Ending a lease does not automatically recover the apartment, and a deposit does not automatically pay the last rent. ARG helps landlords and tenants identify the valid claim, notice and evidence.

Clients often ask ARG whether two unpaid months justify changing the locks, or whether unresolved repairs allow a tenant to stop paying altogether. These situations require separate answers about the lease, the money owed and the return of the property. A clear assessment can prevent an existing rental dispute from becoming a second conflict over access or belongings.
Rent, utilities, damage and the deposit have different legal bases. A clear account connects every amount with its period, supporting documents and payments already received.
Repair, rent reduction, compensation and termination require their own conditions. A defect does not automatically justify withholding every payment.
A notice and a handover perform different functions. Preserve delivery evidence, keys, meter readings and the record of when control was returned.
A dispute over overdue rent does not authorise unrestricted entry or a lockout. The appropriate claim and enforcement route depend on the contractual facts.
A Bulgarian lease creates a contractual entitlement to temporary use in return for a price under Article 228 of the Obligations and Contracts Act (Закон за задълженията и договорите, ЗЗД). For comparison, England and Wales also recognise statutory landlord repair duties in qualifying residential leases under section 11 of the Landlord and Tenant Act 1985, although its scope and remedies differ from the Bulgarian rules. The useful starting point in Bulgaria is the actual bargain. The condition promised for an ordinary apartment differs from the condition agreed for premises rented expressly for renovation or a particular business activity.
The landlord supplies the agreed use of the premises, and the tenant must use them properly, report relevant problems and return them when the relationship ends. These obligations explain why the same disagreement can produce different claims. A leaking roof may support a repair demand, while unpaid rent requires its own calculation. Neither party’s alleged breach automatically proves every claim made by the other.
The tenant must pay the agreed rent and expenses connected with use under Article 232, paragraph 2 of ЗЗД. Identifying the agreed amount is sometimes harder than reading the first page of the contract. An annex may alter the price, an introductory discount may expire, or the parties may disagree whether a transfer covered rent, utilities or the deposit. The account should therefore be reconstructed transaction by transaction, using the contract, subsequent agreements, payment references and receipts. A total written in a demand letter is an assertion, not a substitute for that reconstruction.
Advance rent pays for a defined period of use. A security deposit secures the obligations specified in the agreement and is accounted for when the contractual conditions arise. The tenant cannot assume that the last month is already paid simply because the landlord holds an equal deposit. Equally, the landlord cannot treat the deposit as an automatic departure fee when the contract contains no such valid obligation.
Set-off also requires legal attention. Mutual monetary obligations do not cancel simply because each party says the other owes money. The statutory mechanism in Article 103 of ЗЗД concerns reciprocal obligations of the relevant kind and requires the active claim to be due and liquid. A disputed estimate for future repairs is not necessarily in the same position as an acknowledged repayment already due. Where the conditions for unilateral set-off are contested, a negotiated accounting agreement may resolve the position more securely. The document should make clear which claims are being settled and which remain open.
Non-payment can justify contractual remedies, but the first missed transfer does not automatically end every lease. The due date, amount, termination clause, seriousness of non-performance and legally required opportunity to perform all matter. A termination notice must express the intended legal consequence rather than merely complain that payment is late.
Termination for culpable non-performance requires a different analysis. The creditor generally gives an appropriate period for performance with a warning that the contract will be treated as terminated after that period expires, as Article 87, paragraph 1 of ЗЗД requires. The warning must be written if the contract was written. An additional period is unnecessary where performance has become wholly or partly impossible, delay has made it useless to the creditor, or performance necessarily had to occur at the agreed time, as paragraph 2 provides, while paragraph 4 excludes termination for an insignificant unperformed part in light of the creditor's interest. The practical task is to fit the notice to the facts rather than declare every late payment an immediate end to the lease.
Older arrears require separate limitation analysis. Rent claims fall within the three-year period in Article 111, letter c of ЗЗД, while the due date matters under Article 114. The Supreme Court of Cassation's Interpretative Decision No. 3 of 18 May 2012 in interpretative case No. 3/2011, delivered by the General Assembly of the Civil and Commercial Chambers, explains the characteristics of periodic payments. Repeated obligations can qualify even when their amounts or intervals differ, provided the necessary common basis and advance determinability exist. A varying rent schedule therefore does not automatically remove the claim from the shorter regime.
The route to termination depends first on whether the lease is for a fixed period, indefinite or subject to a valid contractual termination provision. A notice that would be relevant to one arrangement may be ineffective for another. For an indefinite lease, Article 238 of ЗЗД provides a one-month notice rule for the ordinary situation addressed here. That rule should not be copied automatically into a fixed-term contract as an unrestricted right to leave early. The complete agreement, later extensions and the reason for ending the relationship must be read together.
A deduction must correspond to an established obligation covered by the deposit. The amount retained should be traceable to rent, utilities or particular damage, with the remaining balance separately identified. A newly purchased replacement does not by itself prove that the tenant caused a loss equal to its full price. The item’s original condition and the reason replacement was necessary remain relevant.
The distinction between ordinary use and compensable damage is especially important. A landlord seeking replacement cost for a damaged appliance should establish its earlier condition, the relevant damage and a reasonable measure of loss. A photograph of a new appliance purchased after departure does not itself prove that the tenant caused the previous appliance to fail. The tenant owes compensation for damage during use under Article 233, paragraph 1 of ЗЗД unless the tenant proves a cause for which they are not responsible, and the provision also addresses household members and subtenants. Its presumption of receipt in good condition makes the initial inventory particularly valuable.
The accounts should recognise amounts already recovered. If the deposit is validly applied to a particular rent instalment, the landlord cannot continue claiming that instalment as though no application occurred. A proposed settlement should state the starting deposit, each accepted deduction, any disputed reserve and the amount to be repaid. Final utility invoices deserve separate treatment because they may arrive after physical handover. A limited, explained reserve with a reconciliation mechanism is easier to assess than an indefinite refusal to account for any part of the deposit.
Ending the contractual right of use and physically recovering the apartment are separate steps. A landlord who has effectively terminated may demand return, but a disputed notice does not authorise immediate private eviction. Conversely, a tenant’s claim for reimbursement does not automatically entitle the tenant to remain until every monetary disagreement has been resolved.
Recovering money and recovering the apartment are separate procedural objectives. Claims to vacate rented premises are included in the expedited procedure by Article 310, paragraph 1, item 2 of the Civil Procedure Code (Граждански процесуален кодекс, ГПК). The claimant must prepare evidence of the contract, the event ending it and non-return. The procedure does not eliminate the need for proper service or establish that a disputed termination was effective. A claim for arrears may require a different procedural route or separate treatment. Selecting the route should reflect the relief actually needed, the available documents and the likely points of opposition. A related procedural regime is the possession-claim procedure under Part 55 of the Civil Procedure Rules in England and Wales. Its conditions and timetable do not replace the Bulgarian expedited procedure.
The tenant should understand the limits of the expedited possession dispute. Objections about ownership or improvements are excluded in claims to vacate rented or borrowed premises under Article 314, paragraph 3 of ГПК. A belief that expensive works were done does not therefore guarantee continued occupation until their value is settled in that proceeding. This procedural restriction should not be described as automatic loss of every possible claim for reimbursement. The merits and appropriate procedure for any separate monetary claim must be examined independently, including its evidential basis and limitation position.
Continued occupation must be evaluated together with the landlord’s response. Silence, an express objection and an agreed temporary extension can have different consequences. The parties should also distinguish rent for an ongoing lease from compensation for use after the relationship has ended. The description attached to a bank transfer cannot alone decide that classification.
Continued occupation after expiry has two possible directions. Where use continues with the landlord's knowledge and without opposition, the lease is treated as extended indefinitely under Article 236, paragraph 1 of ЗЗД. Where the tenant remains despite opposition, paragraph 2 instead provides for compensation and continuing performance of obligations arising from the ended lease. These consequences make the landlord's response and subsequent correspondence important. Accepting money, discussing an extension or arranging a handover must be documented accurately so that the parties can explain what the payment or conversation meant in its context.
The evidence of opposition needs to be evaluated in context. A landlord may send a clear demand for return but subsequently discuss an extension. A tenant may transfer money described as rent while the landlord treats it as compensation. Neither the label on one transfer nor one isolated sentence should replace examination of the entire course of dealings. Advice should identify the effective termination ground, the communications received and the significance of subsequent conduct. If the parties agree to a temporary stay while arranging departure, they should record its terms expressly.

Repair responsibility turns on the agreed condition, the cause of the defect and the distinction between ordinary minor repairs and other necessary work. A signed inventory and contemporaneous reports help establish those facts. A tenant who replaces an old appliance with a substantially more expensive model still needs a basis for charging the whole new price to the landlord.
The initial condition is assessed against Article 230 of the Obligations and Contracts Act (Закон за задълженията и договорите, ЗЗД). Its first paragraph addresses suitability for the agreed use, while the second allows repair, a proportionate rent reduction or rescission where delivery was defective, together with a damages claim in each case. The third limits responsibility for defects known or discoverable with ordinary care, while preserving the express health-related exception. A tenant who accepted unfinished premises in exchange for a particular arrangement cannot simply ignore that bargain. Equally, an apparently cosmetic defect may conceal a serious problem that ordinary inspection would not have revealed. Evidence must show what was actually agreed and discoverable. The closest limited comparison is the repair duty in qualifying residential leases under section 11 of the Landlord and Tenant Act 1985 in England and Wales; Bulgarian rules determine this tenancy.
During the tenancy, minor repairs due to ordinary use fall within Article 231, paragraph 1 of ЗЗД. Other repairs not attributable to the tenant's culpable conduct are addressed by paragraph 2. If the landlord fails to carry out repairs for which the landlord is responsible, the tenant can use the remedies in Article 230, paragraph 2. Damages additionally require a cause for which the landlord answers. A tenant who performs the repair with proper care may set its value off against rent. A tenant should retain the original complaint, the proposed access dates, the response and the invoice. The reasonableness of the work matters, because a necessary repair does not automatically justify a more expensive improvement chosen for personal preference.
The condition of the premises should be documented before cleaning, repair or replacement removes the disputed features. Photographs should show both the wider room and the particular defect, with a reliable date and enough context to identify the location. A short video may help explain access or the operation of an appliance, but it should not substitute for a written inventory. The legal relevance comes from connecting the condition to the agreed use and the obligations under Articles 230, 231 and 233 of ЗЗД, not from producing the largest possible collection of images.
An unpaid electricity bill should be linked to the relevant meter, consumption period and contractual responsibility. A photograph of the closing reading can separate the tenant’s consumption from later use. For damage, the essential comparison is between the proved initial condition and the condition at return, with a reasoned explanation of the work required to restore it.
Payment evidence needs to show more than money leaving an account. A bank transfer should be linked to the recipient, reference, amount and obligation it was intended to discharge. Cash payments should be supported by receipts or other reliable evidence. If a property manager collected money, the manager's authority and the landlord's subsequent acknowledgements may matter. A deposit should appear separately in the account. Recording it as ordinary rent from the outset can create a false picture of arrears and make the final reconciliation harder for both parties to understand.
The strongest preparation connects each alleged loss to an event and an item of evidence. For water damage, that may mean the first report, photographs before intervention, a technical explanation, reasonable emergency expenditure and the final condition. For furniture damage, it may mean the initial inventory, age and condition, later photographs and an appropriate repair estimate. This approach gives both parties a realistic view of the claim. It can also reveal that litigation over a large replacement bill would be disproportionate when the provable damage is narrower and a documented financial adjustment would resolve it.
An owner abroad can act through a properly authorised representative. The authority should cover the intended notice and, separately where needed, receipt of keys, agreement on deductions or settlement. A property manager’s practical involvement does not automatically establish authority to waive a claim or change the lease. The tenant should be able to identify who can validly accept performance.
If voluntary return fails, the landlord needs the appropriate enforceable basis and lawful enforcement. The evidence must establish the lease, its effective ending and the continuing failure to return. A money judgment for arrears does not itself order the occupant to leave. The requested relief should therefore match the result the owner actually needs.
Claims to vacate rented premises are governed by the expedited route in Article 310, paragraph 1, item 2 of the Civil Procedure Code (Граждански процесуален кодекс, ГПК). The claimant should be ready to prove the contractual relationship, its effective ending and the failure to return. The defendant should address the facts and legal basis relevant to that claim, rather than assume that an unrelated grievance answers it. The restriction on ownership and improvement objections in Article 314, paragraph 3 of ГПК is particularly important. It may require separate advice on an improvement claim while the occupation dispute proceeds on its own basis. A related procedural regime is the possession-claim procedure under Part 55 of the Civil Procedure Rules in England and Wales. Its conditions and timetable do not replace the Bulgarian expedited procedure.
The general allocation of proof requires each party to establish the facts supporting its claims or objections under Article 154, paragraph 1 of ГПК, subject to applicable presumptions and specific rules. A tenant relying on payment should provide the evidence of payment. A party relying on a notice should preserve its content and delivery. If the technical cause of damage is disputed, a properly framed expert request may be necessary. Missing a procedural opportunity to submit evidence can be more damaging than having a relatively modest claim, so court documents should be reviewed promptly on receipt.
Changing locks while the tenant still occupies the property can create a fresh dispute about access, belongings and resulting loss. The existence of arrears does not confer an unrestricted power to remove possessions or interrupt utilities as pressure. The lawful response is a properly grounded demand followed, where necessary, by the applicable proceedings and enforcement.
An empty apartment is not necessarily a returned apartment if keys and control remain with the tenant. Equally, acceptance of keys need not mean acceptance of every disputed deduction. The parties can record return and reserve identified financial claims. This separates the owner’s ability to use the property again from the remaining account between the parties.
If one participant does not attend, preserve the invitation, response and circumstances of the attempted handover. Advice is needed on an appropriate further offer of performance and any available legal steps. Leaving keys with an unauthorised neighbour or abandoning them inside the property may not resolve the obligation. A landlord should also consider the consequences of refusing a reasonable handover merely because a damage amount remains disputed. The aim is to establish who offered what, when and on what conditions, so that further liability can be assessed on evidence rather than competing recollections.
The procedure depends on whether the client seeks payment, return of the premises or repayment of security. These objectives should be distinguished before filing, because their evidence and procedural treatment differ. ARG can arrange assessment and representation through appropriately authorised Bulgarian attorneys, including the effect of a foreign address on service and the practical recovery of an awarded sum.
Time limits require attention before negotiations become prolonged. Rent claims are subject to the three-year limitation rule in Article 111, letter c of ЗЗД, with commencement examined under Article 114. The Supreme Court of Cassation, General Assembly of the Civil and Commercial Chambers, explains periodic obligations in Interpretative Decision No. 3 of 18 May 2012 in case No. 3/2011. Its reasoning recognises recurring obligations with a common source, predetermined due intervals and amounts determined or determinable beforehand, without requiring identical sums. The practical consequence is to assess each instalment's position instead of treating the debt as one undated total.
A deposit claim or a particular compensation claim should not be assigned the same limitation rule merely by association. The legal basis and due date must be identified separately, and any relevant interruption, suspension or defence considered. A demand letter is not a universal solution to limitation risk. If a deadline may be approaching, the client needs advice on the procedural step that actually protects the claim in the circumstances. Settlement discussions can continue alongside an appropriate legal strategy, but the client should understand which protections have and have not been obtained.
Before leaving Bulgaria, the parties should agree who will attend the handover, who has authority to sign and where future notices will be sent. Documents signed abroad may require a suitable translation and authentication depending on their source and purpose. A power of attorney for litigation should not be confused with authority to settle every substantive claim.
A deposit disagreement should not make the factual handover impossible. The record can list keys, meter readings, remaining belongings and specific reservations without declaring that all accounts are settled. If a later utility invoice is expected, identify the period, supporting evidence and method of accounting. That is more useful than a general statement allowing the landlord to retain the entire deposit indefinitely.
The handover appointment should have its own written arrangements. Identify the premises, the date and time, who will attend, what keys or access devices will be transferred and how meter readings will be recorded. The tenant's return obligation arises under Article 233, paragraph 1 of ЗЗД. A move abroad does not by itself establish that the premises were returned. If a representative will attend, the authority should cover the intended acts. Authority to collect a key may not be authority to acknowledge a debt or waive a disputed claim.
