A property owner came to ARG with property management and rental tax work spread across several people. ARG first reviewed the owner’s objectives, then organised the legal, tax and documentary tasks. Clear communication helped the owner understand what each part of the work required instead of coordinating separate explanations alone.

That situation reflects a common problem for landlords in Bulgaria. Managing an apartment in Sofia, Varna or Burgas is not only about collecting rent. You also need to identify the taxable income, establish who is responsible for withholding or payment, track the correct deadlines and prepare reliable records for the annual return. A property manager can coordinate these steps, but does not automatically change the legal responsibilities set by the tax rules.

ARG can help when you need to

  • Classify personal rental income and check the applicable statutory expense deduction.
  • Map the tenant’s status and identify who must withhold, pay or declare the tax.
  • Organise quarterly deadlines and review the fourth quarter withholding arrangement.
  • Prepare the annual return file with Appendix 4, lease records and payer statements.

At a glance

(001)
Lease and operating records

Provide leases, deposits, rent receipts, management terms and expense records. The actual letting model determines operational duties and the accounting information required.

(002)
A clear decision mandate

Specify who may instruct, sign, approve spending and receive reports. Professional tax, legal and regulated investment functions need named responsible advisers.

(003)
Tax residence and transaction year

Identify your residence facts, relevant countries and planned dates. Immigration status and the bank account’s location do not settle the tax treatment.

(004)
Lawful intended use

Describe whether the asset will be a home, office, rental or business premises. Check permitted use, commissioning and any approvals needed for the actual activity.

Who should control letting, repairs and the owner's money?

Property management should start with a written allocation of authority. The manager needs to know whether they may advertise, choose tenants, sign leases, collect deposits, approve repairs or represent the owner before the condominium and utility providers. Set spending limits, an emergency procedure and the matters requiring your written approval. Administrative convenience should not leave the manager able to make an unbudgeted long-term commitment.

Use a handover inventory, dated photographs, meter readings and a clear record of keys. For each tenancy, retain the signed agreement, identity and contact details obtained lawfully, rent schedule, deposit terms and evidence of receipts. A deposit should be tracked separately from earned rent: whether and when any retained amount becomes income depends on what it pays for. Do not let a monthly net remittance conceal the underlying rent, charges and deductions. NRA: rental-income rules.

The agreement should distinguish ordinary maintenance from improvements, set the process for comparing contractor quotations and require invoices and evidence that work was performed. Record conflicts where a manager recommends a related contractor. Obtain a reliable way to inspect the property and recover keys, records, deposits and access credentials when management ends.

Long-term residential letting and repeated short-stay accommodation can fall under different tax and operational regimes. Before using an online accommodation platform, determine the applicable tourism registration or categorisation, guest reporting and tax obligations for the actual activity. ARG coordinates the management brief and accounting handover so the owner can see occupancy, unpaid rent, expenditure, upcoming renewals and filing duties without having to reconstruct them from scattered messages.

What needs to be agreed before a tenant moves in?

Start with the actual letting arrangement. Identify every landlord, the person signing for them, the intended occupants and whether the tenant contracts privately or through a business. That last distinction also affects the ordinary resident individual's rental withholding position. If several family members own the apartment, agree who may sign, collect money and approve expenses without confusing that administrative role with ownership of the entire rental income.

A usable lease specifies the premises, permitted use, term, rent, payment account, payment dates, deposit and allocation of utility and building charges. Record any indexation, break arrangement, restrictions on subletting and the procedure for reporting defects. Avoid leaving an English summary materially different from the Bulgarian contract: the tenant and owner should understand the same obligations before either signs. NRA: rental-income rules.

Complete a signed inventory with photographs, meter readings, keys and the condition of appliances and furniture. State how the deposit will be held and which documented liabilities may be deducted at the end. A refundable deposit is not automatically earned rent; if part is later applied to unpaid rent or damage, the records must show that change. Do not promise deductions without evidence of the underlying claim.

Provide contact and notice details that will work while you are abroad. A manager needs clear authority to inspect by arrangement, arrange approved repairs and receive reports, together with an emergency contact. The owner should approve material concessions, long renewals or a change of use. ARG coordinates the lease file and management instructions so the first month's collection, tax treatment and maintenance responsibilities all follow the agreement actually signed.

How is rental income treated for an individual owner?

For a Bulgarian tax-resident individual in the ordinary rental-income regime, taxable rent is generally calculated after the statutory ten-percent expense allowance under Article 31 of the Personal Income Tax Act. This is a prescribed allowance, not a system allowing the owner simply to deduct every actual repair, mortgage instalment and management fee. The applicable tax base and reporting route change where the owner is a company, a nonresident or is conducting a business activity rather than ordinary letting.

Who pays the rent matters. A Bulgarian business or self-employed tenant can have withholding and reporting duties, while a private tenant may leave the landlord responsible for advance tax. Annual reporting and quarter-specific rules must be checked alongside amounts already withheld. Ask for the payer's certificates and reconcile them with the bank receipts so that the same tax is neither omitted nor counted twice. NRA: rental-income rules.

For a nonresident, Bulgarian-source rent can be subject to final-tax rules. Treaty relief, an EU/EEA recalculation option and the owner's foreign return require separate examination. Owning a Bulgarian apartment does not automatically make the owner Bulgarian tax resident, and transferring rent to a foreign account does not change where the property is located.

Prepare a monthly record of gross rent, the period it covers, amounts actually received, withheld tax, deposits and adjustments. Include payments made by an agent on your behalf. ARG coordinates the property records with the accountant, who determines the correct return, payer obligations and deadlines from your residence, ownership and letting model. A dependable rental statement explains the gross transaction before showing the net cash available to you.

Where are you tax resident, and which income does Bulgaria examine?

Tax residence is a factual and legal classification, not simply nationality, immigration permission or ownership of an apartment. Article 4 of the Bulgarian Personal Income Tax Act considers the statutory residence criteria, including presence for more than 183 days in a twelve-month period and the centre of vital interests. A Bulgarian permanent address does not make a person resident where the centre of vital interests is outside the country under the Act's exception.

The centre-of-interests assessment considers family, property, work or business and where the person manages their assets. Collect the actual facts: travel dates, home availability, employment, family location and management activity. A residence certificate supports a position but should correspond to those facts. Do not assume that spending fewer than 183 days in one calendar year automatically settles every domestic or treaty question. NRA: tax-residence criteria.

If two countries treat you as resident, the relevant double-tax treaty may apply a tie-breaker sequence. The exact treaty, income article and relief method must be checked for the countries involved. Bulgarian tax residents generally face taxation on worldwide income under the applicable rules, while nonresidents are assessed on relevant Bulgarian-source income. A foreign bank account does not by itself take income outside the Bulgarian analysis.

Plan the year of relocation before a major distribution, sale or retirement payment. Identify when income is legally acquired, which country can tax it, what was withheld and what evidence supports relief. ARG coordinates the facts with tax advisers in the relevant jurisdictions so returns and bank self-certifications use a coherent residence position. The objective is to claim the correct relief with evidence, not to change labels while the underlying life and business remain elsewhere.

A relocation chronology should distinguish physical arrival, availability of the family home, commencement of work and the dates of major receipts. Those events may fall in different months and need separate evidence rather than one assumed “move date”.

Which costs and practical conditions belong in the budget?

The asking price is only one part of the commitment. Prepare separate figures for the purchase price, applicable acquisition tax, notarial and registration charges, any VAT treatment, financing charges, translation, professional review and the work required before occupation or letting. Rates and tax bases must be established for the actual municipality and transaction; a general percentage quoted in an advertisement is not a completion statement.

Keep acquisition costs separate from annual ownership expenditure. A condominium may collect management charges, repair-fund contributions or approved extraordinary expenditure. A resort or managed complex may also have a separate contractual maintenance fee. Request the governing documents, recent decisions, account statements and planned works. A low advertised annual fee may exclude an expensive repair already being discussed by owners. Notaries and Notarial Practice Act.

Check building insurance and the responsibilities of the insurer, lender, condominium and individual owner. Empty-property conditions, rental use and unapproved alterations can affect cover. If you will be abroad, designate someone to receive notices and respond to urgent repairs, with a clear spending limit and route for your approval.

Finally, align the money timetable with bank review and contractual deadlines. Funds that exist in an investment portfolio may not be available on the day a deposit is due. Asset sales, currency conversion, transfer checks and loan drawdown conditions each take their own place in the sequence. ARG coordinates a transaction checklist showing the client inputs and third-party dependencies. It helps you distinguish an agreed obligation from an estimate and identify which missing document or payment prevents the next step.

Who files and pays the quarterly rental tax?

For a resident individual receiving ordinary rental income, the Bulgarian tenant's status determines the advance-tax workflow. Where the payer is a business or self-employed person within the withholding rules, that payer normally calculates, withholds and remits the tax. With a private tenant, the landlord generally handles the applicable advance tax. A property manager collecting the money does not automatically replace the person whom the tax law makes responsible.

For this ordinary regime, the NRA identifies 30 April, 31 July and 31 October as the payment and declaration deadlines for the first three quarters. The fourth quarter is treated differently: a business or self-employed payer can withhold following the landlord's written request, with the corresponding declaration and payment by 31 January. Without that election, the usual annual settlement applies rather than inventing a fourth advance instalment for the landlord. NRA: rental-income rules.

Give the accountant a quarter-by-quarter schedule of amounts actually received and tax already withheld. Show late payments in the relevant receipt period; distinguish an invoice or contractual due date from payment. If one tenant leaves and a company tenant replaces them, update the withholding responsibility from the new arrangement instead of retaining the original checklist. Keep the fourth-quarter request and proof that the payer received it.

Reserve money for the tax before remitting all available cash to the owner's foreign account. Set an internal cut-off for the manager's report early enough to query missing receipts or payer statements. A nonresident owner, company landlord, business accommodation activity or jointly owned common property may follow a different calculation and filing route. ARG coordinates the responsible adviser and property records so a deadline is attached to the correct taxpayer and income regime, not merely copied from another owner's calendar.

What should the annual rental-income file contain?

For a resident individual within the ordinary rental regime, Article 50 annual reporting brings together the year's income and advance tax. The NRA's rental guidance identifies Appendix 4 and the ordinary filing and balancing-payment deadline of 30 April of the following year. A manager's net remittance is not an adequate substitute for the underlying records: it may combine rent, reimbursed bills, retained fees and deposit movements.

Prepare the lease and amendments, receipt dates, gross rent, tenant identity and status, tax withheld by the payer and advance tax paid by the owner. Reconcile those figures with bank statements and the payer's income statements. If the payer is a business or self-employed person, obtain its required statement of income paid and tax withheld; where an additional certificate is needed, request it before the return is due. NRA: rental-income rules.

Review unusual entries separately. A refundable deposit, a payment for damage, an advance covering a later rental period and a utility reimbursement cannot all be booked as an undifferentiated monthly transfer. Nor can every actual management or repair cost simply be added to the ordinary statutory expense allowance. The adviser needs the agreement and the reason for each payment to determine the correct treatment rather than reverse-engineering it from the amount left in the account.

For co-owners, identify each person's entitlement and tax position, even if one person receives all payments administratively. Give a foreign adviser the Bulgarian calculation and proof of tax actually paid where the income also belongs in another country's return. Agree who approves the final figures, who submits the return under the necessary authority and who confirms payment. ARG organises this handover and retains the reconciliation so the next year's filing starts with reliable opening information.

How can you see the property's real income while living abroad?

A useful owner statement starts with the contractual rent, actual receipts and arrears for each tenancy. It then shows tax withheld, approved expenses, the management fee and the amount remitted to the owner. Deposits and reserve money should remain identifiable. Without this reconciliation, a high occupancy figure can hide unpaid rent, and a low transfer can conceal either legitimate repair spending or an unexplained deduction.

Keep the statutory tax calculation distinct from investment performance. Under the ordinary resident-individual rental rules, the ten-percent expense allowance is a prescribed tax adjustment. Your actual management fee, insurance and repairs still affect the investment's cash return, even where they are not separately deductible against that rental income. A report should therefore show both taxable-income information and real expenditure, without presenting the two calculations as the same result. NRA: rental-income rules.

Require supporting invoices and a description of work for each material deduction. Identify whether a payment came from rent, a deposit or an owner-funded reserve, and whether the owner approved it. Reconcile the closing cash balance with the next month's opening figure. If a manager receives money in a collection account, agree the remittance timetable and the evidence available to trace your property's receipts and liabilities.

Set practical reporting thresholds: immediate notice of serious damage or arrears, a monthly operating statement and a forecast for larger works or renewal decisions. Include vacant days, upcoming lease expiry, insurance renewal and unresolved tenant complaints. Agree how records and money will be handed over when the mandate ends. ARG coordinates an owner-readable statement and accounting file so you can approve the next decision from current information rather than a photograph, an occupancy percentage or an unexplained net payment.

Who approves repairs and what evidence should the manager provide?

The management agreement should distinguish a minor operational repair, urgent work needed to prevent further damage and an improvement that changes the property. Set an ordinary spending limit and an emergency notification procedure. A leaking pipe cannot always wait for an owner in another time zone, but urgency should not become an unlimited authority to commission a renovation or use a related contractor without disclosure.

Some work goes beyond maintenance and can raise planning, construction or condominium issues. The Spatial Development Act distinguishes the legal permissions for construction and use. Before altering internal arrangements, enclosing a terrace or converting the premises for another activity, establish the required approvals with the relevant technical and legal professionals. A manager's assurance that other owners have done the same work is not a permission for your apartment. Spatial Development Act.

Ask for the defect report, photographs, quotations proportionate to the job, the chosen contractor's details, invoice and completion confirmation. Agree who checks workmanship and pursues defects. Separate the tenant's alleged responsibility from the owner's immediate need to make the premises safe: charging the tenant later requires an evidential and contractual basis, not simply the fact that damage occurred during their occupation.

For building-wide expenditure, obtain the condominium decision, allocation and payment notice rather than relying on an informal message. Match insurance notifications and any claim to the actual event and policy conditions. The owner's report should show approved cost, paid amount and outstanding work. ARG coordinates the administration so an owner abroad can authorise necessary expenditure, retain an audit trail and distinguish a completed repair from a deposit paid to a contractor who has not yet finished.

What happens if the tenant stops paying or will not leave?

A practical arrears procedure starts with a verified ledger. Establish which rent, utility charge or other amount is due, when it became due and what has already been paid or disputed. Preserve the lease, amendments, payment records and communications. An owner abroad needs prompt notice of the first missed payment, not a report several months later when the deposit no longer covers the exposure.

The signed lease and the legally effective notices determine the next steps; a message sent to an outdated address may not achieve the intended result. A sale of the property also requires examination of the lease's effect against the purchaser, including any relevant registration and documentary formalities. Before promising vacant possession to a buyer, establish the existing tenant's legal position and a realistic route to handover. Bulgarian Registration Rules.

Set authority limits for concessions. The manager may be allowed to send a reminder but should need the owner's approval to waive rent, reschedule a debt, settle damage or sign a termination agreement. Record any repayment plan in a form that identifies the debt, dates and consequences of default. If possession or liability is contested, the legal partner assesses the appropriate notice and enforcement procedure; a management mandate alone does not resolve the dispute.

At the end of the tenancy, prepare a joint inspection where possible, final meter readings, a key record and a reasoned deposit reconciliation. Separate normal wear from claimed damage and retain evidence for every deduction. Do not treat a lock change or interruption of utilities as an ordinary collection technique. ARG coordinates the documentary handover between manager, owner and lawyer, preserving the claim while making the property's actual availability clear for the next tenant or sale.

Which owners and letting models need a different tax calculation?

The ordinary resident-individual rental calculation cannot be carried across to every owner. A nonresident receiving Bulgarian-source rent falls within the relevant final-tax rules unless a different applicable provision or relief changes the result. The gross basis, payer's obligations and available EU/EEA recalculation need to be assessed separately. Give the adviser your actual tax residence, ownership documents and the payer's details before the first distribution of rent.

For a company landlord, rent enters the company's accounting and corporate-tax calculation, with a different treatment of real expenses, financing and depreciation. Personal use of company accommodation creates further questions. A platform booking business or repeated provision of accommodation services also requires classification of the activity rather than an assumption that every receipt is ordinary passive rent. Tourism, guest reporting, local charges and VAT obligations should be assigned to the relevant operator before bookings begin. NRA: final tax.

Distinguish a private apartment inside a condominium from income earned by the condominium from common property. The NRA's exception to the ordinary expense allowance for specified condominium income does not mean that every owner of an apartment in a shared building loses the allowance. The identity of the recipient, ownership of the rented space and applicable management arrangement are essential facts.

Personal circumstances can also change advance tax or relief. Where reduced working capacity is relevant, obtain the current qualifying TELK or NELK decision and give the required evidence to the payer. These are Bulgarian medical assessment decisions, not a general overseas disability label. ARG coordinates the factual classification and documents with the accountant so eligibility for relief, the responsible payer and the appropriate return are determined before an ordinary rental template is applied.

What should be handed over when you appoint or replace a manager?

Before appointing a manager, agree the service list in concrete terms: tenant enquiries, viewings, lease administration, payment reminders, repairs, inspections, owner reporting and the accounting handover. Identify which services require a separate professional appointment. A promise to handle everything does not establish whether anyone has accepted responsibility for filing the owner's tax return, representing the owner in a dispute or commissioning major building work.

Where the manager operates through a Bulgarian company, check the company identity and registered representation through the Commercial Register. The contract should name the party responsible for the service and the person entitled to bind it. Verify the payment instructions independently when they change. A trading name, a staff member's personal bank details and a registered company are not interchangeable recipients of the owner's money. Registry Agency: company registration.

Define authority, fee calculation, expenses, conflicts and termination. Specify whether the manager may grant rent reductions, renew a lease, use a related contractor or receive and return deposits. Establish how the owner approves exceptions while abroad. If a power of attorney is needed, tailor it to the agreed administrative acts and coordinate any special formalities with the lawyer; property management should not silently include an authority to sell or mortgage the apartment.

At handover, reconcile keys, access codes, tenant contacts, original agreements, deposits, rent arrears, bills, contractor warranties and open disputes. Obtain the last accounting statement and make clear who will collect the next payment. Inform tenants and relevant providers of the new authorised contact and payment details through a controlled process. ARG coordinates this transition so the owner retains continuity of income, tax records and practical access to the property when the management relationship changes.
