Spousal Support and Alimony After Divorce in Bulgaria

Lower earnings after years of family care do not automatically create a right to spousal maintenance. ARG assesses the statutory conditions, available resources and scope for a clear support agreement or enforceable claim.

Spousal Support & Alimony

After years caring for the family, one spouse may face divorce with little income and health problems that limit work. Does the former partner have to provide support? Clients ask ARG this expecting a percentage of the higher salary, but Bulgarian law requires a more specific assessment.

Through appropriately authorised Bulgarian lawyers, ARG can help in these situations.

  • Health or age limits the ability to work and meet essential expenses.
  • The divorce decision or proposed agreement leaves support unclear.
  • A maintenance period is approaching its end.
  • Remarriage, income or property changes affect an existing obligation.
  • Payments or relevant assets are located abroad.

Support depends on its legal basis

Marital duties, statutory maintenance after divorce and an agreed financial undertaking require distinct analysis.

Caregiving does not create automatic alimony

A career interruption may matter to the overall financial position, but statutory entitlement still requires the applicable conditions to be proved.

Duration and fault matter after divorce

Bulgarian statutory support for a former spouse has additional conditions, a limited ordinary period and specific rules for extension and remarriage.

Budgets and property claims must be separated

The adult’s needs, child maintenance and matrimonial property issues should be identified accurately before an amount or settlement is proposed.

What is spousal maintenance under Bulgarian family law?

Financial solidarity during marriage and support after divorce have different legal bases. The Family Code (Семеен кодекс, СК) requires spouses to contribute to family welfare according to their means under Article 17, while Articles 139 and 145 govern the relevant statutory maintenance conditions after divorce. A brief comparison is the broader assessment of resources, needs and family contributions under section 25 of the Matrimonial Causes Act 1973 in England and Wales. That framework must not be imported into a Bulgarian claim. Bulgarian spousal maintenance is not automatically an equalisation of the former partners’ salaries or compensation for every career opportunity forgone during marriage.

Who may qualify for maintenance after divorce?

The claimant must establish the general conditions of Article 139 of СК as well as the special conditions of Article 145. The general test concerns incapacity for work and inability to support oneself from one’s property. The former spouse’s greater income does not remove those requirements. A person who stopped working to care for children may have a compelling financial concern, yet a career gap or unemployment does not by itself establish incapacity. The practical distinction matters before negotiations and proceedings begin. It determines whether the claim rests on a statutory entitlement, an agreed undertaking or a different property or child-maintenance right.

Capacity needs to be examined in relation to the person’s actual condition. Medical assessments, treatment records and the functional effect of illness can show why work is unavailable or materially limited. A diagnosis should be connected to the work the person can realistically perform, rather than presented as a label that decides the entire case. Income from pensions or assets must also be considered. Neither a modest pension nor ownership of a property answers the issue automatically without understanding the available resources. The same statutory framework applies to a qualifying former husband or wife; the court should not infer entitlement from gender or the traditional division of family roles.

Which statutory conditions restrict the right to support?

The ordinary duration is no more than three years from termination of the marriage under Article 145(2) of СК, unless the parties have agreed a longer period. It does not begin afresh whenever a claim is eventually filed. An extension requires the recipient to be in an especially serious situation and the payer to be able to continue without particular difficulty. Timing can therefore decide whether a remedy remains available. In Decision No 220 of 1 November 2017, appellate civil case No 284/2017, Gabrovo Regional Court, a first claim brought more than three years after divorce was held inadmissible; requesting one year retrospectively did not cure the late first claim. The decision illustrates that specific procedural situation, rather than eliminating an existing right to seek extension on the statutory conditions.

The order of persons obliged to provide support is another often overlooked restriction. Children and a current spouse come first under Article 140(1), parents second and a former spouse third. The next rank becomes liable when those in the preceding rank cannot provide support under paragraph 2. This is not an invitation to demand payments from a minor child without examining capacity and the governing rules. It requires the claimant’s actual family circumstances and the resources of any relevant earlier-ranking persons to be assessed. On the payer’s side, Article 141 also prioritises competing maintenance creditors. A former spouse’s claim cannot be evaluated as though dependent children and other prior-ranking obligations did not exist.

How is post-divorce support different from child maintenance?

Maintenance belongs to the person whose needs the obligation serves. A child’s claim is not part of the former spouse’s personal allowance, even when both payments reach the same household. Parents’ duties toward minor children under Article 143(2) of СК have special protection independent of the ordinary capacity and property test. The minimum linked to one quarter of the minimum wage in Article 142(2) concerns a child, not a universal minimum for an adult former spouse. A proposed budget should therefore distinguish the adult’s necessary expenses from the child’s expenses and shared housing costs. Otherwise the same item may be counted twice or a valid child claim overlooked because the adult does not qualify personally.

Property division answers a separate question about ownership and shares. Receiving a share of an apartment does not automatically settle every maintenance issue, although the property’s actual use and income potential may affect need. Equally, a maintenance award does not transfer ownership of the family home or reimburse a former partner’s contribution to purchasing it. A settlement should identify which payment is maintenance, which is a property equalisation payment and which concerns a child. Different legal conditions, duration and enforcement consequences attach to each. A single unexplained monthly figure can conceal disagreement about what ends on remarriage, what remains payable as an ordinary debt and who is entitled to receive it.

When does marital fault or capacity to work affect entitlement?

The statutory post-divorce right is given to the spouse who is not at fault for the divorce under Article 145(1) of СК. The divorce court determines fault when requested under Article 49(3). The judgment and any approved agreement therefore need to be read, rather than treating the person who filed for divorce or earns less as automatically innocent. A divorce without a fault determination requires careful analysis of the basis of the later claim. An agreed support obligation should also be distinguished from an assumption that the ordinary statutory conditions have already been adjudicated.

How does support by agreement differ from court-ordered maintenance?

A mutual-consent divorce agreement under Article 51(1) of СК addresses maintenance between the spouses alongside the other required matters. The parties can define a payment amount, due date, account, duration and the events relevant to adjustment. An agreed longer period is expressly permitted by Article 145(2). A negotiated arrangement can be particularly important where the family wishes to provide a transition after years of unpaid care but a statutory claim is uncertain. Its legal nature and wording must be clear. A court should not be asked to enforce a promise whose amount, starting date or conditions cannot be identified from the document.

Freedom to settle is not permission to ignore mandatory rules. A waiver of future maintenance is void under Article 147 of СК, and Article 148 prohibits setting off another claim against a maintenance obligation. A statement that neither party currently seeks maintenance must therefore be distinguished from an attempt to abolish every possible future statutory right. Similarly, an alleged debt for a car or property expense should not simply be deducted from a monthly maintenance instalment. Separate the obligations and obtain advice on the proposed settlement’s effect. A longer support term, a property transfer and acknowledgement of already paid instalments each require their own accurate explanation.

How are genuine need and ability to pay assessed?

The amount follows the recipient’s needs and the payer’s means under Article 142(1) of СК. A useful needs schedule identifies necessary accommodation, food, utilities, treatment and other relevant living expenses, then explains what pensions, earnings or usable property income already cover. Annual expenses can be converted into a transparent monthly equivalent where appropriate. Supporting documents should show the actual cost and who bears it. A requested amount based only on the former marital lifestyle or a percentage of the other person’s income does not address the Bulgarian test. The court needs to see the genuine shortfall remaining after the claimant’s own resources are considered.

Ability to pay requires an equally realistic account. Salary statements, pension records, rental receipts, business distributions and existing legally relevant obligations may matter. Company turnover should not automatically be treated as the shareholder’s personal disposable income, and a foreign salary should be assessed with its taxation and proven necessary outgoings. The payer’s own essential support and prior-ranking maintenance duties are relevant. A low figure in a single document can be questioned where other reliable evidence shows available resources, but suspicion is not proof. The requested award should connect an established need to an established capacity, rather than use the case to punish the former spouse for the breakdown of the relationship.

When can maintenance terminate or be modified?

The recipient’s remarriage terminates the former-spouse maintenance right under Article 145(3) of СК. The payer’s remarriage is a different event and does not automatically produce the same result. Changes in income, health, assets or relevant family obligations can support a claim to vary or terminate an award under Article 150, provided their effect is established. A payer should not assume that a personal calculation has rewritten the court’s operative order. The existing title, the date of the alleged change and any payments made must be examined so that the correct judicial or enforcement response is used and the dispute does not grow through undocumented deductions.

An approaching expiry requires its own decision. The ordinary three-year limit, an agreed longer term and an extension under Article 145(2) should not be confused. An extension needs both the recipient’s especially serious situation and the payer’s ability to provide support without particular difficulty. A continuing ordinary shortfall alone does not establish that enhanced test. Serious misconduct can also affect entitlement under Article 151(1), but a difficult relationship or an unsupported accusation is not enough to demonstrate the provision’s conditions. These issues call for concrete dates and evidence, including the prior award and the reason support is said to remain necessary, rather than a general request that payments continue indefinitely.

Let’s discuss your plans for Bulgaria

Tell us where you live, how your business works and what you want to change. We will help you identify the questions to resolve and the next steps to consider.

What happens if the former spouse remarries or circumstances change?

The first step is to identify the event and the obligation it affects. Under the Family Code (Семеен кодекс, СК), the recipient’s remarriage ends the former-spouse maintenance right through Article 145(3), while a change in circumstances can justify variation or termination under Article 150. A limited comparison is the power to vary qualifying financial orders under section 31 of the Matrimonial Causes Act 1973 in England and Wales. The Bulgarian analysis still depends on its own conditions. Record the date of remarriage or financial change, obtain reliable supporting documents and distinguish future payments from instalments that had already fallen due.

Which documents prove income, work ability and necessary expenses?

Medical evidence should explain the practical limitation on work, its expected duration and relevant treatment, not simply list diagnoses. Pension decisions, wage records, benefit statements and tax information help establish existing resources. Necessary expenses should be supported by rent documents, utility records, prescriptions, treatment invoices and other material relevant to the claimed shortfall. Separate recurring costs from a single exceptional payment. If an adult child or parent could be an earlier-ranking maintenance provider under Article 140 of СК, the evidence must also address that issue. A claim against a former spouse should not omit a legally relevant support source simply because the parties would prefer not to discuss it.

Documents held by someone else can require a targeted evidential request. The Civil Procedure Code (Граждански процесуален кодекс, ГПК) provides mechanisms for production by a party under Article 190(1) and a nonparty under Article 192(1). A restrained comparison is the family-evidence framework in Part 22 of the Family Procedure Rules in England and Wales, whose procedures differ. Identify the document, who holds it and why it proves a relevant fact. An employer’s earnings record or a specific rental agreement is more actionable than a demand to investigate everything the former spouse has ever owned. Foreign evidence may require the applicable cooperation procedure rather than assuming a Bulgarian production order compels every overseas institution directly.

How should the court approach assets held overseas?

An overseas asset matters because of what it establishes about available resources, rather than because foreign ownership is inherently decisive. A registry extract can show title, while a tenancy agreement and bank receipts may show actual rent. The remaining loan, co-ownership share, restrictions on use and necessary expenditure can affect the resource available for maintenance. A property occupied as the claimant’s necessary home raises different issues from a second apartment producing rent. Present the facts supporting the distinction instead of assuming that every property must generate an identical income or that an asset can be ignored because it is outside Bulgaria.

The same care is needed with a business interest. A company’s account balance belongs to the company unless there is a legal basis for treating a sum as available to the individual. Dividends, salary, distributions or enforceable claims should be identified separately. Foreign documents need a usable translation, consistent identity details and any authentication required for their particular type and route. Asset value and enforcement location are also different questions. Evidence may help the Bulgarian court assess means while actual seizure requires action in the country where the asset is held. Knowing that distinction early can prevent an apparently strong monetary claim from being presented with no workable route to recovery.

Can a post-divorce settlement regulate support?

A support arrangement should state who owes what to whom, when payments start and end, and how compliance will be proved. The divorce agreement under Article 51(1) of СК can regulate spousal maintenance, and Article 145(2) permits an agreed longer duration. Identify child support and property payments separately. Where future adjustment is contemplated, the terms should describe the relevant condition clearly without purporting to displace mandatory law. A signed private promise and a court-approved enforceable arrangement do not automatically have identical procedural consequences. The legal form should match the intended use, especially if the recipient expects to enforce the undertaking abroad.

How are overdue payments enforced?

Begin with the operative title and an instalment schedule showing the amount due, due dates, payments received and remaining balance. Monetary maintenance is monthly, with statutory interest on delay under Article 146(1) of СК. A Bulgarian enforcement officer acts on a suitable enforceable title through Article 426 of ГПК; Article 404 identifies relevant enforcement grounds. A maintenance award is subject to preliminary enforcement under Article 242(1), so an appeal should not simply be assumed to prevent collection. The actual title and its legal effect must be established. The creditor should give available information about accounts, employment and assets, while the officer uses the lawful enforcement powers for the particular property and debtor.

A payment dispute should be resolved through accurate accounting. Bank references, receipts and earlier enforcement statements may show that a particular instalment was paid, while an unrelated property transfer may not discharge maintenance at all. The no-setoff rule in Article 148 of СК remains relevant. Past maintenance being established for the first time under Article 149, which is limited to the preceding year, should not be confused with collection of instalments already awarded in an existing judgment. The state does not advance former-spouse maintenance under Article 152(4). Recovery therefore needs a realistic asset and enforcement plan, rather than an assumption that a municipality will replace payments if the debtor defaults.

When is another country’s court competent to decide spousal maintenance?

Within its applicable scope, Council Regulation (EC) No 4/2009 on maintenance obligations gives jurisdiction under Article 3 to the courts of the defendant’s or creditor’s habitual residence, with additional qualified routes for an ancillary claim. A court handling divorce does not acquire maintenance jurisdiction solely because one spouse has its nationality. For spouses and former spouses, Article 4 permits a written choice of specified connected courts, including the court competent for the matrimonial dispute or the state of their last common habitual residence of at least one year. The precise connecting factor and agreement matter. A convenient postal address or the location of a bank account alone does not establish the forum.

The law governing entitlement is a separate question. The relevant conflict-of-law instrument for states bound by it is the Hague Protocol of 23 November 2007 on the Law Applicable to Maintenance Obligations, as provided by Article 15 of the Regulation. The general connecting factor is the creditor’s habitual-residence law under Article 3, but a spouse may object under Article 5 where another state’s law has a closer connection with the marriage, particularly the last common habitual residence. A Bulgarian court may therefore need to apply a different substantive law. The Bulgarian incapacity, fault and duration rules described here should not be promised as the outcome before that analysis. Residence history, marriage history and any valid choice-of-law agreement can materially affect the answer.

How should a person abroad choose the next step in a support dispute?

Which Bulgarian court or professional is competent for the requested result?

A new claim, a variation and collection of an existing award require different applications. Where Bulgaria has jurisdiction, an ordinary maintenance action belongs at district-court level; Article 112 of ГПК also permits filing at the claimant’s permanent address. The local venue does not independently create international jurisdiction. Claims are heard through the expedited procedure under Article 146(2) of СК, and maintenance claimants have the statutory fee exemption in Article 83(1), item 2 of ГПК. That does not mean every lawyer, translation or adverse-cost risk disappears. A Bulgarian lawyer can distinguish the applicable route and organise representation; an enforcement officer collects an enforceable obligation rather than deciding a new entitlement.

The divorce date and previous maintenance history should be examined before spending time on a proposed first claim. In Decision No 220 of 1 November 2017, appellate civil case No 284/2017, Gabrovo Regional Court, the court rejected a first claim made after the three-year period even though part of the requested retrospective period fell within it. The practical lesson is to disclose the final divorce decision and any earlier award immediately. An existing extension issue is distinct from attempting to create the first award after expiry. Negotiations and correspondence should not be assumed to restart the statutory period or cure an already missed procedural condition.

Which cross-border documents or enforcement complications actually arise?

For enforcement under the Regulation’s route for a decision from a state bound by the 2007 Hague Protocol, Article 20 requires an authentic copy of the judgment, the issuing court’s Annex I extract and, where appropriate, an arrears statement with its calculation date. The extract may need translation into an accepted language. A translation of the judgment itself is not routinely required under Article 20(2), although it may be requested if enforcement is challenged; translations must satisfy paragraph 3. These documents support the particular enforcement mechanism, not a new trial on whether the former spouse deserved support. The destination, origin and enforceability must be checked before selecting the form.

A debtor seeking a reduction also needs to consider Article 8 of the Regulation. Where the original decision was given in a covered state in which the creditor was habitually resident and remains so, the debtor ordinarily cannot start modification proceedings in another Member State, subject to the specified exceptions. Moving abroad does not itself create a fresh choice of forum. Outside the Regulation’s relevant route, the applicable treaty or domestic recognition procedure must be identified for the country and obligation concerned. Keep the award, payment history, service records and any later variation together, so that the authority abroad can identify the current debt and avoid collecting amounts already paid or superseded.

Questions and answers

01 / 06

Does the lower-earning spouse automatically receive alimony

No. Under Bulgarian statutory rules, entitlement requires the applicable conditions, including the general incapacity and property test and the additional requirements for a former spouse. An agreed undertaking may require separate analysis.

Does caring for the family create compensation through maintenance

Caregiving may be relevant to property rights, negotiations and the factual financial position. It does not alone establish a statutory maintenance award compensating for every period outside paid employment.

How long can support after divorce continue

The ordinary Bulgarian statutory limit is three years from termination of marriage unless a longer period is agreed. A court extension requires the recipient’s particularly difficult condition and the payer’s ability to continue without particular difficulty.

Is spousal support the same as child maintenance

No. The claimant, conditions and purpose differ. A child’s maintenance is not simply personal income awarded to the parent, and the two needs should be presented separately.
