Emergency treatment, planned care and repatriation may fall under different policy benefits. ARG helps determine which expenses are covered and what to do when the hospital seeks payment before the insurer decides.

Can a hospital demand payment when the assistance centre said the treatment would be covered? Clients ask ARG this when an emergency admission in Bulgaria turns into a dispute about medical necessity, an earlier illness or an approval that the hospital says it never received.
ARG can assist in the following situations.
Identify whether the contract promises services, reimbursement or a fixed benefit.
Clinical necessity, policy eligibility and the payment obligation are separate questions.
Exclusions and alleged non-disclosure must be tested on their own terms.
Confirm the insurer’s identity and the assistance company’s authority before pursuing payment.
Travel assistance and medical insurance are related but distinct promises. Immediate assistance following an accidental difficulty during travel is defined by Article 426 of the Bulgarian Insurance Code (Кодекс за застраховането, КЗ), with the events and conditions determined by the contract. Medical insurance under Article 427 can reimburse defined health expenses, provide an agreed fixed sum or combine those benefits. A limited England and Wales comparison is the Financial Conduct Authority's prompt and fair claims-handling framework in ICOBS 8.1.1R. It does not determine the scope of a Bulgarian policy. The insured benefit must first be identified from the actual agreement.
A policy covering unexpected emergency care does not necessarily pay for a procedure arranged before departure. Conversely, treatment is not automatically elective simply because a known condition existed before the trip. The wording may distinguish an acute deterioration, routine monitoring and a planned intervention. Medical records should establish why care was needed at that time and whether postponement was realistically possible, while the contract supplies the coverage test. The insurer should identify the exclusion or eligibility condition actually relied on. A general description such as non-emergency care is not a substitute for explaining how the recorded symptoms and treatment fall within that condition.
The traveller must fall within the insured category for the relevant dates and destination. Check names, age conditions, residence definitions, maximum trip duration and any excluded activities. An annual policy can cover several journeys without permitting an unlimited continuous stay. A medical event in Bulgaria also does not prove that a policy issued abroad covers Bulgaria or applies after a change of residence. Travel dates, bookings and border records may resolve a duration dispute, while the application and certificate identify the insured person. A relative paying the bill is not necessarily the person entitled to the insurance benefit.
Group coverage requires particular attention to membership and the benefit claimed. An employer or bank may arrange a package containing medical, accident and assistance components with different conditions. The group life rules in Article 441 КЗ are expressly extended to accident insurance by Article 459(4), but Article 428(2) for medical insurance refers to Article 454, not to every life-insurance rule. It would therefore be wrong to apply all group life provisions automatically to a medical claim merely because several employees share one arrangement. Obtain the master policy, membership evidence and the terms governing the particular treatment or assistance benefit.
An eligible person's public healthcare rights and a private insurer's promise arise from different systems. Necessary care during a temporary stay under Article 19 of Regulation (EC) No 883/2004 differs from planned treatment requiring the relevant authorisation under Article 20. A European Health Insurance Card does not automatically cover any private clinic chosen by the patient, repatriation or every additional charge. The provider's participation in the applicable public system matters. Equally, the absence of public reimbursement does not by itself defeat a private policy that expressly covers the expense. Each route requires its own eligibility and documentation assessment.
The practical consequence is to identify which part of the bill belongs to which arrangement. A hospital may provide covered public care while charging separately for an additional service, or a private clinic may fall entirely outside the public route. The insurance schedule may include a deductible, a per-treatment limit or a restricted provider network. The permissible limit structures are recognised in Article 427(4) КЗ. An expense-reimbursement benefit and an agreed fixed cash benefit under Article 427(2) should also be distinguished. Proof of a qualifying event may justify the fixed benefit without matching it to every invoice, whereas reimbursement requires establishing the covered expenditure and avoiding duplicate recovery of the same expense.
The consequence depends on the obligation actually agreed, the reason for non-contact and the governing legal rules. A policy may require the assistance centre to arrange a provider or approve non-urgent expenditure. The claimant should preserve attempted calls, messages and hospital records showing incapacity or urgency. Failure to follow an administrative step is not automatically the same as absence of an insured event. The insurer should explain whether it disputes initial coverage, invokes an exclusion or alleges breach of a duty, since those arguments require different facts. Necessary emergency treatment should not be retrospectively described as an elective choice merely because prior telephone approval was impossible.
A pre-existing-condition objection needs the same precision. Written risk questions and known material circumstances are governed by Article 362 КЗ, while intentional non-disclosure and unknown circumstances are distinguished by Articles 363 and 364. A diagnosed condition, an unexplained symptom and an illness discovered only after treatment are different facts. In Decision No 60063 of 30 June 2021, commercial case No 351/2020, the Supreme Court of Cassation's first commercial division rejected a broad medical exclusion in a credit-life case where relevant written questions had not been asked. That is a limited analogy about unfair exclusion wording, not a travel preauthorisation ruling or a declaration that every prior-condition exclusion is invalid.
Medical cover can reimburse expenses paid by the insured or provide services through contracted providers under Article 428(1) КЗ. Direct billing concerns the arrangement for the provider to seek payment without requiring the patient to fund the entire covered amount first. Reimbursement ordinarily requires evidence of the expense and payment. An assistance centre's promise to investigate is not necessarily an unconditional payment guarantee to the hospital. Ask what was approved, for which treatment, up to what amount and subject to which conditions. A patient should retain both the insurer communication and any separate hospital undertaking signed at admission.
A dispute about one claim also does not relieve the insurer of deciding another claim properly. In Decision No 2871 of 28 April 2023, cassation case No 1920/2023, the Administrative Court Sofia City, Third Panel, upheld a sanction concerning delayed determination of a separate group medical claim. The insurer's earlier refusal of another claim, citing an exhausted package, did not replace an express timely decision on the later one under Article 108(1) КЗ. This was administrative penalty review, not a civil award of benefits beyond the policy limit. It is useful where a claimant receives silence or a reference to an old refusal instead of an answer to the particular bill submitted.
Transport, specialised care and other related services can be included within medical insurance under Article 427(3) КЗ, but inclusion and conditions must be established. Travel assistance may separately promise repatriation following a defined medical event. An ambulance to the nearest suitable hospital, transfer between hospitals and transport to the home country can therefore be different benefits. A broad medical-expense limit does not necessarily include all three. The contract may require medical necessity, coordination by the assistance provider or a specific transport method. The clinical reason, available alternatives and actual approval should be recorded before the dispute is reduced to the size of the invoice.
A doctor's statement that the patient is fit to fly differs from a recommendation for accompanied medical transport, and neither alone proves the insurer agreed to pay a preferred route. Evidence should explain the patient's needs, the service selected and the contractual condition relied on. If the insurer delegates claims or assistance functions, its responsibility within that outsourcing is addressed by Article 110(2) КЗ. That does not make it automatically responsible for every independent clinic or transport company. The claimant should identify whether the disputed act was performed by the insurer's delegated provider, a contracted medical provider or a service independently chosen by the patient, because those relationships affect the available claim.

Medical necessity must be assessed against the insured benefit and the contemporaneous clinical facts. A bill proves that a charge was made, but not necessarily why the treatment was required or covered. The Bulgarian Insurance Code (Кодекс за застраховането, КЗ) distinguishes expense, fixed-benefit and service-based medical cover in Articles 427 and 428. The closest limited England and Wales comparison is the FCA requirement for prompt and fair claims handling in ICOBS 8.1.1R. Bulgarian entitlement still depends on the actual contract. Identify the event, medical reason for the disputed service, applicable limit and whether the claim seeks reimbursement or an agreed sum.
Useful records include the admission findings, diagnosis, tests, treatment plan, discharge summary and itemised invoice, with proof of payment where reimbursement is sought. The documents should identify the same patient and dates. A generic receipt marked medical services may not distinguish covered treatment from accommodation upgrades or other extras. If the insurer says a procedure was unnecessary, request the clinical and contractual basis of that conclusion and obtain the treating clinician's explanation of the recorded circumstances. The purpose is not to ask a doctor to decide coverage, but to establish the medical facts on which the legal interpretation depends.
Preserve original invoices and receipts together with reliable translations where required. The translation should retain treatment descriptions, dates, currency and amounts, rather than replace a detailed invoice with a brief summary. A payment-card debit can differ from the invoice because of conversion or fees. Show the original charge, actual amount paid and the policy provision governing conversion, instead of choosing whichever exchange rate gives the highest claim. If several family members paid different parts, link each payment to the relevant service and explain who incurred the expense. Payment by another person and ownership of the insurance right are not necessarily identical questions.
Medical evidence from several countries should be arranged chronologically. A Bulgarian emergency admission may be followed by treatment at home, and the later records can explain continuing need without proving that every later expense falls within the original trip cover. Distinguish follow-up care, a new event and treatment outside the permitted period. Obtain documents through lawful access rights and authorisation. The insurer's access to necessary medical information under Articles 107 and 454 КЗ does not justify sending unrelated private records to every intermediary. The claimant should know who receives the records, for which claim and why the particular information is relevant.
Returning home does not itself determine whether an already occurring insured event is payable. The policy's event, territorial and time conditions must be checked separately from the place where the claimant now resides. Preserve the assistance reference, hospital contacts, original documents and proof of the journey before departure. If a provider demands payment, examine the hospital agreement and any guarantee given by the insurer. A pending insurance dispute does not automatically suspend a separate payment undertaking signed by the patient. Conversely, an invoice alone does not resolve whether the provider agreed to bill the insurer for the covered part.
The immediate choices should be documented. Request an itemised statement, identify undisputed charges and seek clarification of the direct-billing arrangement. If payment is made to avoid a separate hospital dispute, retain proof and make clear which insurance claim remains pursued. A receipt should not be confused with a broad settlement releasing the insurer. Where the provider or assistance company gave conflicting instructions, preserve the actual messages and identify the sender's role. ARG can help assess those documents and coordinate representation through authorised Bulgarian lawyers, including where the traveller can continue the claim remotely rather than return simply to deliver routine paperwork.
Notice requirements, submission conditions, the insurer's decision period and limitation are different calendars. A policy clause requiring prompt contact should be examined alongside the reason for any delay and the relevant mandatory rules. A written monetary claim should include payment-account details under Article 380(1) КЗ unless the agreed performance is in kind. The insurer must record the claim and documents under Article 106(2). Keep receipt confirmations and a list of attachments, because the date of complete evidence may determine the decision period. A portal upload without confirmation can otherwise leave uncertainty about what the insurer actually received.
For ordinary relevant claims within Article 108(1) КЗ, the insurer must determine payment or give a reasoned refusal within fifteen working days after all necessary evidence. For these ordinary claims with incomplete evidence, Article 108(2) sets an outer decision period of six months from submission. The benefit classification and any applicable special or large-risk rules must still be checked, including Article 109, rather than applying this period to every package component. In Decision No 2871 of 28 April 2023, cassation case No 1920/2023, the Administrative Court Sofia City, Third Panel, confirmed that an earlier refusal of another medical claim did not replace timely determination of the new claim. The sanction did not award compensation beyond an exhausted benefit limit. It shows why each claim and its submission date should be identified separately when challenging silence.
The first response should address the actual ground for refusal. Missing proof, a medical-necessity dispute, an exhausted sublimit and an excluded event call for different evidence. A complaint about amount can request the factual and legal explanation within seven days under Article 108(6) КЗ. The Financial Supervision Commission can examine claims-handling compliance, but it does not replace a civil court's resolution of a contested contractual entitlement. Before suing, identify the contracting insurer rather than assume that the assistance centre, broker or hospital is the debtor merely because that organisation handled the correspondence.
A foreign-issued policy also requires a governing-law and jurisdiction assessment. An incident in Bulgaria does not automatically make every foreign insurer subject to every Bulgarian contractual rule. The policy, insurer's establishment, claimant's position and applicable international instruments determine the route. Where Bulgarian proceedings are available, the claim should specify the unpaid benefit, supported interest where legally due and amounts already reimbursed. A regulatory complaint should not be mistaken for the court action required to preserve or enforce the monetary claim. Clear identification of the debtor and relief prevents a medically well-documented case from being directed against the wrong organisation.
Insurance limitation depends on the legal class of the benefit. The general three-year rule in Article 378(1) КЗ differs from the five-year rule for accident and sickness under paragraph 2. A mixed travel package should therefore be classified benefit by benefit instead of applying a single period to its marketing name. Claim submission suspends time under paragraph 9 until receipt of the decision or expiry of the applicable maximum decision period, whichever is earlier. Continued reconsideration does not indefinitely suspend every related claim. The dates of the event, submission, actual decision receipt and any payment should be preserved while negotiations continue.
Bulgarian court evidence follows the Civil Procedure Code (Граждански процесуален кодекс, ГПК). A limited England and Wales comparison is evidence management under the Civil Procedure Rules, including Part 32. The allocation in Article 154(1) ГПК requires proof of facts supporting the claim and defences. Relevant identified documents may be sought under Articles 190 and 192; expert medical assessment is available under Article 195 when specialised knowledge is needed. The court considers the expert's reasoning with other evidence under Article 202. A useful expert question connects the symptoms and treatment to the disputed necessity or timing, leaving interpretation of coverage and legal responsibility to the court.
