An insurer’s offer may omit covered work or require a final waiver. ARG helps establish the payable balance, the correct decision and interest dates, and the consequences of accepting money.

Clients often ask ARG whether accepting a small insurance payment will prevent them from claiming the rest. The immediate concern may be a repair bill, but the answer also depends on the offer’s wording, the insurer’s explanation and the documents already supplied.
ARG can assist in the following situations.
The unpaid balance and the date when payment became overdue require distinct legal and evidential assessments.
Repair scope, valuation basis, limits and deductions should each connect with the policy and the proven loss.
A payment and a broad release of further rights can have different effects. Review interest, costs and later consequences.
Claims handling periods, limitation and the available court route depend on the insurance and the documented chronology.
A missing document matters when it is genuinely needed to establish the event, entitlement or amount. The Bulgarian Insurance Code (Кодекс за застраховането, КЗ) requires registration of the claim and evidence under Article 106(2), while paragraph 5 prohibits legally unobtainable evidence and immaterial demands intended to delay settlement. The Financial Conduct Authority's prompt and fair claims-handling rule in ICOBS 8.1.1R offers a limited England and Wales comparison. It does not replace the Bulgarian deadlines. An insurer cannot make a relevant document irrelevant by ignoring it, or make an irrelevant request necessary merely by repeating it.
For ordinary claims within Article 108(1) КЗ, payment or a reasoned refusal is due within fifteen working days after all necessary evidence. The incomplete-file maximum is six months under paragraph 2, excluding the special motor liability route, where Article 496 provides a three-month final-position period. Large risks and specified insurance classes require separate treatment under Articles 108(5) and 109. A business policy is not automatically exempt from the ordinary timetable. Where repair by an external contractor was agreed, Article 108(7) distinguishes timely written commissioning from completion within a reasonable or specifically agreed period. Fifteen working days is therefore not a universal physical-repair deadline.
Interest requires a due payment and the correct start date. Property insurance delay is addressed by Article 409 КЗ, alongside Article 380(3), which matters where payment-account details were not properly supplied. The general monetary-default rule is Article 86 of the Obligations and Contracts Act (Закон за задълженията и договорите, ЗЗД). Interest on debts under section 69 of the County Courts Act 1984 is a limited England and Wales comparison, not a source of the Bulgarian rate. Calculate the applicable rate for the relevant period rather than insert an outdated percentage into every demand.
Motor liability has a specific insurer-delay rule. The starting point under Article 497(1) КЗ is the earlier expiry of fifteen working days after all necessary evidence or the three-month period, subject to its exception concerning requested evidence not supplied by the injured person. This interest must be distinguished from interest attached to the insured person's underlying liability. A claimant should identify the principal, dates, earlier payments and the legal basis of each interest component. A partial payment ordinarily changes the outstanding principal for the following period. The same period and amount should not be counted twice simply because two statutory provisions are mentioned in the claim.
Underpayment usually means that the insurer accepts some liability but disputes the calculation or a particular component. A complete refusal may deny the insured event, the claimant's entitlement or the entire contractual obligation. The response should match the issue. An independent repair estimate may expose omitted labour but will not by itself answer an allegation that the policy excludes the cause of damage. Conversely, proving coverage does not establish that every item in a contractor's quotation is a necessary consequence of that event. Separate the accepted amount, rejected items and reasons for each deduction.
The insurer's payment description also matters. A unilateral transfer of the amount it considers due differs from a signed agreement resolving the whole dispute. Ask for the itemised assessment and compare it with the policy basis, deductible, limit and proven damage. A percentage reduction for alleged misconduct is not interchangeable with an agreed excess. In Decision No 604 of 22 October 2024, civil case No 1679/2023, the Supreme Court of Cassation's Fourth Civil Division rejected an automatic motor-theft reduction bypassing Article 395(4) and (5) КЗ. The insurer had to establish the relevant causal and proportional basis. The decision does not abolish valid coverage limits or excuse proof of the insured event.
A settlement resolves an existing or possible dispute through mutual concessions under Article 365 ЗЗД. Its effect depends on the actual agreement, the harm identified and its validity, not merely the heading of the form. A statement that the recipient is fully compensated can have greater consequences than a receipt for an interim payment. Before signing, check whether it covers only a repair invoice or also later medical consequences, interest and claims against other persons. An accompanying protest may not neutralise an otherwise clearly accepted final agreement.
The consequences are illustrated by Interpretative Decision No 1 of 30 January 2017, interpretative case No 1/2016, of the Supreme Court of Cassation's General Assembly of Civil and Commercial Colleges. A valid, performed motor-insurer settlement expressly providing full compensation for the same harm precludes additional recovery of that harm from the insurer or tortfeasor, even if the latter did not sign. The holding concerns the substantive merits, not automatic procedural inadmissibility. Different harm, an agreement constrained by the insurance limit or a legally established invalidity requires separate analysis. An unfavourable bargain is not automatically invalid simply because later advice suggests that more could have been claimed.
Property indemnity generally corresponds to actual damage at the event, within the sum insured, under Article 386 КЗ. An agreed fixed value under Article 387 differs from an ordinary limit. Actual and reinstatement values are distinguished by Article 400, with reinstatement involving new equivalent property without depreciation where that basis governs. The calculation should identify necessary quantities, labour, materials and justified deductions. Lost profit requires an agreement under Article 405(2). A damaged shop's repair cover therefore does not automatically compensate every lost sale, even where the closure and damage occurred together.
Underinsurance is another distinct issue. The default under Article 389(1) КЗ is full covered damage up to the insured sum, outside the agreed-value exception; proportional compensation requires an agreement under paragraph 2. If value is 100,000, the sum insured 50,000 and covered damage 20,000, the default is 20,000 before other adjustments. An applicable proportional agreement could produce 10,000. Medical expenses and fixed medical benefits likewise require different calculations under Article 427. The invoice total may prove an expense claim but does not set an agreed fixed benefit. Each example assumes coverage and the relevant terms rather than promising a particular award.
An internal complaint can expose a calculation error and obtain the insurer's position without immediate litigation. For a complaint about the amount, Article 108(6) КЗ requires a written factual and legal explanation within seven days. Identify the disputed repair item, exclusion, date or deduction instead of demanding reconsideration in general terms. A reasoned answer may narrow the dispute even if it does not increase the offer. A complaint to the Financial Supervision Commission concerns regulatory compliance; it does not itself produce a civil judgment awarding the disputed indemnity.
A court claim seeks an enforceable decision on the contractual or direct insurance entitlement. It needs the correct claimant, insurer, amount and supporting facts. In motor liability, Article 498 КЗ requires a prior written claim and provides the relevant conditions for court proceedings after nonpayment, refusal or disagreement over amount. Other insurance categories must be examined under their own rules. Neither repeated internal correspondence nor a regulatory complaint should be assumed to preserve time indefinitely. Limitation under Article 378 distinguishes insurance classes, and paragraph 9 ends claim-related suspension upon receipt of the decision or expiry of the applicable maximum period, whichever occurs earlier.

Start with the submission record, because a sound valuation cannot establish when the insurer became late. The Bulgarian Insurance Code (Кодекс за застраховането, КЗ) requires registration of claims and subsequent documents under Article 106(2). A limited England and Wales comparison is the FCA's prompt and fair claims-handling requirement in ICOBS 8.1.1R. For the Bulgarian claim, retain the claim form, delivery confirmation, attachment list, later requests and responses. The date printed on a medical report is not necessarily the date the insurer received it. Identify the actual delivery method and the recipient's role.
Separate initial notice from a monetary claim, and distinguish the last document sent from the last necessary document. A late unsolicited duplicate should not automatically be treated as restarting the whole timetable. Conversely, an essential missing medical report cannot be replaced by saying that many other papers were supplied. Accurate payment-account details are required by Article 380(1) КЗ unless performance is in kind, and omission can affect delay consequences under paragraph 3. A chronological record should therefore show both evidence and payment instructions. If the insurer disputes completeness, require it to identify what specific relevant fact remains unproved and which requested document addresses it.
A useful expert identifies the disputed assumption. For repair costs, this may be the number of damaged components, necessary dismantling, labour hours, material specification or pre-event value. Photographs, inspection reports, invoices and comparable market evidence should support that assumption. A higher quotation alone does not prove that every proposed improvement is covered. Medical disputes require clinical findings, treatment records and evidence of the consequences actually claimed. Distinguish reimbursement of medical bills from a fixed contractual benefit and from non-material harm under liability insurance. Those claims cannot be valued by one universal tariff.
The legal effect of alleged misconduct also requires proof. Supreme Court of Cassation Decision No 604 of 22 October 2024, civil case No 1679/2023, Fourth Civil Division, concerned a stolen vehicle and a clause reducing payment because a registration document was left inside. The court required the insurer to prove the causal and proportional grounds under Article 395(4) and (5) КЗ, rather than rely on an automatic percentage. This reasoning is useful for a comparable preventive-duty deduction, not every exclusion. Private investigation and valuation expenses under Article 397(1) require prior insurer approval for reimbursement on that basis. Commissioning a report does not automatically make its cost recoverable.
A transfer of the undisputed amount is not necessarily a final settlement. Read the payment letter and every document requiring a signature. A receipt can confirm money received, while a release may extinguish the balance or additional categories of harm. Ask for any proposed settlement to identify the exact damage, amount, interest and reserved issues. If the offer is conditional on a final agreement, the claimant cannot assume that adding a separate reservation unilaterally rewrites the bargain. The safest assessment occurs before acceptance, when wording can still be negotiated and consequences understood.
The Supreme Court of Cassation's Interpretative Decision No 1 of 30 January 2017, interpretative case No 1/2016, General Assembly of Civil and Commercial Colleges, gives a concrete warning. A valid, performed motor-insurance agreement expressly settling the same harm in full can bar further recovery from both insurer and tortfeasor. It is not a ruling that every bank transfer waives all rights. Preserve the agreement, correspondence, payment evidence and medical or repair information available when it was concluded. Where later harm or invalidity is alleged, identify that distinct issue and its proof instead of merely describing the original sum as too low.
Respond to each document request by identifying what was supplied, what can lawfully be obtained and why a disputed request is unrelated to the claim. The prohibition in Article 106(5) КЗ protects against legally unobtainable evidence and immaterial demands aimed at delay. It does not excuse withholding genuinely relevant records already available to the claimant. The additional-evidence rules in paragraphs 3 and 4 must be applied to the particular claimant and request. A focused written response makes it possible to assess the decision deadline under Article 108 rather than allowing the file to remain indefinitely labelled incomplete.
Separate claims also require separate decisions. In Decision No 2871 of 28 April 2023, cassation case No 1920/2023, the Administrative Court Sofia City, Third Panel, upheld a sanction for delayed determination of a medical claim despite an earlier refusal concerning another claim. The previous exhausted-package explanation did not replace the response required by Article 108(1) КЗ for the new submission. The judgment did not award civil benefits beyond the policy limit. A claimant facing silence can use the submission history in a supervisory complaint while independently considering the civil payment action and its limitation period.
First decide whether the objective is an explanation, regulatory action, a negotiated payment or an enforceable award. These are different outcomes. A request under Article 108(6) КЗ addresses the calculation, whereas the Financial Supervision Commission examines compliance and the competent civil court decides disputed payment rights. An independent expert can explain medical or technical facts but cannot order payment or decide policy interpretation. ARG can coordinate that work and representation through authorised Bulgarian lawyers. The contracting insurer must be identified separately from a broker, assistance provider or claims handler whose name appears on correspondence.
A foreign policy, insurer or claimant makes jurisdiction and governing law separate questions. An event in Bulgaria does not automatically settle either. Before choosing proceedings, establish the insurer's legal identity, applicable international framework and any relevant policy clause, then assess the domestic court and venue. For a motor direct claim, preserve the prior written claim required by Article 498 КЗ and the refusal, amount disagreement or expired period enabling litigation. A court demand should deduct payments already received and distinguish principal from interest. This prevents an otherwise justified balance claim from including money already paid or being directed against the wrong entity.
Foreign repair invoices, hospital records and corporate authority documents must connect the claimant to the right and the amount sought. Preserve originals, complete translations and the original currency alongside any conversion basis. Evidence in Bulgarian proceedings is governed by the Civil Procedure Code (Граждански процесуален кодекс, ГПК). A limited England and Wales comparison is evidence management under Civil Procedure Rules Part 32. The factual burden follows Article 154(1) ГПК, identified documents may be sought under Articles 190 and 192, and expert evidence under Articles 195 and 202 assists the court without replacing its legal judgment.
Limitation should be calculated before negotiations consume the remaining time. The ordinary three-year insurance period differs from the five-year categories in Article 378(1) and (2) КЗ; interest has its separate rule in paragraph 8. Claim submission suspends time under paragraph 9 until the earlier of actual decision receipt and expiry of the applicable statutory maximum. Preserve envelopes, electronic delivery evidence and authority showing who received the answer. A foreign judgment or Bulgarian award pursued against assets abroad additionally requires the applicable recognition and enforcement route. The insurer's location and available assets therefore matter alongside the strength of the valuation evidence, especially when settlement and litigation costs are compared.
