Life Insurance Payout and Beneficiary Disputes in Bulgaria

A death benefit may belong to a nominated beneficiary or creditor rather than the estate. ARG helps determine the correct recipient and challenge a refusal based on health disclosure, exclusions or policy lapse.

Life Insurance Claims

Clients often ask ARG who should receive a life insurance payment after a family member dies, especially when a bank still holds an unpaid loan. The question becomes harder if an old nomination names someone else or the insurer alleges an undisclosed illness.

ARG can assist in the following situations.

  • A death claim is refused because of an allegedly inaccurate health questionnaire.
  • Several nomination forms or family members point to different beneficiaries.
  • A bank claims the proceeds while relatives have continued repaying the loan.
  • An unpaid premium is said to have terminated a savings life policy.
  • A beneficiary abroad needs to prove identity, entitlement and the correct payment destination.

How does a life insurance contract operate when the insured person dies?

Who can be named as beneficiary and when does the designation matter?

A life policy promises the agreed benefit when the insured event and contractual conditions are established. It is not simply reimbursement of the family's expenses. The framework is the Bulgarian Insurance Code (Кодекс за застраховането, КЗ), particularly Articles 438, 444 and 448. A limited England and Wales comparison is the statutory trust available for certain family life policies under section 11 of the Married Women's Property Act 1882. Bulgarian beneficiary rights do not depend on assuming such a trust. The policyholder, insured person, premium payer and beneficiary may be different people, so identifying those roles is the first step towards identifying who can receive payment.

The policyholder can designate a third-party beneficiary at inception or during the contract under Article 444(1) КЗ. A revocable designation can be changed, whereas an irrevocable one cannot be changed during the term on that basis. The operative nomination therefore matters more than a relative's expectation. If children are described without names, later-born children are included unless otherwise agreed under paragraph 4. An unnamed spouse refers by default to the person married to the policyholder when the event occurs under paragraph 5. That wording concerns the policyholder, who is not necessarily the insured. Named and class-based nominations can consequently produce different results after remarriage or the birth of another child.

What proves death and continuing insurance cover?

A death certificate establishes the civil fact of death, but the insurer may also require relevant evidence of the insured event, cause and amount. The claim should identify the policy, insured person, beneficiary and payment account under Article 380(1) КЗ. A document proving death does not alone show that the policy remained effective or that the particular cause was insured. Obtain the schedule, applicable conditions, endorsements and premium history. For group life cover, membership and the relevant period can be decisive even if the deceased never received an individual policy. Information duties towards insured and entitled persons are addressed by Article 441(3) and (4).

A missed premium should not be treated as automatic proof that every savings life policy ended immediately. The particular regime in Article 446 КЗ requires written invitation to pay with at least one month from receipt. Depending on the statutory conditions, including premiums paid for at least two years or at least fifteen per cent of total premiums, the contract may continue with a reduced insured sum rather than simply end. This rule concerns life insurance with a savings element and should not be copied indiscriminately to every policy. The notice, receipt date and calculation of reduced cover can therefore determine whether a refusal for non-payment is justified.

How are beneficiary rights different from ordinary inheritance rights?

The life insurance sum is outside the relevant estate under Article 445(1) КЗ, including when heirs are designated as beneficiaries. A beneficiary who is also an heir can renounce the inheritance without losing the insurance benefit under paragraph 2. Being entitled to the policy payment and accepting estate debts are therefore different legal questions. A family should not sign an inheritance document solely because it assumes that every insurance payment requires acceptance. Nor does an inheritance certificate override an effective nomination of another beneficiary. The legal source of the payment right must be identified before determining which succession documents are genuinely needed.

The distinction is especially important where the policyholder insured another person's life. Express written consent is normally required by Article 443(1) КЗ, subject to the specific employer-funded group exception in Article 441(2). Payment of premiums alone does not necessarily establish the payer's right to the death benefit. Where the insured is also the policyholder and no third-party beneficiary is designated, Article 448(5) addresses payment to heirs. A previously nominated beneficiary's earlier death requires the separate rule in Article 444(7), including any contractual substitute. These are different routes to entitlement, not a single rule that the closest relative always receives the money.

When may the insurer challenge the health questionnaire?

How do deliberate non-disclosure and an innocent mistake differ?

The statutory disclosure inquiry focuses on material circumstances known to the relevant person and expressly asked about in writing under Article 362 КЗ. Preserve the actual questionnaire, not merely a later insurer summary. A broad allegation that the insured should have volunteered every medical detail is not equivalent to proving an inaccurate answer to a particular written question. The insurer's acceptance of incomplete or unclear responses, previously disclosed facts and matters independently checked are relevant under Article 362(3) to (5). These protections do not authorise deliberate concealment, but require the refusal to be tested against what was asked and what the insurer already knew.

Intentional inaccurate disclosure is distinguished from unknown circumstances by Articles 363 and 364 КЗ. After an event, Article 363(4) connects refusal to the effect of the concealed circumstance on occurrence. If it only increased the damage, the provision instead allows the specified premium-ratio reduction, rather than refusal on that basis. A later diagnosis does not itself prove that the insured knew of the illness when answering. Medical dates, symptoms, prior consultations and the wording of the question need to be connected. The insurer bears the specified burden for health-based refusal or reduction under Article 448(8), so an assertion of concealment must be supported rather than inferred from the eventual cause of death alone.

When can an exclusion concerning the cause of death apply?

A cause-of-death exclusion is a question about the agreed risk and applicable statutory limits, separate from whether an answer was dishonest. The default exclusions in Article 449 КЗ are subject to contrary agreement and must be applied to their exact conditions. A policy's medical exclusion also requires scrutiny of its wording and the consumer regime where applicable. Unfair terms are controlled by the Bulgarian Consumer Protection Act (Закон за защита на потребителите, ЗЗП), including Articles 143 and 146. The limited England and Wales comparison is consumer fairness review under section 62 of the Consumer Rights Act 2015. Neither comparison means that every clearly defined medical exclusion is invalid.

The distinction was important in Decision No 60063 of 30 June 2021, commercial case No 351/2020, of the Supreme Court of Cassation's first commercial division. The insurer had not asked the relevant written health questions but relied on a very broad pre-existing-illness exclusion covering direct or indirect involvement. The court treated the particular clause as an unfair discretionary escape under Articles 143(2)(6) and 146(1) ЗЗП. This does not invalidate every exclusion or prove every family claim. The court ordered payment to the creditor bank, not personally to the deceased's daughter, illustrating that defeating a refusal and identifying the lawful recipient remain separate issues.

What if several beneficiaries or competing payment instructions exist?

Several beneficiaries have equal rights unless the contract provides otherwise under Article 444(6) КЗ. A nomination of two people in unequal stated shares therefore differs from naming them without an allocation. Refusal or inability to receive a share, failure to claim within limitation and predeceasing the insured engage distinct provisions. They should not be collapsed into an assumption that the deceased beneficiary's relatives automatically inherit the nomination. A substitute beneficiary or a later valid amendment may change the result. Obtain the complete sequence of nominations, the insurer's records of receipt and any document said to make a designation irrevocable.

A creditor arrangement, an assignment and a beneficiary nomination also perform different functions. The creditor's entitlement under loan-linked insurance must be examined under Article 382 КЗ rather than inferred from possession of the policy. A document presented as an assignment requires assessment of what right was actually transferred and whether the competing instructions affect the same amount. Intentional conduct by a beneficiary that triggers disqualification is separately addressed by Article 444(8) to (10). Allegations between relatives do not establish those conditions by themselves. The payment claim should identify the operative entitlement, relevant share and any creditor portion, so the dispute is resolved by the documents and law rather than family seniority or who contacted the insurer first.

When is a bank entitled to a loan-linked life insurance payment?

Which amendments and beneficiary forms determine the recipient?

Begin with the actual insured loan and creditor arrangement, not the assumption that all life proceeds belong to the estate. The creditor's entitlement and the treatment of any surplus are addressed by Article 382 of the Bulgarian Insurance Code (Кодекс за застраховането, КЗ). A limited England and Wales comparison is the separate beneficial arrangement available for certain family life policies under section 11 of the Married Women's Property Act 1882. Bulgarian loan-linked insurance must be analysed under its own creditor rules. The balance relevant to the insured event, policy limit, subsequent repayments and designated recipient need to be reconciled before anyone demands the entire sum personally.

Request the original policy, group membership evidence if applicable, loan agreement, endorsements, nomination forms and the insurer's record of changes. A bank's current repayment statement may not identify the debt at the event date. Separate principal, relevant interest, payments after death and amounts outside the agreed cover. Certain heirs, co-debtors or guarantors have rights concerning the claim under Article 382, but that does not make each of them the recipient of the creditor portion. A qualifying person who lawfully repaid after the event may have a right under Article 456, subject to its conditions and the insurer's contractual defences. The date and legal basis of each repayment therefore matter.

How should disputed medical history be established fairly?

Build a dated medical chronology tied to the questionnaire. Distinguish the date of first symptoms, consultation, diagnosis and communication of the diagnosis to the insured. A condition discovered later is not automatically something knowingly concealed earlier. Conversely, an earlier recorded diagnosis can matter even if the insured considered it minor. The exact written question determines what answer was required under Article 362 КЗ. Records should identify the patient consistently and show whether a statement is a contemporaneous medical finding or a retrospective opinion. Obtain records through the lawful entitlement of the claimant or authorised representative, not by assuming every relative has unlimited access.

The insurer's refusal should identify the disputed answer, alleged knowledge, relevant condition and causal consequence. Where specialised assessment is necessary, a medical expert can distinguish a condition's existence from its contribution to death. The statutory burden for health-based refusal or reduction in Article 448(8) КЗ should remain visible in that analysis. The family still needs evidence of its own entitlement and the insured event. A technical disagreement should be expressed through questions the expert can answer, such as whether the recorded diagnosis preceded the declaration or whether the identified condition caused the event. The validity and interpretation of an exclusion remain legal questions.

What if the beneficiary lives abroad or has changed name?

Can heirs claim when no effective beneficiary nomination exists?

A foreign address or changed surname does not by itself remove an established beneficiary right. The claimant must prove that the person identified in the nomination is the person requesting payment. A marriage certificate, civil-status record or linked identity documents may resolve that issue more directly than a lengthy statement about family history. Foreign documents need the authentication or translation required for their particular use, with the country and instrument checked first. Do not assume that every document needs identical formalities. Payment-account details should identify the entitled recipient or a lawfully authorised arrangement, avoiding confusion between the beneficiary's right and a relative's convenient account.

Where there is no effective nomination, identify why it is ineffective before applying a fallback. The insured-policyholder situation in Article 448(5) КЗ differs from a beneficiary who died first under Article 444(7). A contractual substitute may control the latter case. If heirs are beneficiaries, Article 445 keeps the benefit outside the estate and preserves the beneficiary-heir's right despite renunciation. That statutory distinction prevents an unnecessary inheritance acceptance from being treated as a routine insurance formality. Where several heirs or beneficiaries claim, obtain the documents establishing their category and shares rather than assuming that the first certificate or first application settles competing rights.

How should a medical-disclosure refusal be challenged?

Separate three questions in the response. Was the insurer's written question answered inaccurately, was the relevant fact known and legally material, and does the asserted consequence satisfy the applicable statutory rule? Attach the actual questionnaire and the medical records answering those points. If the insurer instead invokes an exclusion, analyse the clause as an exclusion rather than accepting a moving allegation of dishonesty. Consumer fairness may be relevant under Articles 143 and 146 of the Bulgarian Consumer Protection Act (Закон за защита на потребителите, ЗЗП). The nearest limited England and Wales comparison is section 62 of the Consumer Rights Act 2015, without importing its result into Bulgarian proceedings.

The Supreme Court of Cassation's Decision No 60063 of 30 June 2021, commercial case No 351/2020, first commercial division, provides a concrete example. The court rejected a broad pre-existing-illness clause used where relevant written health questions had not been asked, treating the clause as unfair under Articles 143(2)(6) and 146(1) ЗЗП. The ruling is useful when the same defect is present, not as a universal answer to every medical refusal. It also directed payment to the bank. A beneficiary or heir contesting refusal must therefore request the payment legally due to the correct recipient rather than assume that a successful challenge necessarily produces money payable personally to the person bringing the dispute.

How can an overseas claimant obtain a legally effective payment decision?

Which complaint or court procedure addresses the actual disagreement?

Submit a written claim identifying the policy, event, basis of entitlement and payment account under Article 380 КЗ, retaining proof of receipt and an attachment list. The life-benefit payment rule in Article 448(6) provides fifteen working days after the requested evidence establishing the event and amount is supplied. A request for documents must be assessed for relevance and legal obtainability within the claims-handling framework of Article 106. The claimant should explain an unavailable record and identify an alternative source rather than simply ignore the request. Equally, an insurer should not treat endless irrelevant requests as a substitute for deciding the claim.

The Financial Supervision Commission can examine compliance with supervisory claims-handling duties, while a disputed entitlement or payment amount may require a civil claim against the responsible insurer. Only the person entitled to receive payment has the direct claim contemplated by Article 448(7) КЗ, subject to the separate creditor-related routes where applicable. International jurisdiction and domestic competence need assessment from the insurer, parties and actual claim. A family disagreement about the nomination should be identified before choosing relief. ARG can arrange document review and representation through appropriately authorised Bulgarian attorneys, with the authority to receive documents, settle and receive money clearly distinguished.

Which time limits and evidence must be preserved while the claim is disputed?

Life insurance rights generally carry the five-year limitation period under Article 378(2) КЗ. The event and relevant legal basis must be identified rather than starting the calendar automatically when a relative discovers the policy. Submission of the claim suspends limitation under Article 378(9) until receipt of the insurer's decision or expiry of the applicable maximum decision period, whichever occurs first. An internal complaint, a request for reconsideration or continuing correspondence should not be assumed to create unlimited protection. Preserve the submission, actual receipt of the decision and any later payment, because those facts can materially affect the remaining time and amount.

If court proceedings are needed, evidence is governed by the Bulgarian Civil Procedure Code (Граждански процесуален кодекс, ГПК). A limited England and Wales comparison is court control of evidence under the Civil Procedure Rules, including Part 32. The general burden in Article 154(1) ГПК operates alongside the specific insurance burden already described. Identified documents held by an opponent or third party can be sought through Articles 190 and 192, and medical expertise through Article 195 where special knowledge is required. The court evaluates expert reasoning with other evidence under Article 202. Preserve complete records and translations so the claim can establish entitlement, event and amount while testing the insurer's particular defence.

Questions and answers

01 / 06

Does the life insurance payment form part of the estate?

Article 445 treats the life insurance sum separately from the estate, including where heirs are beneficiaries. The particular nomination and payment right still need to be established.

Does renouncing inheritance automatically waive the insurance benefit?

No. A beneficiary who is also an heir can retain the life insurance entitlement despite renunciation. The beneficiary arrangement and other relevant facts must be checked.

Can an insurer refuse simply because an earlier illness existed?

An earlier diagnosis alone does not resolve the issue. The applicable exclusion or disclosure rule, written questions, knowledge and required connection with the event must be examined.

How can ARG assist a beneficiary?

ARG organises the policy history, claimant documents and specialist communication. An independently engaged authorised Bulgarian lawyer provides legal advice and representation.
