A contract made during marriage operates from conclusion or another specified date. This distinction should appear in the transaction planning, especially if the couple has already committed to a purchase. For an immovable property disposition, the registration mechanism in Article 39, paragraph 3 requires entry on the day of notarisation for a contract made during marriage. For a premarital contract, the notary submits it when the marriage certificate is received. The parties must ensure that the event activating the next step is documented and communicated.
A proposed amendment first requires agreement on the revised legal result, followed by the required form. Changes must follow the form used for conclusion under Article 41, paragraph 1 of the СК. Because the original contract is personally executed with notarised content and signatures under Article 39, paragraph 1, an informal exchange about different financial arrangements is not an adequate substitute. The amendment should identify the affected provisions and the date from which they change. If it contains a new property transfer, its transactional requirements also need to be addressed. The parties should not assume that calling a document an annex reduces the formal requirements attached to its substance.
Termination by mutual agreement is separately recognised under Article 42, paragraph 1, item 1 of the СК. The spouses can then select a statutory regime or enter a new contract. If they do neither, statutory community applies. The replacement should specify how ongoing payment obligations and future acquisitions will be governed. It should not assume that ending the organising contract automatically reverses every completed transaction without examining its nature. A spouse who wants an asset transferred back needs the intended result identified and the corresponding legal act assessed. This distinction prevents the termination document from promising a property consequence that its operative terms and formalities do not actually accomplish.
Changing the regime does not erase the acquisition history or automatically give every existing asset to the spouse named in a bank statement. Statutory community may be terminated during marriage by choosing separation or concluding a marriage contract under Article 27(3) of СК. Where community is terminated, Article 28 provides the starting rule of equal shares. If the spouses want a different permitted allocation of a particular asset, they must identify and implement that disposition with the required form. The new rule for future purchases and the treatment of already acquired rights should therefore be stated separately.
The source of acquisition funds requires its own analysis where the agreement leaves the default community rules applicable. An account in one spouse's name does not by itself establish personal acquisition, as confirmed in the Supreme Court of Cassation's Interpretative Decision No 2 of 20 January 2025 in interpretative case No 2/2022, General Assembly of the Civil College. The court distinguished qualifying transformation under Article 23 from rebuttal of the joint contribution presumption under Article 21. The former concerns the legal source invested in the acquisition. The latter requires proof of the absence of contribution in its relevant forms. In drafting, the distinction prevents a bank account label from becoming an unsupported statement about every asset subsequently purchased from it.
A mixed payment illustrates why the distinction matters. A spouse may invest proceeds from a premarital asset together with income earned during marriage. Under the default rules, partial personal transformation is addressed by Article 23, paragraph 2 of the СК, subject to the exception for an insignificant part. The necessary evidence includes the earlier acquisition, the sale, receipt of the proceeds and their use in the new transaction. A contract can instead articulate a permitted future allocation so that the parties do not rely exclusively on reconstructing that history. It should still avoid making inaccurate declarations about the origin of funds. A future contractual choice and proof of an earlier fact perform different legal functions.

Identity, marital status and capacity are the first legal facts to establish. The Bulgarian Family Code (Семеен кодекс, СК) permits a marriage contract between fully capable persons under Article 37, paragraph 2 and requires personal conclusion under Article 39, paragraph 1. The position has a limited comparison with England and Wales, where the court assesses the weight of nuptial agreements through informed consent and fairness, as explained in Radmacher v Granatino [2010] UKSC 42, paragraph 75. For a Bulgarian contract, however, those comparative considerations do not replace the express statutory form and capacity requirements. Names, identification details and the existing marriage record should be consistent across the operative documents.
An internal promise about a loan must be read alongside the creditor's existing rights. If both spouses have undertaken obligations to the lender, a clause assigning all instalments to one spouse primarily allocates performance between the spouses. It does not itself obtain the lender's release of the other. The protection of rights acquired by third parties before the contract is explicit in Article 40, paragraph 2 of the СК. The spouse seeking an external release must therefore identify the lender and the legal act needed to change that relationship. If the lender does not agree, the couple should understand the remaining exposure and any internal reimbursement obligation. Calling the allocation exclusive does not answer the creditor question.
The property file should establish what each party can actually regulate or transfer. Acquisition documents identify the asset, the right and the date of acquisition. Current information about existing burdens or competing rights helps test whether the proposed disposition can achieve its intended result. The contract cannot affect rights previously acquired by third parties under Article 40, paragraph 2 of the СК. A spouse who promises an unencumbered asset must therefore distinguish that promise from the present legal position. If a lender's right remains, the agreement should not describe it as extinguished without the corresponding legal act. The missing step may require the participation of someone who is not a party to the marriage contract.
Evidence of funding matters where the couple relies on a personal acquisition rather than creating a different permitted contractual allocation. A bank statement shows movement of money, but not necessarily the legal character of the source. Payment from one spouse's account is insufficient by itself under statutory community, as explained in the Supreme Court of Cassation's Interpretative Decision No 2 of 20 January 2025 in interpretative case No 2/2022, General Assembly of the Civil College. The spouse asserting qualifying transformation must establish the source invested in the acquisition. Earlier ownership documents, sale receipts and the payment chain may therefore be necessary. The evidence should connect the source to the actual acquisition, rather than merely show that sufficient money once existed somewhere in the family.
The competing explanation also needs to be understood. A spouse may accept that a payment came from the other's account while disputing that the money was personal for transformation purposes. Alternatively, the dispute may concern joint contribution rather than the source. The interpretative decision distinguishes those questions, and Article 21, paragraph 2 of the СК recognises work, childcare and household activity as forms of contribution. During preparation, the lawyer should identify which proposition each document supports and which remains disputed. A declaration prepared for convenience should not be used to erase a disagreement about an existing fact. The couple may be able to agree a lawful future arrangement without pretending that their historical accounts are identical.
Business related wording should identify the actual right being regulated. Money held by a spouse, a claim to receive income, ownership of equipment and a company's own assets are not the same thing. The contract's permitted property subject matter under Article 38, paragraph 1 of the СК does not authorise the spouses to dispose of rights belonging to someone else. Where an asset belongs to a separate company, describing it as the entrepreneur's personal asset is therefore an inadequate starting point. The agreement should address the rights the spouse actually holds and distinguish them from the company's property and obligations. Any transaction involving other right holders needs the appropriate separate legal analysis and participation.
A business schedule should identify the company, the spouse's actual participation, relevant loans and any personal guarantees. Company turnover is not the spouse's disposable income, and company property is not available for transfer merely because that spouse manages the company. If a spouse promises a payment funded by future dividends, the agreement should distinguish a personal payment duty from an assumption that the company must declare them. The same care applies to foreign real estate. Obtain the title, ownership shares, mortgage information and any local restrictions before promising a transfer that the Bulgarian instrument alone may not complete.
A foreign agreement can be relevant and effective, but its language or place of signature does not alone determine the law governing the spouses' property. The assessment distinguishes applicable law, substantive validity, formal validity and local registration of specific rights. An agreement that works for assets in its country of origin may require additional steps for Bulgarian immovable property. Conversely, a foreign clause should not be rejected merely because its drafting style differs from a Bulgarian template. Read the executed agreement, amendments and the connecting facts before deciding whether to recognise its existing effect or prepare a new arrangement.
A cross-border file begins with dates and connecting facts. Bulgaria participates in Council Regulation (EU) 2016/1103 concerning jurisdiction, applicable law and the recognition and enforcement of decisions in matrimonial property regimes. Its temporal rules matter. The applicable law chapter applies to spouses who marry or specify the law applicable to their regime after 29 January 2019 under Article 69, paragraph 3. The rules governing proceedings and instruments have their own transitional treatment under paragraph 1. An older marriage is therefore not automatically excluded from every aspect of the Regulation, and a recent Bulgarian document does not by itself answer which law governs every earlier acquisition. The chronology should identify marriage, residence, law choices and relevant transactions.
Both parties should work from the same final text and understand the legal result of ordinary examples, including sale of the family home, parental leave and a purchase using mixed funds. Provide explanations in a language each understands, settle translation differences before signing and arrange the interpretation needed for the lawful notarial process. Separate legal advice can be useful where interests diverge. It helps each spouse evaluate the obligations they assume; it does not replace personal execution or notarisation. A signature on an unread translated summary leaves the most important financial consequences insufficiently examined.
A choice of governing law is also distinct from the property terms themselves. The law choice agreement must be written, dated and signed under Article 23, paragraph 1, with additional formal requirements potentially applicable under the remaining paragraphs. The matrimonial property agreement has its own formal rules in Article 25. Those rules can require compliance with additional formalities linked to habitual residence and, under paragraph 3, the law governing the regime. Accordingly, a simple signed statement cannot be assumed sufficient merely because the Regulation mentions writing. Where Bulgarian law supplies the relevant additional form, the personal execution and notarial requirements of the СК must be incorporated into the legal assessment. The appropriate form follows the combined applicable rules.
Disagreement about amendment does not mean that either spouse can simply choose a different contract. The legal basis for intervention depends on the problem alleged. A party may say that the agreement was defective when concluded, that a promised obligation has not been performed or that later circumstances have made its continued operation seriously harmful. Those are different propositions. The general rules on contractual invalidity apply correspondingly through Article 43, paragraph 1 of the СК, while changed circumstances are addressed in Article 42, paragraph 1, item 2. The factual chronology should therefore distinguish formation from performance and later events. A complaint that combines them without identifying the requested result can obscure an otherwise serious legal issue.
Judicial termination for changed circumstances requires more than a preference for a better bargain. One spouse must establish a substantial change and a serious threat caused by the contract to that spouse's interests, those of minor children or the family under Article 42, paragraph 1, item 2 of the СК. A major loss of earning capacity may be relevant if it makes a specified obligation threaten essential family needs. The claimant should connect medical or employment evidence to the contract's financial operation and the protected interest. A fall in income is not analysed in isolation from available resources, the obligation's scale and the actual consequences. The required connection gives the court a concrete legal question to decide.
The responding spouse may contest whether the alleged event is new, whether it is substantial or whether the contractual burden creates the required serious threat. Existing financial disclosures, the original assumptions, later payments and evidence of resources can matter to those questions. The defence should address the statutory conditions instead of relying solely on the fact that the claimant once signed. Equally, the claimant should not treat an unequal allocation as sufficient proof of every ground for intervention. The court must assess the identified legal basis and the evidence relevant to it. A proposed consensual amendment may resolve the practical problem, but its availability does not remove the need to understand the conditions of the judicial route.
The attorney identifies the permitted arrangement and prepares its operative terms; the notary performs the required authentication and property-transfer checks. The municipality and matrimonial property register deal with the separate publicity mechanism under Article 19 of СК. A dispute about invalidity or judicial termination belongs to the competent civil court, not to the notary as a substitute dispute tribunal. For clients abroad, a representative may organise documents and negotiations, but the personal-conclusion rule in Article 39(1) means that a power of attorney cannot simply replace the spouses at execution.
Execution planning should start with whether the contract transfers an immovable right. If it does, Article 39(2) of СК requires a notary in the property's district, with a choice among the relevant districts where several properties are involved. Send the title documents, proposed operative transfer and complete schedules before arranging attendance. For a premarital contract, supply the marriage certificate after the ceremony so the notary can take the property-registration step described in Article 39(3). The signed draft, notarial act and completed registration each serve a different function in implementing the couple's intention.
Where the applicable law chapter governs, the available choice is limited by the couple's actual connections. They may select the law of a state where either spouse or future spouse is habitually resident when the agreement is concluded, or a state of either person's nationality at that time, under Article 22, paragraph 1. A preferred law copied from a foreign template may therefore be unavailable if neither connection exists. Residence should be established through the person's actual circumstances, while nationality requires reliable supporting documents. Selecting the language of the contract or signing in a particular office does not by itself create the statutory connecting factor. The choice must be justified by the relevant facts at the legally relevant time.
Without a valid choice, the Regulation supplies a sequence rather than an unrestricted selection by the lawyer. The first common habitual residence after marriage is the primary connecting factor under Article 26, paragraph 1, followed by common nationality at marriage and then the state of the closest joint connection, as the provision specifies. Multiple common nationalities and the exceptional route in paragraphs 2 and 3 require attention where relevant. A couple's present home in Bulgaria therefore does not invariably make Bulgarian law the automatic answer for their entire matrimonial regime. The residence history and earlier arrangements should be established before a draft is built around an assumed domestic default.
The governing law generally applies to all assets within the regime regardless of location under Article 21, and it can be the law of a nonmember state under Article 20. Those rules do not mean every related subject or formality is absorbed into the same instrument. Maintenance, succession, the nature of rights in property and registration matters are excluded as specified in Article 1, paragraph 2. A Bulgarian contract involving an asset abroad may therefore require separate local examination of the right and registration process. Likewise, a law choice for matrimonial property does not automatically decide a maintenance question simply because both provisions appear in the same document. Each clause should be classified by its actual legal subject.
The foreign file should establish marriage date, nationality when the law choice was made, habitual residence at that time and the first common habitual residence after marriage. These facts perform different functions under Articles 22 and 26 of Regulation 2016/1103. Property documents identify the asset and local registration requirements, while the original signed agreement establishes the clauses and execution history. Keep proof of amendments and existing lender rights. A translation should preserve dates, qualifications and schedules rather than silently replacing foreign legal terms with a Bulgarian result the agreement never created.
