Judicial partition ends co-ownership through a legally available method. ARG helps compare division in kind, a negotiated buyout, special allotment and public sale against the established shares and available funding.

One owner wants to sell an apartment while the other lives there and refuses both a sale and a buyout. Clients ask ARG whether that refusal means they must remain co-owners indefinitely, and whether their half share can become a separate half of the flat. These are different legal questions.
ARG can arrange advice and representation through authorised Bulgarian lawyers in the following situations.
An ideal share concerns the whole ownership right. Allocating use does not automatically create a separate property.
Participants, assets and shares must be properly established before the court determines how partition will be carried out.
Ordinary co-ownership does not give the occupier a general right to have an indivisible home awarded against payment.
Renovation, income and compensation for use require their own legal basis and timely evidential preparation.
The starting point is a share in ownership, rather than residence, family relationship or contribution to maintenance. The Ownership Act (Закон за собствеността, ЗС) permits a co-owner to seek partition under Article 34, subject to exceptions arising from legislation or the nature and purpose of the property. For comparison, disputes over shared land in England and Wales may involve applications under sections 14 and 15 of the Trusts of Land and Appointment of Trustees Act 1996. That provides a useful institutional reference, but the Bulgarian right and methods of partition follow their own rules. A majority share is not generally needed to begin the Bulgarian claim.
An agreement that ownership will remain shared indefinitely does not ordinarily defeat the right provided by Article 34 of ЗС. The same provision states that the partition claim is not extinguished by limitation. This does not mean that evidence of ownership can be ignored indefinitely. A defendant might assert that another person's share has already been acquired through possession, or that the claimant sold it years earlier. Such a defence attacks the continued existence of co-ownership. It differs fundamentally from saying that the claimant has simply waited too long to ask for partition.
The Civil Procedure Code (Граждански процесуален кодекс, ГПК) separates the litigation into admission and implementation, particularly through Articles 341 to 355. In England and Wales, the Civil Procedure Rules likewise regulate how disputed property claims are presented and proved, but they do not reproduce this Bulgarian two-stage partition structure. The first Bulgarian judgment under Article 344, paragraph 1 of ГПК identifies the participants, the properties and their respective shares. It does not yet divide the apartment into rooms or transfer the entire dwelling to one participant. Once final, those determinations govern the second stage.
All owners must be included. For inherited property, the Inheritance Act (Закон за наследството, ЗН) expressly provides in Article 75, paragraph 2 that partition without a co-heir is wholly void, and Article 34 of ЗС extends the relevant inheritance partition rules to other co-ownership. The closest English and Welsh comparison is the law governing administration and distribution of estates, although the Bulgarian requirement operates within its particular partition procedure. A family list compiled from memory is therefore insufficient. An earlier owner's death, a transferred share or a deceased heir's descendants can change the necessary participants.
The consequence of an omission has recently been clarified. In Interpretative Decision No. 4/2023 of 16 June 2025 in Interpretative Case No. 4/2023, the General Assembly of the Civil Chamber of the Supreme Court of Cassation held that a claim under Article 75, paragraph 2 of ЗН is admissible after a final admission judgment even though the partition has not yet been completed. The omitted owner need not wait for a sale or allotment. The court explained that the defect cannot simply be cured by adding that owner during implementation, because the final first-stage judgment already determines the participants.
An agreed division remains worth considering where all necessary participants consent to a lawful outcome. Voluntary partition of immovable property requires writing with notarised signatures under Article 35 of ЗС, and the provision imposes an additional requirement of prior district-court permission where legally incapable or absent persons participate. A settlement must accurately identify the assets and shares, address equalisation and possession, and state what happens to outstanding accounts. An informal exchange of messages about which room each person will use is not equivalent to terminating co-ownership through the required instrument. Technical restrictions on independent properties also remain relevant despite agreement.
The agreed route requires consent on the actual proprietary result, whereas judicial partition can determine a lawful outcome despite disagreement. Neither route automatically converts an informal arrangement about rooms into separate ownership. A buyout must specify the right transferred and the corresponding payment. An agreement regulating use alone leaves the participants as co-owners and does not prevent a later partition claim under Article 34 of ЗС. This distinction is useful where the parties can agree on temporary occupation but remain far apart on the price of a final exit.
The Spatial Development Act (Закон за устройство на територията, ЗУТ) supplies important constraints. Its Article 203 permits judicial division of buildings and dwellings into independent properties where this can occur without substantial alteration, without inconvenience exceeding the ordinary, and consistently with construction rules. The closest comparison in England and Wales is planning and building control, which likewise addresses whether proposed physical arrangements are lawful, although approvals and tests differ. The Bulgarian chief architect approves the relevant investment project or issues a reasoned refusal. The partition court reviews the legality of that position within the partition proceedings under Article 203, paragraph 2.
This requires more than an estimate of how cheaply a partition wall could be erected. Independent access, the arrangement of essential facilities, structural work and the status of shared spaces can determine whether the proposal is possible. If one proposed dwelling can only be reached through the other's kitchen, the apparent equality of floor area conceals a serious defect. For a regulated land parcel, Article 201 of ЗУТ requires the relevant municipal assessment and examination of the planning conditions for division. Minimum dimensions, existing buildings and permitted development can prevent a boundary that appears convenient on a cadastral printout.
Special allotment of an indivisible dwelling has specific eligibility conditions under Article 349 of ГПК. For the inherited-home route in paragraph 2, the applicant must have lived there when the inheritance opened and must own no other dwelling, alongside the remaining statutory requirements. The separate route in paragraph 1 concerns a dwelling formerly held in marital community, ended by divorce or the death of a spouse. The surviving or former spouse seeking allotment must have been awarded the exercise of parental rights concerning the minor children of that marriage and must have no dwelling of their own. Merely being a former spouse or currently living with a child is insufficient. The request must be made no later than the first hearing after the admission judgment becomes final under paragraph 4. If the indivisible property cannot lawfully be placed in a share, public sale follows under Article 348.
The Supreme Court of Cassation clarified the treatment of different property types in Interpretative Decision No. 2/2021 of 11 April 2022 in Interpretative Case No. 2/2021, General Assembly of the Civil Chamber. Allocation under Article 353 does not require the properties to be identical in type or purpose. A dwelling, a shop and land are not automatically destined for public sale merely because they differ. The court must consider whether real shares can be formed consistently with the participants' rights, while avoiding a result that effectively forces a participant to sell everything for money.
The size of a share also needs careful identification. Shares are presumed equal until the contrary is proved under Article 30, paragraph 2 of ЗС. The purchase deed, inheritance documents and subsequent transfers may establish a different proportion. Paying more of the mortgage instalments, maintaining the roof or covering local charges does not automatically rewrite the fractions stated in a valid acquisition. Those payments may support separate monetary claims, depending on their legal basis and proof. Treating expenditure as ownership can cause a party to make an unsustainable claim to a larger share while overlooking the claim that the evidence actually supports.
A defendant can dispute the claimant's ownership, the proposed share or the inclusion of a particular asset. The first hearing matters under Article 342 of ГПК, while Article 343 permits determination of specified preliminary disputes, including questions about wills and reduction of testamentary dispositions or gifts. The general evidential rule in Article 154 requires each party to prove the facts supporting its claim or objection. A person asserting a larger share must therefore identify the acquisition producing it. An opposing party relying on a later transfer must produce and explain that transaction, rather than merely challenge the claimant's arithmetic.
The property division and the financial relationship between co-owners overlap without becoming identical. A participant may own one third of the property, be owed a share of rental income and owe part of necessary preservation costs. Those positions require separate factual and legal analysis. The court should not reduce an ownership quota merely because another person paid the insurance or installed expensive fittings. Nor should a claimant assume that the value of every invoice can be deducted from the equalisation payable. A monetary claim needs its own basis, amount and supporting evidence.
Past expenses and income also require timely procedural treatment. Claims between participants concerning accounts can be introduced at the first hearing after admission of partition under Article 346 of ГПК. A person seeking reimbursement should identify the work, when it was done, who paid, whether the other owners agreed, and the legal basis for the amount sought. An invoice proves a charged cost, but it does not automatically prove that every other owner owes the same fraction of it. Necessary preservation, improvements and expenditure serving only the occupant's convenience can produce different questions. Ownership fractions and monetary accounts must not be merged without legal justification.

The first task is to reconstruct acquisition of every proposed asset. The Ownership Act (Закон за собствеността, ЗС) recognises a co-owner's right to partition in Article 34, while Article 30, paragraph 2 supplies a presumption of equal shares unless the contrary is proved. The closest English and Welsh institutional comparison is litigation about shared land under sections 14 and 15 of the Trusts of Land and Appointment of Trustees Act 1996. The Bulgarian inquiry remains tied to the actual acquisition documents and fractions. A spreadsheet showing who paid household expenses cannot replace the deed or succession through which ownership arose.
The Inheritance Act (Закон за наследството, ЗН) makes omission of a co-heir a serious validity problem under Article 75, paragraph 2, with the relevant rules extended to co-ownership through Article 34 of ЗС. Estate administration and distribution in England and Wales concerns the comparable subject, but does not supply the Bulgarian procedural conditions. Every person who actually holds a share must be identified. A person described as an heir may have transferred that interest, while someone absent from a family certificate may have acquired it by purchase. The parties should resolve those distinctions before asking the court to divide the assets between an incomplete group.
The Civil Procedure Code (Граждански процесуален кодекс, ГПК) identifies the documents accompanying an application in Article 341 and gives other participants an opportunity to request inclusion of additional property at the first hearing. The Civil Procedure Rules play the corresponding general procedural role in England and Wales, although Bulgarian partition follows its own stages and deadlines. The written claim and response should distinguish the properties, their identifiers and the alleged shares. If two documents describe the same property differently, the explanation may require historical plans or expert identification. Similar addresses do not conclusively establish that two records concern the same legal object.
The consequence of leaving out an owner is illustrated by Interpretative Decision No. 4/2023 of 16 June 2025 in Interpretative Case No. 4/2023, General Assembly of the Civil Chamber of the Supreme Court of Cassation. It permits a nullity claim under Article 75, paragraph 2 of ЗН after the admission judgment becomes final, even before division is completed. The initial judgment's binding determination of participants cannot simply be repaired by adding the omitted owner in the second stage. The practical objective before admission is therefore a complete, evidenced ownership picture. Once that picture is settled, later expert work can address division of the correct assets among the correct people.
After ownership is established, the evidence must address the possible methods of partition. A valuation alone does not answer whether physical division is lawful. The Spatial Development Act (Закон за устройство на територията, ЗУТ) sets the relevant conditions for regulated parcels in Article 201 and for buildings and dwellings in Article 203. Planning and building control in England and Wales provides a limited comparison because lawful physical configuration is also regulated there, but Bulgarian requirements must be examined directly. The distinction matters where a party presents two coloured areas on a plan as if that automatically creates two independent properties.
For a building, the expert should explain the proposed units, their access, facilities, structural implications and necessary alterations. Division must be possible without substantial reconstruction or inconvenience beyond the ordinary and must comply with construction rules under Article 203 of ЗУТ. The chief architect approves the project or gives a reasoned refusal, whose legality the partition court reviews under paragraph 2. A useful challenge to an expert opinion identifies the missing technical issue or a supported alternative configuration. Simply insisting that the house is large enough does not show that each proposed unit can lawfully function independently.
Valuation should then support the proposed legal method. A dwelling considered for special allotment is assessed at actual value under Article 349, paragraph 4 of ГПК. More generally, allocation proposals need reliable values to compare real shares with the established quotas and calculate equalisation. The expert should use relevant market evidence and explain the property's actual condition, lawful use and material limitations. A party can challenge unsuitable comparables, incorrect floor areas or ignored defects. A high asking price from an unrelated advertisement does not automatically disprove a reasoned valuation, just as an old tax assessment does not settle current market value.
Past monetary claims need a separate evidential chronology. Claims concerning accounts are introduced at the first hearing after admission under Article 346 of ГПК. Work invoices should be connected to the property, payment and purpose of the work, while rental claims should identify receipts and periods. Personal-use compensation under Article 31, paragraph 2 of ЗС requires proof of the written demand's receipt and actual deprivation. In Interpretative Decision No. 7/2012 of 2 November 2012 in Interpretative Case No. 7/2012, the Supreme Court of Cassation's General Assembly of the Civil Chamber explained that free occupation by family or another person can qualify as personal use by the co-owner who excludes the others.
The same decision makes the defence evidence equally important. A genuine offer of proportionate use can defeat an assertion that the claimant was deprived, while receipt of actual rent raises the distinct benefits rule in Article 30, paragraph 3 of ЗС. The financial calculation should identify periods of changed use and avoid counting the same benefit twice under incompatible descriptions. By connecting the evidence to the correct basis, the court can distinguish ownership value, temporary occupation and historical accounts. That separation helps the client understand what a proposed settlement actually pays for and which claims would remain unresolved if its wording dealt only with the property itself.
An existing mortgage must be assessed before comparing what each participant will receive. The Obligations and Contracts Act (Закон за задълженията и договорите, ЗЗД) protects the mortgage creditor’s right to follow the property under Article 173, paragraph 1. Mortgages in England and Wales have a comparable security function, although Bulgarian priority and discharge rules govern here. An agreement between co-owners does not by itself release the creditor’s security or free a personally liable borrower. The instrument, the exact property or share mortgaged and the chosen partition method therefore matter. Public sale has distinct consequences under Article 175, including its stated exception where the buyer assumes the secured debt by agreement with the creditor.
A lease requires a separate assessment of the landlord’s authority, the term, registration, occupation and enforceability against the person receiving the property. For an ordinary transfer, Article 237 of ЗЗД distinguishes registered leases from leases with a legally certain date and other occupation arrangements. That is not a blanket rule that every partition either preserves every lease or ends them all. The proposed result must explain whether vacant possession can actually be delivered, whether rent remains receivable and whether the valuation reflects an enforceable tenancy. A participant should not accept a supposed ready-to-use home without resolving who currently has a lawful right to occupy it.
A foreign address does not make a participant's absence irrelevant. The court must proceed through the applicable service rules, and the party should arrange reliable representation and access to the case papers. Authority to conduct litigation must be distinguished from authority to conclude a settlement or dispose of the subject matter, for which Article 34, paragraph 3 of ГПК requires express powers. A proposed settlement should not be signed on the assumption that any general authorisation necessarily covers every proprietary act. The exact authority and form should be matched to the action contemplated. This is particularly important where the client intends to remain abroad throughout the proceedings.
Refusal to negotiate does not create a veto over the statutory partition claim. The absent owner must still be joined and served through the applicable procedure, and the court must establish the ownership evidence. Absence is not a concession that the claimant’s proposed shares are correct. Conversely, an owner cannot safely ignore the case until the sale stage. Once the admission judgment has become final, the established participants, properties and shares constrain the next stage. Any challenge to those matters should be raised through the appropriate procedural opportunity.
A settlement is economically attractive when its enforceable net result is preferable to the realistic judicial alternatives. Compare the money each person actually receives after secured debt, agreed accounts, costs and necessary work, together with the payment date and the risk of non-payment. The relevant auction comparison is not an advertised market price guaranteed to be achieved. Nor is a low private offer justified merely by threatening an auction. Independent valuation and a clear analysis of the available method give both sides a more credible negotiating range.
Payment security is as important as the headline price. An immediate buyout, instalments secured appropriately and a division requiring construction work have different risks. The agreement should connect title, money, handover and outstanding use claims so that performing one obligation does not leave another essential obligation uncertain. It should also state which historical accounts are settled and which remain. An agreement signed by fewer than all necessary owners cannot provide the complete partition result, even where those signing represent most of the property’s value.
Partition proceedings begin before the district court under Article 341 of ГПК. Territorial venue must be checked for the actual claim, including the property-location rule in Article 109 and the special inheritance rule in Article 110 where applicable. A client living abroad should therefore identify whether the case concerns ordinary co-ownership or division of an inheritance before assuming that the nearest court to the home is always competent. Joined disputes may also require their own jurisdictional assessment.
The court determines owners, shares and the lawful method. The expert provides technical divisibility and valuation evidence, while the chief architect has the statutory project role under Article 203 of ЗУТ. None of those professionals replaces the others. A notary can assist with a properly agreed transaction but cannot decide a contested share by selecting the most persuasive family account. The lawyer’s procedural request should identify whether the immediate need is recognition of a fraction, temporary use, a timely accounts claim or a supported proposal for the second stage.
Foreign death, civil-status or succession documents must establish the relevant identity and link in the ownership chain. Accurate Bulgarian translation is required for foreign-language evidence under Article 185 of ГПК, while authentication and the effect of the foreign instrument depend on the applicable route. A change of surname or successive deaths can explain why the present owner is absent from an older certificate. Those gaps should be resolved before admission, not left to the valuation expert. Authority to settle must expressly cover the intended disposition under Article 34, paragraph 3 of ГПК.
Payment planning should begin before the allotment judgment, because the statutory consequences are strict. Monetary equalisation together with statutory interest must be paid within six months from finality under Article 349, paragraph 5 of ГПК. The recipient acquires ownership upon timely payment under paragraph 6. Non-payment causes the allotment to lose effect by operation of law. The statute then directs the property toward public sale, subject to its specified possibility of allotment to another qualified participant who made a timely request and pays immediately on the prescribed basis. The losing participant need not accept an indefinite promise that financing will eventually be arranged.
