An adviser’s mistake and an insurer’s duty to pay are separate questions. ARG helps clients and insured professionals establish responsibility, timing, coverage and the defensible amount.

Clients ask ARG whether a professional’s insurance must pay after advice proves wrong or a deadline is missed. The answer depends on the duty actually accepted, the loss caused and the policy covering the legally relevant event. A certificate alone resolves none of those questions.
ARG can assist in the following situations.
Prove the professional’s actionable error and the insurer’s obligation under the relevant policy.
Article 469 and the rules for the profession may determine the event and applicable period.
An insured’s admission or private settlement can affect the relationship with the insurer.
The advice, harmful result and later demand can occur on different dates.
Professional indemnity insurance covers an insured professional's established liability within the applicable contract and compulsory rules. It does not guarantee that every client obtains the hoped-for result. The framework comes from Articles 429 and 469 of the Bulgarian Insurance Code (Кодекс за застраховането, КЗ). For comparison, solicitors' indemnity insurance in England and Wales operates within the Solicitors Regulation Authority's profession-specific framework. That comparison highlights the need to identify the particular profession and insurance regime rather than assume that an overseas policy model applies to a Bulgarian architect, notary or other regulated adviser.
A dissatisfied client must identify the accepted task, the applicable duty, the departure from it and the resulting compensable loss. A court case can be lost despite competent representation, while a missed filing can constitute a serious omission even before the client knows the final financial result. Causation remains essential. If the omitted application could never have succeeded, its non-filing does not automatically justify the value of the benefit sought. Conversely, a professional cannot answer a missed deadline merely by saying that success was uncertain. The original entitlement and evidence must be examined to determine what consequence the omission actually produced.
The insured may be an individual or a legal entity. Compulsory professional cover extends to representatives and employees, and to persons entrusted with work who are included in the insurance contract, under Article 469(5) КЗ. A separate independent adviser is not automatically covered by another professional's policy. The engagement party, actual performer and insured names therefore matter. A parent company paying a subsidiary's professional invoice does not necessarily acquire the subsidiary's compensation claim. The claimant must establish the right affected and the person to whom the professional owed the relevant obligation.
Coverage must also match the activity. The compulsory regime connects the work to Bulgarian registration or recognised professional qualification within Article 469(3), unless another regulatory rule applies. The client's foreign residence alone does not exclude the service, and a Bulgarian office does not automatically insure every foreign assignment. The policy and professional permissions must be considered together. Where several people contributed, the question is which conduct caused which loss and whether the responsible person is insured. Naming every participant in a transaction is not a substitute for identifying the legally relevant duty and causal contribution of each.
A claims-made term focuses on when the demand is made within its contractual conditions; an event-based term focuses on the defined insured occurrence. Bulgarian compulsory professional insurance has a specific default. The event is the harmful result for which the insured is responsible under Article 469(1) КЗ, unless legislation provides otherwise. The act, damage, discovery and demand can therefore fall in different years. The current insurer is not automatically responsible simply because the complaint arrived during its policy. Any voluntary claims-made or retroactive wording must be assessed within the governing compulsory framework rather than assumed to displace it.
The significance is illustrated by Decision No 313 of 28 May 2024, civil case No 2024/2023, of the Bulgarian Supreme Court of Cassation's fourth civil division. In that notarial dispute, the majority located the purchasers' damage at the transaction in which they failed to acquire the purported rights, rather than at the later ownership judgment. The decision included a dissent and is not a rule that every professional loss occurs on the advice date. It shows why the legally relevant harmful result must be identified before selecting the policy year or calculating limitation. Discovery of an old mistake may reveal an earlier event without creating a new one.
Compulsory liability insurance protects the injured person even when the insured intentionally caused the harm under Article 432(3) КЗ. The insurer's corresponding recourse against the insured is addressed by Article 433. This separates the client's protection from the professional's personal exposure. It does not mean that deliberate misconduct becomes consequence-free, or that an allegation of dishonesty eliminates the need to prove liability and damage. Voluntary coverage and a particular profession's compulsory rules must be distinguished before applying a policy exclusion. A clause cannot simply be treated as overriding mandatory protection for the injured person.
Legal costs require a different analysis from intentional-conduct exclusions. Costs awarded to the injured person in proceedings against the insured are included within the insurance amount where the insurer was joined, under Article 429(5) КЗ. Representation arranged by the insurer or its designated person with the insured's authorisation is governed by Article 430(3), including the stated treatment of those expenses within the sum insured. Neither provision is a blanket promise to reimburse any lawyer independently chosen on any terms. Before incurring substantial defence costs, the professional should establish who is authorised, what is covered and whether interests diverge because the insurer also disputes coverage.
A client can have a valid claim against the professional while part of it falls outside a particular insurance promise. Liability for third-party harm is distinguished from agreed cover for contractual non-performance in Article 429(1) КЗ. Repayment of a fee, a contractual penalty, the cost of correcting deficient work and compensation for a lost asset do not become identical insurance claims merely because they appear in one demand. Each head should be classified and connected to the applicable cover. The insurer's objection to one item does not necessarily defeat another properly supported item arising from the same engagement.
The distinction also affects amount. Direct lost profit from tort is included within Article 429(2)(1), while contractual lost-profit cover is addressed separately by Article 429(4). A forecast is not proof of a lost gain. The Supreme Court of Cassation's Interpretative Decision No 3 of 13 January 2023, interpretative case No 3/2021, requires certainty of proof of lost profit caused by tort. Confirmed contracts, funding, available capacity and the conditions for earning the income matter. The ruling does not establish the professional's breach or the insurer's coverage. It prevents a possible future commercial success from being presented as an already proved financial loss.
The injured person may seek indemnity directly from the liability insurer under Article 432(1) КЗ, complying with the written-claim requirements of Article 380. This route avoids treating the insurer as the person who performed the professional work, but still requires proof of the insured's liability and applicable coverage. The insurer can raise relevant liability and contractual defences, subject to statutory exceptions. Specified objections concerning the professional's notification and procedural duties cannot be asserted against the injured person under Article 432(2). For compulsory liability insurance, the professional's agreed contribution likewise cannot be used to reduce the injured person's entitlement on that basis.
That protection does not abolish the policy limit. If claims from one event exceed the compulsory insurance amount, Article 470 establishes priorities and proportional payment within each rank. Subject to the statutory exceptions, specified injury or death claims precede property claims, followed by subrogated and other claims. Two established claims in the same rank for 100,000 and 200,000 would share an available 150,000 as 50,000 and 100,000, assuming no unpaid higher-ranking claim. This is proportional allocation, not equal payment per claimant. The professional's remaining personal liability must be assessed separately, and a settlement should specify which persons and heads of loss it actually releases.

Build a chronology separating instruction, performance, harmful result, discovery and first demand. Compulsory professional insurance normally uses the harmful result as the event under Article 469(1) of the Bulgarian Insurance Code (Кодекс за застраховането, КЗ), unless legislation provides otherwise. The closest useful comparison is the claims-made framework for qualifying solicitors' insurance in England and Wales, which demonstrates why the latest policy cannot simply be selected by assumption. Obtain earlier policies, endorsements and any retroactive provisions. The insurance certificate alone may omit the temporal condition that decides which insurer is potentially responsible.
The engagement letter, accepted quotation, instructions, drafts and delivery records establish the scope of work. A final report may omit a later correction, while an internal draft may show that a warning was considered but never communicated. Preserve both favourable and unfavourable material, including attachments and version histories. For a missed application, identify who had to supply each document, when it was supplied and whether the professional warned that filing would be impossible without it. These facts can distinguish a professional omission from a delay caused by missing client information. A later note should bear its actual date rather than appear to be a contemporaneous record.
An expert should address a defined professional question using the information reasonably available at the time. An engineer may assess whether a design met technical requirements; an accountant may explain a calculation; neither decides every issue of contractual scope or insurance coverage. If a lost procedural opportunity is alleged, the original substantive right and available evidence must also be examined. The question is not whether hindsight reveals a better outcome, but whether the accepted task required a different step and whether that step would have prevented the claimed consequence. The client's actual decisions, warnings received and feasible alternatives are part of that assessment.
Judicial proof follows the Bulgarian Civil Procedure Code (Граждански процесуален кодекс, ГПК). The nearest general comparison in England and Wales is evidence regulation under the Civil Procedure Rules, including Part 32, while the Bulgarian proceedings apply Article 154(1) ГПК to facts supporting claims and defences. Specialised examination can be appointed under Article 195(1), and the court assesses its reasoning with other evidence under Article 202. A private report assists preparation without automatically binding the court. An effective challenge identifies a wrong document version, omitted warning, unsupported assumption or incorrect calculation, rather than merely objecting that the expert reached an unfavourable conclusion.
The professional should not wait for a quantified lawsuit. Notification under Article 430(1) КЗ covers potentially liability-generating circumstances, the event, demands, service of proceedings and payments, with the stated seven-working-day periods linked to the relevant knowledge, service or payment. A notice can report the allegation accurately while reserving the professional's position. If several insurers may be relevant, supply a consistent chronology and explain the uncertainty. Earlier risk information is assessed against written questions and known circumstances under Article 362. Alleged deliberate non-disclosure requires the conditions and consequences of Article 363, rather than an automatic assumption that every unanswered detail defeats cover.
A factual correction or sensible remedial step should be distinguished from admitting the whole compensation demand. Preserve the possibility of reducing harm, but agree the role of the insurer before promising an insured settlement. A settlement or acknowledgment by the professional binds the insurer if approved under Article 434(1) КЗ; the authorised representative's knowledge and consent have the effect specified in paragraph 2. Reimbursement after the professional pays is subject to Article 435. An apology, a release and a payment undertaking perform different functions. The professional should understand what is being accepted, who will pay and which remaining claims the wording closes.
Start with each accepted task and its causal contribution. An architect's design, an engineer's inspection and a consultant's later advice may concern one project without creating identical obligations. A claimant should distinguish damage that would have occurred anyway from additional damage caused by a later failure to detect or correct the problem. The relevant professional and insurer may differ for each component. Evidence of delegation also matters because compulsory cover includes entrusted performers only within the conditions of Article 469(5) КЗ. Neither the number of advisers nor their participation in one transaction proves that every policy covers the whole loss.
When several injured people compete under one compulsory policy, Article 470 КЗ separately governs distribution if same-event claims exceed the available sum. Obtain the insurer's explanation of the event, relevant payments and asserted exhaustion. Timely notice matters because paragraph 2 addresses a claimant omitted for reasons attributable to that claimant where the insurer neither foresaw nor should have foreseen the later demand. Do not confuse this insurance allocation with the underlying allocation of civil liability among advisers. A settlement with one participant should identify its effect on the remaining claims and avoid both double recovery and an unintended release of a different responsible person.
The injured client's written demand to the insurer should identify the professional, work, breach, causal loss and amount, with payment-account information required by Article 380 КЗ. A direct claim under Article 432(1) and a claim against the professional are related but distinct routes. International jurisdiction and domestic competence depend on the parties, underlying relationship, insurance contract and requested relief. The professional regulator's disciplinary process can examine conduct but is not itself a civil payment judgment. Likewise, the Financial Supervision Commission's supervision of claims handling does not replace a court's determination of disputed professional liability and indemnity.
If the professional is sued, sending the papers to the insurer is not necessarily the same as seeking its participation in court. The duty under Article 430(2) КЗ must be coordinated with the procedural opportunity under Article 219 ГПК. The defence should identify which facts are admitted, which duties are disputed and whether the insurer contests coverage separately. ARG can arrange representation through appropriately authorised Bulgarian attorneys and clarify whose interests each representative protects. This matters when an insurer's preferred defence could leave the professional personally exposed, or when a claimant mistakenly assumes the insurer's investigator is providing independent advice to the claimant.
The harmful-result date can decide both coverage and limitation. In Decision No 313 of 28 May 2024, civil case No 2024/2023, the fourth civil division of the Supreme Court of Cassation located damage in the particular notarial transaction where purchasers failed to acquire the purported rights, rather than in a later ownership judgment. The majority's fact-specific reasoning does not make discovery irrelevant as evidence, but prevents it from automatically becoming the event date. Compulsory professional insurance uses the five-year limitation rule through Articles 469(2) and 378(2) КЗ. The separate claim against the professional may require its own calculation.
The suspension after an insurance claim under Article 378(9) КЗ ends on receipt of the decision or expiry of the applicable maximum decision period, whichever occurs first. Ongoing negotiations or a disciplinary complaint do not indefinitely protect all civil rights. Foreign engagement documents, technical reports and payment records may need translation for Bulgarian proceedings, and authority to instruct counsel must come from the actual claimant. If the professional has ceased practice, investigate the additional five-year cessation insurance required by Article 469(6), unless legislation provides otherwise. That inquiry can reveal a relevant policy, but does not itself guarantee that every historical loss satisfies its conditions.
