Car Insurance Denial and Reduced Payout Disputes in Bulgaria

A missing document or alleged security breach does not automatically justify a casco refusal. ARG helps separate coverage from valuation and determine whether the insurer has proved the grounds for its reduction.

Car Insurance Disputes

Clients often ask ARG whether a casco insurer can reduce a theft payment because a registration document was left in the vehicle, or reject collision damage as pre-existing. The answer depends on different evidence and legal rules, even when both refusal letters rely on a breach of the policy.

ARG can assist in the following situations.

  • A theft or collision claim is refused because of an alleged security obligation.
  • Late notice is treated as an automatic loss of all coverage.
  • The insurer attributes new damage to an earlier accident or ordinary wear.
  • A repair estimate or vehicle value produces a disputed total-loss calculation.
  • An incident abroad raises territorial restrictions, foreign repair bills or payment difficulties.

(001)
Casco protects a defined vehicle interest

The owner, policyholder and beneficiary may differ, particularly where a vehicle is leased or financed.

(002)
A clause’s function matters

A contractual duty cannot be treated as a genuine exclusion solely because of the heading under which it appears.

(003)
Causation must match the refusal

An alleged security or maintenance failure requires analysis of its connection with the particular insured event.

(004)
Value and payment require separate review

Repair costs, total loss, residual value and the finance balance involve different questions.

What does Bulgarian comprehensive motor insurance cover?

How does casco protection differ from third-party liability insurance?

Casco protects an insured financial interest in the vehicle against the risks actually agreed. Compulsory motor third-party liability insurance addresses the insured person's liability to others, so a driver's own liability policy does not ordinarily pay for that driver's damaged car. The Bulgarian Insurance Code (Кодекс за застраховането, КЗ) requires the contractual risks and exclusions to be identified under Article 345, while Article 394 links payment to the insured event and policy terms. The FCA's prompt and fair claims-handling rule in ICOBS 8.1.1R is a limited England and Wales comparison. It does not supply the Bulgarian scope of cover.

A collision caused by another motorist may support a casco claim and a separate liability route, but the same damage cannot be recovered twice. After paying, the property insurer's recovery rights arise under Article 410 КЗ. The owner's remaining uncompensated loss needs its own assessment. The insured person, driver, policyholder and payment beneficiary may also differ. A person who arranged insurance on another's property must consider the owner's approval under Article 402. A lease or creditor endorsement can affect the recipient, so possession of the keys or payment of the premium does not alone establish a personal right to the entire indemnity.

Why do limits and optional insured risks matter?

A product called comprehensive may still contain selected risks and exclusions. Theft, vandalism, glass damage, flood, parking damage and assistance may have different conditions or separate limits. Read the schedule, incorporated general conditions and endorsements together. Individually agreed terms prevail over conflicting general conditions under Article 348(1) КЗ. A version downloaded after the incident may not be the version accepted when the policy was concluded. Establish the insured registration details, period, territory, use and additional equipment before assuming that a familiar product name settles the dispute.

The insured sum generally caps the obligation rather than guaranteeing payment of that whole sum for a minor loss. Actual damage is the starting point under Article 386 КЗ, subject to the applicable valuation rules. Optional benefits such as replacement transport, recovery or loss of use should be identified separately instead of added automatically to the repair bill. Previous damage can affect the factual repair scope, and earlier claims may affect remaining cover under Article 407, subject to its qualifications. A refusal should therefore be examined by benefit and item. Rejection of an optional expense does not necessarily defeat the covered physical damage to the vehicle.

When can breach of a policy obligation justify refusal?

A breach-based refusal is different from proof that a risk was never covered. The relevant duty must be provided by law or contract, significant for the insurer's interest and causally connected to the event under Article 408(1)(3) КЗ. The preventive-duty regime in Article 395(4) additionally distinguishes an expressly agreed refusal ground from a reduction corresponding to the breach's seriousness. A missed administrative step cannot automatically be treated as satisfying every element. Establish what the driver or insured person was obliged to do, whether that obligation was breached and how it affected the particular incident.

In Decision No 604 of 22 October 2024, civil case No 1679/2023, the Supreme Court of Cassation's Fourth Civil Division examined a fifty-percent casco reduction because a registration document was left in a stolen vehicle. The insurer had to prove the causal and proportional basis under the current Article 395(4) and (5) КЗ rather than impose an automatic contractual percentage or shift the burden. Earlier practice under the repealed code did not resolve the current rule. The judgment does not declare every security condition invalid. It explains why a real causal analysis is necessary when the insurer uses a breached preventive obligation to reduce an otherwise covered claim.

How does late notice differ from failure to prove the insured event?

What must the insurer establish when relying on an exclusion?

The insured must establish facts supporting the covered event and loss, while an insurer invoking a defence must establish its supporting facts under the applicable allocation of proof. An exclusion should be identified in the terms actually incorporated into the policy and matched to the incident. A mechanical defect, a collision following a defect and an unrelated old scratch are not interchangeable explanations. The claim should separate cause from consequence. An insurer's assertion that damage is inconsistent with the account may call for technical reconstruction; merely repeating the claimant's description will not resolve a genuine physical inconsistency.

Late notice has its own statutory test. The default is seven working days from learning of the event under Article 403(1) КЗ, unless another appropriate contractual period applies. The contractual minimum is three working days, with a twenty-four-hour minimum for theft or robbery under paragraph 2. Refusal under paragraph 4 requires the specified obstructive purpose or that the failure made establishing the circumstances impossible. Prior insurer knowledge matters under paragraph 5. Thus lateness is not automatically absence of coverage. Preserve when the event was discovered, how notice was given and what independent evidence remained available despite the delay.

How do total loss, repairs and market value produce different calculations?

A vehicle can be repairable technically yet qualify as a statutory total loss. Necessary repair expenditure must exceed seventy percent of actual value under Article 390(2) КЗ. The provision distinguishes a repairer's pro forma invoice for restoration in kind from expert assessment for monetary compensation. If actual value is 20,000 and necessary repair is 15,000, the assumed ratio is seventy-five percent. That classification does not mean the insurer simply pays the repair quotation or the policy limit. The indemnity still requires the proper value, covered loss, limit and justified treatment of remaining property.

For a Bulgarian-registered vehicle, Article 390(1) КЗ requires the relevant registration-termination certificate noting total loss before payment of compensation determined on that basis. This should not be presented as an identical Bulgarian registration requirement for every foreign-registered car. A dispute may concern both sides of the ratio, not only the repair estimate. Comparable vehicles should match age, model, mileage, equipment and pre-event condition. An unusually cheap listing without those features is weak evidence of value. Retained salvage and any proposed deduction should be separately explained rather than hidden inside an unexplained final figure.

When can depreciation or an excess legitimately reduce payment?

Actual and reinstatement values are distinct under Article 400 КЗ. Actual value concerns equivalent property of the same kind and quality; reinstatement value concerns new equivalent property and inherent replacement expenses without depreciation. The default follows actual value unless otherwise agreed. A valid agreed fixed value under Article 387 is another arrangement. The insurer should identify the contractual valuation basis before applying age-related deductions. A cash assessment and an agreed repair in kind under Article 406 also involve different performance mechanisms. The owner should know which method was selected and whether the necessary repair scope is accepted.

An agreed excess is separate from underinsurance or a sanction for misconduct. The default is full covered damage up to the insured sum, outside the agreed-value exception, under Article 389(1) КЗ. Proportional compensation requires agreement under paragraph 2. For example, value of 30,000, a sum insured of 15,000 and damage of 6,000 produce 6,000 under the default before other valid adjustments, or 3,000 if an applicable proportional clause governs. The calculation should display each step. Combining depreciation, proportional reduction and an excess without identifying their respective bases can conceal an unjustified reduction, but the mere existence of several deductions does not prove that all are unlawful.

How does an offer differ from a final discharge of the casco claim?

Which photographs, service records and incident documents support coverage?

An offer states what the insurer is prepared to pay; a signed final settlement may resolve the remaining dispute as well. Before accepting, identify whether the document records a partial payment or releases the whole claim, including additional damage discovered during repair. Evidence should support the particular event and each damaged component. The Bulgarian Insurance Code (Кодекс за застраховането, КЗ) requires access for inspection and directly relevant documents under Article 395(7). The FCA's prompt and fair handling rule in ICOBS 8.1.1R provides a limited England and Wales comparison, while the Bulgarian policy and statute determine the claim.

Photograph the vehicle's overall position and detailed damage before dismantling, retaining original files where possible. Police or incident records establish recorded circumstances, while service history, inspection photographs and repair invoices help distinguish condition before and after the event. A police report is not automatically a valuation of every repair. A contractor's estimate should show parts, labour and technical necessity. Preserve communications about permission to move or repair the car, particularly if the insurer's preferred workshop cannot inspect promptly. Safe steps to limit further damage under Article 395(6) should be documented, rather than leaving the vehicle exposed solely to preserve its original position.

What should be done when the insurer alleges pre-existing damage?

Ask which specific component was already damaged and what evidence supports that conclusion. Pre-policy inspection photographs may show an old bumper scratch while a later collision caused structural damage behind it. Those losses should not be merged simply because they occupy the same area. Compare dated service records, earlier repairs, photographs and the current inspection. If an old defect affected the necessary work, an expert should explain the overlap and the additional damage caused by the insured event. The objective is to isolate the covered change in condition, not to claim renovation of the whole vehicle.

An allegation that the account is technically impossible needs a different response from an allegation of ordinary wear. Request the reasoning, measurements or impact assumptions and test them against the scene and damage pattern. Agreeing that one scratch predates the event need not concede that every repair item does. Before signing a final release, consider whether dismantling is likely to reveal additional damage and whether the agreement preserves that issue. If payment is offered only in exchange for full settlement, a separate unilateral reservation may not change the bargain. The actual accepted wording and payment should be preserved together.

When is a second technical assessment worth obtaining?

Can the insurer rely on a missing key or security device?

A missing key can raise several different questions. It may affect proof of how theft occurred, indicate breach of a security obligation or concern the evidence requested after the loss. Those are not automatically the same defence. Identify what the policy required, which keys or devices existed, what was delivered at inception and what happened to them. Service records of key replacement, alarm installation and faults can clarify the chronology. Do not assume that presenting one fewer key proves the mechanism of the theft or that a working alarm automatically answers every other coverage condition.

Supreme Court of Cassation Decision No 604 of 22 October 2024, civil case No 1679/2023, Fourth Civil Division, concerned a registration document left in a stolen vehicle, not a missing-key dispute. Its relevant reasoning requires proof of causal and proportional grounds for a preventive-duty reduction under Article 395(4) and (5) КЗ. It cannot establish the facts of a different theft. A technical expert may help determine whether the alleged security failure could explain the actual event, leaving legal classification to the court. Reimbursement of privately commissioned cause or valuation expenses under Article 397(1) requires prior insurer approval on that statutory basis. Discuss cost and scope before commissioning an extensive report.

How does an incident abroad affect territorial cover?

The place of the incident must fall within the casco policy's territorial scope for the relevant benefit. A certificate concerning compulsory motor liability does not by itself extend voluntary own-damage cover. Check any country-specific exclusion, endorsement, theft restriction and condition governing repairs abroad. Cover for a collision may differ from assistance or transport home. Foreign travel does not automatically cancel a Bulgarian policy, but a broad reference to Europe should be read in its contractual context rather than assumed to include every destination and every optional risk.

Foreign police records, towing documents, workshop findings and travel dates can establish location, timing and mechanism. Obtain detailed invoices and photographs before the vehicle is moved or repaired. If immediate recovery was necessary, record why delay would have increased damage and seek the insurer's instructions where feasible. Reasonable mitigation expenses are treated separately under Article 396 КЗ, while optional repatriation or replacement-car benefits depend on their own terms. An expensive transport invoice should therefore be linked to the relevant legal or contractual basis. Preserve the original currency and agreed conversion method instead of merging all foreign costs into one unsupported total.

How can an owner abroad pursue a refused or reduced Bulgarian casco payment?

Which complaint or court can provide the required remedy?

A written claim with accurate payment-account details under Article 380(1) КЗ should identify the event and amount, with proof of receipt. Ordinary casco claims follow Article 108(1), requiring payment or a reasoned refusal within fifteen working days after all necessary evidence. The incomplete-file maximum under paragraph 2 is six months from the claim. Motor vehicle insurance receives the specific treatment in Article 109, item 1, so the fact that the policyholder operates a business does not automatically create a large-risk exception. The three-month motor liability procedure should not be imported merely because both policies concern a car.

For disagreement over the amount, Article 108(6) КЗ requires a written factual and legal explanation within seven days of the complaint. The Financial Supervision Commission can examine compliance, but the competent civil court decides an unresolved contractual payment claim. A technical assessor cannot compel payment. Identify the contracting insurer and person entitled to sue, especially where the car is leased or insured for a creditor. ARG can coordinate evidence and representation through authorised Bulgarian lawyers. Claim preparation should distinguish the unpaid principal, justified interest under Article 409 and sums already paid, while accounting for the payment-details qualification in Article 380(3).

Which foreign documents and deadlines matter before litigation?

A foreign owner may need ownership, corporate authority or representation documents together with translated incident and repair records. The Civil Procedure Code (Граждански процесуален кодекс, ГПК) governs proof in Bulgarian proceedings. Civil Procedure Rules Part 32 provides a limited England and Wales evidence comparison. The factual burden follows Article 154(1) ГПК, while expert assistance under Article 195 addresses specialised questions. The court evaluates that opinion with the other evidence under Article 202. Foreign-language documents require an accurate Bulgarian translation under Article 185. Authentication and authority to settle must be checked for the particular document and issuing country.

Ordinary casco indemnity has the three-year limitation period from the event under Article 378(1) КЗ. Claim submission suspends the period under paragraph 9 until receipt of the decision or expiry of the applicable statutory maximum, whichever occurs earlier. Repeated requests for reconsideration do not keep time suspended indefinitely. Preserve actual delivery evidence and calculate the remaining period while negotiating. If the insurer or enforceable assets are abroad, jurisdiction and recognition of a judgment require their own assessment. The vehicle's presence in Bulgaria does not alone settle those questions. A useful strategy connects the available evidence, the correct defendant and the court's ability to produce an enforceable result.

Questions and answers

01 / 06

Does casco depend on proving another driver was at fault?

Not in the same way as a direct liability insurance claim. Entitlement depends on the agreed casco risks and the facts of the event, although another person’s responsibility may matter for later recovery.

Can a missing key automatically defeat a theft claim?

The policy, applicable statutory rules and factual circumstances must be examined. The significance of the missing key and its connection with the alleged event cannot be replaced by an automatic assumption.

Should the vehicle be dismantled before inspection?

Where practicable, preserve its condition and give an inspection opportunity before major work. If dismantling is necessary, record why and preserve evidence of the findings and components.

Will a total loss payment clear my vehicle finance?

That depends on the indemnity, financing terms and recipient arrangements. The remaining debt and insurance payment should be calculated separately before a final agreement is accepted.
